HomeMy WebLinkAboutResolution 2017 (40) Resolution No. 40 (2017) ST ROUK,,, RESOLUTION APPROVING ALTERATION OF SUPERVISORY ' �' "''° DISTRICT BOUNDARY- CITY OF NEW RICHMOND (TOWN OF STANTON) 1 WHEREAS,in 2011 the St. Croix County Board of Supervisors adopted a 10-year supervisory 2 district plan creating county supervisory districts,municipal aldermanic districts and election wards 3 following the 2010 Census; and 4 5 WHEREAS, Wisconsin Statutes § 59.10(3)(c) allows a county board,in its discretion, to alter the 6 boundaries of supervisory districts based on annexations which occur after the adoption of the 10-year 7 supervisory district plan, as long as the number of supervisory districts is not changed; and 8 9 WHEREAS, the City of New Richmond completed an annexation in September 2016 of a parcel 10 described on the attached map consisting of 1.38 acres; and 11 12 WHEREAS, a map of the annexed parcel, along with a copy of the annexation ordinance has 13 been filed with the St. Croix County Clerk and are attached; and 14 15 WHEREAS, the parcel annexed by the City of New Richmond is part of County Supervisor 16 District 11, consisting of Ward 1,in the Town of Stanton; and 17 18 WHEREAS, it is appropriate to move the annexed parcel into County Supervisor District 12 in 19 Ward 2, City of New Richmond; and 20 21 WHEREAS, the population of the annexed parcel is zero; and 22 23 WHEREAS, this resolution does not change the number of supervisory districts. 24 25 THEREFORE be it resolved by the St. Croix County Board of Supervisors that the supervisory 26 district boundaries are hereby altered by moving the annexed parcel of land from County Supervisor 27 District 11 to County Supervisor District 12 consisting of Ward 2 in the City of New Richmond as shown 28 on the attached. 29 30 FURTHER be it resolved that the St. Croix County Clerk is hereby directed to forward all notices 31 required under Wisconsin Statutes, Chapter 59, to the Secretary of State for the purpose of advising that 32 office of said supervisory district boundary changes. 33 Legal—Fiscal—Administrative Approvals: Legal Note: None Fiscal Impact: None JA c .Cey ox,Corpvrat o ouunsel 81 121717k hart M' Fiace ixecior 112�I7 ra ck rhompsam,comity Aamini 811 M2017 08/16/17 Administration Committee APPROVED ......... ......... ......... ......... ......... ......... ......... ......... ......... ......... ......... ......... ......... ......... ......... .......... THE COMMON COUNCIL OF THE CITY OF NEW RICHMOND DOES ORDAIN AS FOLLOWS:OWSo Section 1. Territory Annexed. The following described territory presently located in the Town of Stanton is hereby annexed to the City of New Richmond. Territory described as follows: City of New Richmond See 30 T31N R17W 1.38 Acres. Commencing 156 East First Street at the intersection of the north right-of-way New Richmond,WI 54017 of the highway with the west line of the SEA of the SW 1/4 section 30. Thence north along the west line 300 feet,thence east parallel with said right- of-way line 200 feet,thence south 300 feet to said right-of-way line,thence west 200 feet to the point of beginning. (Property owned by Jeff Moberg) Section 2. Effect of Annexation. From and after the date of this ordinance the territory described in Section I shall be a part of the City of New Richmond,for any and all purposes provided by law and all persons coming or residing within such territory shall be subject to all ordinances, rules and regulations governing the City of New Richmond. Section 3. Temporary Zoning Classification. (a) Upon recommendation to the City Council of the City of New Richmond the territory described above,annexed to the City of New Richmond by this ordinance is designated as Z3 Multi-Use/Corridor District. Section 4. Ward Designation. The territory described in Section I of this ordinance is hereby designated as part of Ward 2,Aldermanic District 1,of the City of New Richmond. Section 5. Severability. If any provision of this ordinance is invalid or unconstitutional,or if the application of this ordinance to any person or circumstances is invalid or unconstitutional,such invalidity or unconstitutionality shall not affect the other provisions or applications of this ordinance which can be given effect without the invalid or unconstitutional provision or application. Section 6. Effective Date. This ordinance shall take effect upon passage and publication as provided by law.
