The St. Croix County Board of Adjustment (Board) has reviewed your request for the following
items:
1. Conditional Use Permit to construct a lift according to Section 17.36 F.3.a.3) and an
addendum to the Conditional Use Permit to fill and grade greater than 10,000 square
feet outside of the slope preservation zone according to Section 17.36 F.3.a.6).
After the hearing on July 27, 2017, the Board approved the Conditional Use requests with conditions.

FINDINGS, CONCLUSIONS, AND DECISION
OF THE ZONING BOARD OF ADJUSTMENT
ST. CROIX COUNTY, WISCONSIN

FINDINGS OF FACT AND CONCLUSIONS OF LAW
Having heard all the testimony, considered the entire record herein, and visited the site, the Board of Adjustment
makes the following Findings of Fact and Conclusions of Law pertinent to the applicant's Conditional Use
requests:
1. The property owners are Justin Gerstner and Christine Athmann; the agent is Jon Sonnentag.
2. The site is located at 1406 Hilltop Ridge, Houlton, WI 54082 in part of Government Lot 4 of Section
22, T30N, R20W, Town of St. Joseph.
3. The site is 3.8 acres and is located in the Lower St. Croix Riverway Overlay District.
4. The applicant filed an application with the St. Croix County Board of Adjustment for a Conditional
Use Permit to construct a lift according to Section 17.36 F.3.a.3.) of the St. Croix County Zoning
Ordinance.
5. The applicant submitted an addendum to the Conditional Use Permit to fill and grade greater than
10,000 square feet outside of the slope preservation zone according to Section 17.36 F.' ).a.6) of the
St. Croix County Zoning Ordinance.
6. On February 27, 2017 a Land Use Permit (LUP-2017-007) was approved by Community
Development Department staff to construct a conforming single family residence, structural erosion
control, a stormwater system and vegetation removal.
7. A lift is required to provide pedestrian access to the river due to steep and unstable site conditions.
8. The lift is designed for pedestrian transportation, not to transport boats or machinery.
9. The car of the lift will not exceed 4 feet by 6 feet. A canopy or roof will not be installed.
10. All lift components will be powder-coated and finished in earth-tone, non-reflective colors.
11. Limited vegetation removal for the lift is required and shall be confined to one foot on either side
of the lift route and up to 8 feet above the lift floor.
12. Native vegetation plantings will be installed if natural vegetation does not effectively screen the lift
from the river within 5 years.
13. There is not an existing lift installed on the property.
14. The lift component has been certified by a registered professional engineer in 1989 and recertified
in 2006.
15. The existing septic system will be relocated, away from the bluffline; abandonment will require
limited filling and grading near the slope preservation zone.
16. The stormwater management plan has changed from a below grade infiltration trench to rain
gardens. This will still meet the ordinance standards; the switch is primarily due to easier
maintenance and repair in the future.
DECISION
On the basis of the above Findings of Fact, Conclusions of Law, and the record herein, the Board approved
the applicant's Conditional Use requests, with the following conditions:
1. The upper and lower landing of the lift shall be limited to 40 square feet.
2. The lower landing of the lift shall be located above the Floodplain boundary.
3. All lift components shall be securely anchored to prevent them from shifting, from soil disturbance
and from future erosion according to the professional engineer certification.
4. All components of the lift shall be painted or finished in earth-tone colors, non-reflective colors:
colors are displayed in the St. Croix County Community Development Department suite.
5. All parts of the lift, including the transporting device or power source, shall be visually
inconspicuous or made to be within 5 years with native plantings.
6. Vegetation may not be removed within the slope preservation zone unless it necessary for the
installation of the lift and is compliant with the requirements of Section 17.36 H.13.a.8).
7. There shall be no land disturbance within the slope preservation zone.
8. The new septic system shall be installed per code.
9. Any revision to the stormwater management plan shall be reviewed and approved by St. Croix
County Community Development Department staff.
10. The property owner shall execute and record an affidavit describing the approved stormwater
management, erosion and sediment control and vegetative management plans and maintenance
requirements for each with the County Register of Deeds within 30 days after construction is
completed.
11. Any modification to the Land Use Permit will require prior administrative review and approval by
the Zoning Administrator.
12. These conditions may be amended or additional conditions may be added if unanticipated
circumstances arise that would affect the health and/or safety of citizens or degrade the natural
resources of St. Croix County. Conditions will not be amended or added without notice to the
applicant and an opportunity for a public hearing.
13. Any new owners of the property must adhere to the standards and conditions of the approved
Conditional Use Permit. Any change or addition in use of the property, buildings; or modification
of or addition to the property or buildings shall require review by the Zoning Administrator to
determine if the use may be allowed. This decision applies to the property rather than to the
individual, is valid for only the specified property, and is not transferrable to other properties.
14. Accepting this decision means that the applicant and their agent have read, understand, and agree
to all conditions of this decision, and have no objections to County staff conducting unannounced
onsite inspections to check for compliance with this permit.
The following vote was taken to approve the request: Chairman Malick; Yes, Peterson, Yes; Nelson, Yes;
McAllister, Yes; Sontag, Yes. All in favor, motion carries.
APPEAL RIGHTS
Any person aggrieved by this decision may file an appeal in St. Croix County circuit court within 30 days
after the filing date shown below, pursuant to Sec. 59.694(10), Wisconsin Statutes. St. Croix County
assumes no responsibility for action taken in reliance on this decision prior to the expiration of the appeal
period. St. Croix County does not certify that the identity of all persons legally entitled to notice of the
Board of Adjustment proceedings, which resulted in this decision, was provided to the County.
If an appeal is taken of this decision, it is the responsibility of the appellant to submit at his/her expense a
transcript of the Board of Adjustment proceedings to the circuit court. The Community Development
Department can be contacted for information on how to obtain a transcript. It is the responsibility of the
Board of Adjustment to submit its record (file) of this matter to the circuit court.

CONDITIONAL USE CRITERIA
Pursuant to the St. Croix County Zoning Ordinance Section 17.70(7), please answer the following questions to justify
the approval of your request (attach additional paper if necessary):
1) Describe the details of your request.
This Conditional Use is an expansion of current LUP 2016-061. The development of this site was contingent
upon building permits and land use permit. Now that those have been issued and this lot is able to be used as
intended for a single family home, we are requesting conditional uses for the necessary use, environmental
sustainability, and neighborhood impact.
1. Construction of a Lift - this property is on a bluff and a lift is necessary for safe access to the river, and to
minimize disturbance when accessing the river.
2. Grading in excess of 10,000 sq ft - To improve the storm water management and natural appearance of this
lot we are requesting grading in excess of 10,000 sq ft.
3. Grading within the bluffline setback, but outside of the slope preservation zone. - To replace the current
POWTS that has a drainfield in the slope preservation zone.
2) Describe the impact of your request on the enjoyment and value of surrounding properties. If there is no impact,
explain why.
This project will improve the enjoyment and value of surrounding properties. The improved grading and
POWTS will further reduce any runoff concerns. The previously approved below grade stormwater
management will be replaced with rain gardens. The rain gardens will be more simple to maintain and much
easier to repair if there are any problems in the future. The lift and modified grading and storm water
management will improve the value of this property and therefore surrounding properties as well.
3) Describe the compatibility of your request with the uses and character of the surrounding area.
This request is to maintain use of a single family residential home, comparable with the surrounding area. The
project includes significant improvements to the property and will strengthen the natural beauty of the riverway
by providing a well maintained property and long term sustainability. Multiple lifts and stairways exist in this
area to provide access to the river.
4) Describe how your request is consistent with the spirit and intent of the zoning district in which your property is
located. (Please rifer to the purpose statement for your zoning district in the St. Croix County Zoning Ordinance.)
1) Reducing the adverse effects of overcrowding - this project will maintain a stable single family home in an
area that is not overcrowded.
2) Preventing soil erosion and pollution and contamination of surface water and groundwater. - This project will
improve the storm water management and replace a drainfield with a system that is located much further from
the existing bluff.
3) Providing sufficient space on lots for sanitary facilities. - The improvements under construction were
designed to provide room for the installation of a new sanitary system.
4) Minimizing flood damage. - This project will improve the storm water management and erosion control to
reduce any potential impacts on the St. Croix River floodplain.
5) Maintaining property values. - Addressed above
6) Preserving and maintaining the exceptional scenic, cultural, and natural characteristics of the water and
related land of the Lower St. Croix Riverway
- This project will protect the current slope preservation zone, provide more suitable sanitary facilities, and
install improvements that enhance the long term maintenance and stability of the property. Page 2 of 4
5) Describe how your request will impact public health, safety, and general welfare. What measures will you take to
minimize any negative impacts?
This project will be implemented with best management practices under the review of local authorities and
required permit approvals. Normal construction precautions will be implemented to insure a safe building site
and minimize impacts on local traffic. The general contractor and applicant will oversee the project to insure
that all construction practices are completed properly and that any concerns are addressed immediately. The
proposed lift will provide safer access to the river and a means to provide quick assistance to anyone in need of
help along shoreline.
6) How will you ensure that your request will not constitute a nuisance by reason of dust, smoke, odor, or other
similar factor? What measures will you take to prevent a nuisance?
The potential for any nuisance will be monitored throughout the project by the general contractor and
landowner. Good communication has been established with all neighbors. Disturbance is limited to the
maximum amount practicable so the potential of dust from bare soil is minimal. If dry conditions arise, the site
will be watered to control dust. No materials will be burned on-site and the use of heavy equipment will be
limited to 1 or 2 days for the septic installation.
7) Additional comments:
The proposed lift is consistent with the St. Croix County ordinance as follows:
1. The existing slope is too steep and unstable for pedestrian access.
2. The lift is not designed to transport a boat or machinery up or down the slope.
3. The *car will not exceed 4'x 6' and will not have a canopy.
4. The proposed lift location was chosen to avoid the removal of trees to the maximum extent practicable. An
existing ravine location was reviewed, but deemed potentially unstable and posed construction challenges.
5. The lift will be powder-coated in earth.-tone, non-reflective colors in order to be visually inconspicuous.
6. Native vegetation plantings shall be used were needed to provide visual screening (likely accomplished by
the existing vegetation that will remain).
7. The proposed location will allow for existing vegetation to provide immediate screening.
8. Tree removal will only occur within 1' of the proposed lift location.
9. This is the only lift that will exist on the property.
10. Pipe anchors will be driven into the ground to avoid soil disturbance and future erosion.
*A landing (<40 sgft) at the top and bottom will be constructed to access the car.

GENERAL CONDITIONAL USE APPLICATION PROCEDURE
APPLICATION:
The deadline for application submittals is the 1st Monday of the month before the regularly scheduled St. Croix County Board of
Adjustment meeting. The Board of Adjustment generally meets on the 4 h Thursday of the month.
Applications will not be accepted until the applicant has:
• Met with the Zoning Administrator to review the application;
• Original plus 10 conies submitted of the entire packet including all supporting information, maps & diagrams;
• Resolved any land use violations and paid any outstanding fees owed to the Community Development Department;
• Signed the application form (the signatures of the property owners and agents acting on their behalf are required); and
• Submitted the appropriate application fee (nonrefundable) payable to St. Croix County.
REVIEW:
The Zoning Administrator will review the application for completeness and assign a file number to the application. The Zoning
Administrator may require additional information and will notify the applicant of this within 10 days. Upon receiving a complete
application and supporting documents, the Zoning Administrator will:
• Schedule a public hearing with the St. Croix County Board of Adjustment and notify the applicant by mail of the date and
time of the public hearing;
• Notify adjoining property owners of the applicant's request;
• Publish a public hearing notice in the local paper;
• Send copies of the applications to the appropriate town and reviewing agencies for comment. Applicants are encouraged to
contact their town and attend their town meeting to discuss their application;
• Schedule a site visit to the applicant's property, at which time the applicant shall flag all applicable property/project corners
and label the flags accordingly; and
• Prepare a staff report on the application. The staff report will be mailed to the applicant and will be available for public
review during the week prior to the public hearing.
ACTION:
Conditional Use permits are granted at the discretion of the St. Croix County Board of Adjustment. They are made available to
validate uses that, while not approved within the zoning district in question, are deemed to be compatible with approved uses and"or
not found to be hazardous, harmful, offensive or otherwise adverse to other uses. Conditional Uses are subject to conditions,
compatibility with surrounding land uses, and compliance with the St. Croix County Zoning Ordinance.
At the public hearing, the applicant may appear in person or through an agent or an attorney of his/her choice. The
applicant/agent/attorney may present testimony, evidence and arguments in support of his/her application. The fact that an application
for a permit has been filed does not automatically mean that a permit is granted.
Upon the Board making a decision on the application, the Zoning Administrator shall notify the applicant of the decision in writing.
All site plans, pictures, etc. become the property of the Community Development Department and will remain in the file.

residence that is under construction. The disturbance required to install the lift will be limited to hand tools in
order to limit the impact on the steep slopes.
2) Explain how this request addresses Items 1-7 on Pages 2 -3 of your original conditional use permit application.
