To whom it may concern,
This letter is to advise that the Community Development Department (CDD) staff have reviewed your
Land Use Permit application for the construction of an attached garage, breezeway and cabin addition
within the Rural Residential and Shoreland Zoning Districts. The request for a Land Use Permit is
approved based on the application conditions and the following findings:
• All setbacks based on the site plan have been met and the structure meets the 20-foot maximum
height requirement for an accessory structure.
• Aushegun Trail is a private road, therefore a road setback does not apply.
• There will be more than 2,000 sq. ft. of land disturbance on slopes less than 12% within the
Shoreland Overlay District.
• The total Impervious surfaces currently existing and proposed are less than 15% due to the large
acreage of impervious surface on the parcel, therefore mitigation is not required.
• According to the Wisconsin Departments of Financial Institutions, this property is owned by
Aushegun 1, LLC. The registered Agent office is 1312 89th St., New Richmond, WI 54017
• All members of Aushegun 1, LLC consent to the construction at 786 Aushegun Trail.
• Erosion and sediment control plans have been provided that meet or exceed WDNR Technical
Standards.
• The accessory structure will not be hooked up to the existing sanitary system nor require the
installation of a new sanitary system.
Based on these findings, approval of the Land Use Permit is subject to the following conditions:
pre-construction inspection is required to verify erosion control installation and that the

2. Erosion control and seeding shall be installed according to the General Erosion Control Notes on
the site plan prior to any land disturbance activities. St. Croix County reserves the right to require

additional erosion control measures to be installed during construction if found necessary due to
site-specific conditions.
3. A post-construction inspection will be required prior to removing erosion control measures to
determine the entire project site has reached a point of 70% permanent vegetative cover. It is the
applicant/agent's responsibility to schedule this with the CDD staff.
4. Erosion control and seeding shall be installed according to the General Erosion Control Notes on
the site plan prior to any land disturbance activities. St. Croix County reserves the right to require
additional erosion control measures to be installed during construction if found necessary due to
site-specific conditions.
5. Failure to comply with the terms or conditions above may result in the revocation of this permit
by the Zoning Administrator.
This permit is valid for one year, with the possibility of up to two (2) six month extensions if the applicant
submits the appropriate permit extension fee and documentation to the CDD staff. The permit card is
recommended to be posted on the job-site.
IT IS THE APPLICANTS/AGENTS RESPONSIBILITY TO ARRANGE INSPECTIONS. FAILURE TO
DO SO MAY RESULT IN A CITATION. Prior to an inspection, the CDD staff shall be given at minimum
2 full business days' notice to ensure an inspection time can be arranged.
This approval is subject to the conditions listed above; it does not allow for any additional construction,
structures, grading, paving, filling or clearing of vegetation beyond the limits of this request. This permit
does not approve neighboring sites nor future projects within the site. For any other projects/plans please
contact the CDD staff. Your information will remain on file at the St. Croix County Community
Development Department suite. It is your responsibility to ensure compliance with any other local, state,
or federal permitting or regulations, including contacting the town of Somerset and the Wisconsin
Department of Natural Resources to inquire if additional permissions are required.

786. Attached are excerpts of the meeting held March 26, 2017, memorializing the
membership's consent to the proposed building project.

2. Current Business - Report from Land Use and Futures Committee
Committee Chair Cecil summarized the three committee meetings and a
special meeting with Annie and Mike regarding the Van Pelt sale conditions and
year-around residency. The main concerns discussed were the many potential
issues arising from year-round residency and the Van Pelt's purchase condition
of attaching a garage (their offer expires on June 1, 2017).
An extensive discussion ensued. Numerous issues related to both concerns were
voiced. They included the following:
Road security and how to lock the gate
Road maintenance particularly in the winter
Need for a professional architect or landscape architect to provide a
site plan with advice as to best land use
Difficulty in getting a mortgage
Separate the Master Plan from deciding on the Van Pelt's garage
request
People need to meet the Van Pelts
We should not kick the can down the road; we need to get on with a
plan with use and development rules
Consideration. of moving the driveway will not bar the transaction
Two motions were presented. (1) Cecil Chally moved and Jon Morgan seconded
that the Bass Lake Associates hereby permit and approve (a) year-round
residency and (b) the Van Pelt's proposed garage attached to the current Brose
cabin as depicted in their sketch (attached) facing west at the top of the current
driveway, provided that (i) the building permit is jointly applied for by Aushegun 1, LLC
and the Van Pelts, and (ii) all members will have to April 15 to
object in writing to the President. Motion unanimously approved.
No objections were received.
