Mike Wilberg J CO 2068 110th Street New Richmond, WI 54017 RE: Conditional Approval: File# LUP-2017-056 Project Location: 22.31.18.379A-10; Town of Star Prairie Dear Mike Wilberg, Community Development staff have reviewed the Land Use Permit application for construction of a new accessory structure (30' x 64' pole building) for personal, cold storage, within the Shoreland Overlay District, Chapter 17.30. The request has been conditionally approved based on the application submission and the following findings. Please see the enclosed site plan to reference the general erosion control and grading notes. • According to FEMA Firm Map Panel No. 5510900062E, a portion of the property is mapped Zone A. The Regional Flood Elevation (RFE) is between 865 and 866. The project as proposed is above this profile elevation. • An Impervious Surface (IS) calculation was provided which is compliant with Ch. 17.30 J. The amount of new and existing IS is less than 15%, therefore mitigation is not required. • Erosion and Sediment Control plans have been submitted that meet Wisconsin Department of Natural Resources Technical Standards. • There are existing buildings that do not entirely comply with the OHWM structure setback. Improvements beyond Ordinary Maintenance and Repair on nonconforming structures require review and approval from this Department. • This approval does not allow for a driveway expansion up to the proposed shed as indicated on the site layout as this does not comply with the OHWM structure setback. • According to the St. Croix County land information records, this property was created to its current configuration in 2000 and is described as a remnant of other parcels. Ch. 13.13 B.30. (Previously known as Ch. 18) requires a subdivision to be created if less than 35 acres in area. This requirement was in effect at the time the property was created to its current configuration, therefore the property is considered as an illegal lot creation. Based on these findings, approval of the Land Use Permit is subject to the following conditions: 1. The 75-foot structure setback to the Ordinary High Water Mark (OHWM) must be flagged to the closest poi of the proposed structure, included roof overhang or eave. A pre-construction inspection is required to verify the structure setback and the se, liment and erosion control has been installed per plan prior to any land disturbance activity. The existing septic tank shall be abandoned per SPS 383 code. Contact Rick Ingli to update the permit folder file when this has been completed. 4. The property shall be legally described by a Certified Survey Map (CSM) which is to be approved by Community Development staff, and then recorded with the St. Croix County Register of Deeds. 5. St. Croix County reserves the right to require additional sediment and erosion control measures to be installed if found necessary due to site-specific concerns. 6. It is the applicant's responsibility to secure any other required local, state or federal permit(s) and approval(s) prior to land disturbance activity. 7. Failure to comply with the terms or conditions above may result in the revocation of this permit by the Zoning Administrator according to Chapter 17.30(13). This approval is subject to the conditions listed above; it does not allow for any additional construction, structures, or buildings beyond the limits of this request. Your information will remain on file at the St. Croix County Community Development Department suite. It is your responsibility to ensure compliance with any other local, state, or federal permitting or regulations, including contacting the Town of Star Prairie and the Department of Natural Resources to inquire if additional permissions are required. This permit is valid for one year, with the possibility of up to two (2) six-month extensions if the applicant submits the appropriate permit extension fee and documentation to the Zoning Administrator. A copy of the Land Use Permit placard should be submitted to the local Building Inspector for the town upon application for the building permit. The orange placard must be posted on the job-site and visible from public view. This proposed land Planning disturbance will require 1,083 sq. ft. of grading for the foundation, will be greater than 75 715-386-4674 ft. from both ponds OHWM, will be on slopes <12%, and the existing principal structure has a LOMA on file for floodplain elevations. This project meets filling and grading Real Property requirements allowed without a permit as per Section 17.29(2)(b) of the county Shoreland 715-386-4677 Overlay District zoning ordinance. Although I did a similar determination for your pole Recycling building this past April, that project has been completed and the area has been stabilized. 715-386-4675 To minimize negative impacts to your ponds from the increase in impervious surfaces, I recommended that you infiltrate rain runoff from the roofs. Tammy already has a couple rain barrels in use and downspouts from gutters should be directed into planting areas or other landscape features, like rain gardens. Your existing house has rock drainage beds along the foundation, which is another way to infiltrate runoff. The proposed addition does not include any bedrooms and the Private On-site Wastewater Treatment System (POWTS), designed for the existing two-bedroom dwelling, was replaced in 2011.
