ST. R01"'w YNTY REQUEST FOR REZONING- TOWN OF FOREST
1 WHEREAS, the Gary W. and Frances M. Heinbuch Trust owns 40 acres of land located
2 at 2929 Highway 64 (Parcel ID#: 014107360000) in the Town of Forest, WI in Section 34 T3 IN
3 R15W that is zoned Agricultural; and
4
5 WHEREAS, residential parcels created in the Town of Forest Agricultural Zoning
6 District require lot sizes of no less than 2.5 acres and no more than five (5) acres; and
7
8 WHEREAS, the owners desire to create an 8.89 acre residential parcel and need to rezone
9 to an Agricultural-Residential Zoning District that allows residential lot sizes greater than five
10 (5) acres; and

12 WHEREAS, the subject parcel is legally described as follows:

A PARCEL OF LAND LOCATED IN THE NORTHEAST QUARTER OF THE NORTHWEST QUARTER OF SECTION 34,
TOWN OF FOREST,ST. CROIX COUNTY, WISCONSIN,FURTHER bESCRIBED AS FOLLOWS:
COMMENCING AT THE NORTHWEST CORNER OF SAIb SECTION 34; THENCE N87°42'42"E 1329.16' ALONG THE
NORTH LINE OF THE NORTHWEST QUARTER OF SAID SECTION 34 TO THE POINT OF BEGINNING; THENCE
CONTINUING N87°42'42"E 784,99' ALONG SAID NORTH LINE; THENCE S00°06'20"W 493.67'; THENCE
S87°42'42"W 784.99' TO THE WEST LINE OF THE NORTHEAST QUARTER OF THE NORTHWEST QUARTER OF
SAID SECTION 34; THENCE NOO°06'20"E 493.67' ALONG 5AIb WEST LINE TO THE POINT OF BEGINNING,
CONTAINING 387,186 SQUARE FEET(8,89 ACRES)MORE OR LESS AND BEING SUBJECT TO ANY EASEMENTS,
RESTRICTIONS OR COVENANTS OF RECORD.

16 WHEREAS, the Gary W. and Frances M. Heinbuch Trust has petitioned the Town of
17 Forest to rezone subject property from Agricultural to Agricultural-Residential in order to create
18 one new residential lot; and
19
20 WHEREAS, the Town of Forest Plan Commission met on September 11, 2017 and,
21 following due advertisement announcing the public hearing by law, conducted a public hearing
22 on the petition and recommended approval of the rezoning petition for the Gary W. and Frances
23 M. Trust to rezone 8.89 acres from Agricultural to Agricultural-Residential; and

25 WHEREAS, the Town of Forest Town Board met on October 10, 2017 and approved the
26 rezoning request; and

28 WHEREAS, Section 60.62(3), Wisconsin Statutes states that in counties having a county
29 zoning ordinance no town zoning ordinance amendment is effective unless approved by the
30 county board; and

32 WHEREAS, St. Croix County has a zoning ordinance; and
33
34 WHEREAS, the Community Development Committee has reviewed the proposed
35 amendment and recommends approval.

37 THEREFORE, be it resolved by the St. Croix County Board of Supervisors that the
38 amendment to the Town of Forest Zoning Ordinance described above is hereby approved.
