INSPECTOR DATED - PLUMBER ON JOB LICENSE NUMBER ' uj 7 l1~ February 25, 2005 File Ref: 48-04 John and Judith Reiling 2245 Stanford Ct. St. Paul, MN 55105 Re: Board of Adjustment Decision, Parcel 23.30.19.203B, Town of St. Joseph Dear Mr. and Mrs. Reiling: The St. Croix County Board of Adjustment (Board) has reviewed your variance request to construct an attached garage that encroaches within the Ordinary High Water Mark (OHWM) setback of a pond adjacent to Bass Lake. As part of your proposed project, the Board also reviewed your plans to construct a second story addition within the footprint of your existing home. At the hearing on February 24, 2005 the Board approved your request with conditions. The enclosed document is the formal decision regarding your application. You must obtain a building permit from the Town of St. Joseph prior to beginning construction. Should you have any questions or concerns, please contact Jenny Shillcox at 715-386-4682. Sincerely, David Fodroczi Planning and Zoning Director js Enclosure cc: Marie Schmit, Clerk, Town of St. Joseph, w/ enclosure Pete Kling, Land and Water Conservation Department w/ enclosure John Coughlin, Bass Lake Rehabilitation District w/ enclosure Eunice Post, Department of Natural Resources w/ enclosure I FINDINGS, CONCLUSIONS, AND DECISION OF THE ZONING BOARD OF ADJUSTMENT ST. CROIX COUNTY, WISCONSIN Case: 48-04 Applicant: John and Judith Reiling, owners Complete Application Received: November 29, 2004 Hearing Notice Publication: Weeks of February 7 and 14, 2005 Hearing Date: February 24, 2005 FINDINGS OF FACT AND CONCLUSIONS OF LAW Having heard all the testimony, considered the entire record herein, and reviewed the site the Board finds the following facts: 1. The applicants are John and Judith Reiling, 2245 Stanford Ct., St. Paul, MN 55105. 2. The site is located at Lot 6, Section 23, T30N, R19W, Town of St. Joseph, St. Croix County, Wisconsin. 3. The applicants filed an application with the Planning and Zoning Department for a variance to construct an attached garage within the OHWM setback of a pond adjacent to Bass Lake. As part of the application, the applicants also proposed constructing a second-story addition within the footprint of their existing home. 4. The Board of Adjustment finds that the requirements have been met to grant a variance for the garage pursuant to Section 17.70(5)(c)3 of the St. Croix County Zoning Ordinance. 5. The Board finds that the strict application of the Ordinance would create an unnecessary hardship due to the fact that the property is surrounded by water on three sides, which severely limits the net buildable area on the site. The hardship is not self-created. The only other alternative building site would require the removal of mature trees and an existing POWTS. 6. The Town of St. Joseph Planning Commission has recommended approval of this request. 7. The Bass Lake Rehabilitation District has recommended approval of this request. 8. The Wisconsin Department of Natural Resources has recommended approval of this request. 9. The applicants are working with the Land and Water Conservation Department and Planning and Zoning Department to address concerns with stormwater management and erosion control. 10. There was no public opposition to the request. 11. The Board finds that the request is not contrary to the public interest. 12. The Board finds that the spirit and intent of the ordinance would be met by granting the request for the variances, and substantial justice would be done. 2 DECISION On the basis of the above Findings of Fact, Conclusions of Law, and the record herein, the Board approved the applicant's variance request to construct a second-story addition to their home and attached garage within the OHWM setback of a pond adjacent to Bass Lake, with the following conditions: 1. This variance allows John and Judith Reiling to construct an attached garage that encroaches up to 35 feet within the OHWM setback of the pond on their property, and construct a second-story addition within the footprint of their existing home as shown in the plans submitted to the Planning and Zoning Department on November 29, 2004. This variance does not include additional decks, patios, porches, walkways, or any other accessory structures or impervious coverage not shown on the plans. 2. No native trees or shrubs shall be removed as part of the construction. The applicants shall be responsible for protecting all existing native trees and shrubs on the site from damage during construction with snow fencing or some other type of temporary fencing installed around the drip lines of the trees. The garage shall either be reduced in size or moved to the north as necessary to save two red oak trees located at the southwest corner of the garage. 3. Approval of this variance is contingent upon no objection from the Town of St. Joseph Town Board. 4. The applicants must secure a building permit from the Town of St. Joseph before commencing construction. 5. Prior to beginning construction, the applicants shall be responsible for submitting and implementing erosion control, grading, and permanent stormwater management plans as recommended and approved by the Land and Water Conservation Department. 6. The home and garage must be earth-tone in color to blend in with the natural surroundings on the site. 7. Within 60 days of completing construction, the applicants shall record the stormwater management plan against the deed for the property. The applicants shall provide an as-built drawing showing the final location of the garage and all permanent structures and drainage ways on the site, along with a maintenance schedule and a recorded copy of the deed to the Planning and Zoning Department. The intent is to make the current and future owners aware of the responsibilities associated with the plan as well as the limitations incurred as a result of the plan. 8. Within 60 days of completing construction, the applicants shall submit to the Planning and Zoning Department photographs of the home and landscaping as viewed from -200 feet offshore of Bass Lake within 60 days upon completion of the construction. 9. The applicants shall plant additional trees and shrubs as necessary to screen the second-story addition as viewed from the lake during summer, leaf-on conditions. 10. These conditions may be amended or additional conditions may be added if unanticipated issues arise that would affect the health and/or safety of citizens or degrade the natural resources of St. 3 Croix County. Conditions will not be amended or added without notice to the applicant and an opportunity for a hearing. 11. Any change or addition in use or the expansion of the business - including building, signage, or landscaping - shall require review and approval by the Planning and Zoning Department. Significant changes to any approved use will require Board of Adjustment review. 12. The applicant shall have one (1) year from the issuance of the variance to commence construction. Failure to do so shall result in the variance being null and void, unless the applicant requests and receives a time extension from the Planning and Zoning Department. 13. Accepting this decision means that the applicant has read, understands, and agrees to all conditions of this decision. The following vote was taken to approve: Nelson, yes; Jensen, yes; Luckey, yes; Chairperson Speer, yes. Motion carried unanimously. APPEAL RIGHTS Any person aggrieved by this decision may file an appeal in St. Croix County circuit court within 30 days after the filing date shown below, pursuant to sec. 59.694(10), Wisconsin Statutes.
