This letter confirms zoning approval to install rock riprap along the shoreline of the Lower St. Croix
LandlnFormarion & River on property owned by Anthony and Cynthia Fiorillo in the Town of Troy. Staff finds that the

Croix Riverway District, with the following findings:
1. The applicants' property is located within the Lower St. Croix Riverway District. Section
ReaiProperty 1736 F.2.a.5) of the Ordinance allows rock riprap with a land use permit provided it ineets

the standards in Section 17.36 H.6.a.1) - 6).

ongoing erosion on the property and protect the shoreline.
• The Wisconsin Department of Natural Resources issued a Chapter 30 permit for this
project on September 8. 2006.
• The proposed rock riprap has been designed in accordance with W1 FOTG standards and
has been reviewed and approved by the Land and Water Conservation Department.
• The applicants have submitted a re-vegetation plan to plant deep-rooted native grasses
and shrubs among the riprap and to maintain existing vegetation on the shoreline and in

result. significant erosion and slumping is occurring that could create problems with the
proposed riprap. The applicants have submitted a tree-replacement plan to stabilize the
slopes and maintain the integrity of the riprap, and to bring the property into compliance
with the St. Croix COMM Zoning Ordinance.
4. The Land and Water Conservation Department has reviewed the plans and recommends that
the applicants plant native seed and mulch the disturbed area immediately upslope of the
proposed riprap, replace the mature pine trees to be removed in accordance with the Tree
Replacement Schedule, Ie, and reestablish native vegetation that has been removed within the

slope preservation zone in accordance with the vegetation manabement standards in the
Lower St. Croix Riverway District.
5. The Wisconsin Department of Natural Resources has reviewed the plans and does not object
to the issuance of this permit provided all conditions of the Chapter 30 permit are met.

Approval of the land use permit is subject to the following conditions:
1. This approval if for the applicants to install rock riprap on their property in accordance with the
plans received on July 26, 2006, and as provided in the conditions below.
2. Prior to commencing construction, the applicant shall submit a Compliance Deposit in the amount
of $300 to be held by the Zoning Administrator until all conditions have been completed and
approved, at which time it will be refunded in full pursuant to Section 17.36 J.8 of the Ordinance.
3. Prior to commencing installation of the riprap, the applicants shall install a double-row of silt
fence around the project site in accordance with the plans received on July 26, 2006.
4. Immediately upon completing installation of the riprap, the applicants shall seed and mulch the
disturbed area immediately upslope of the proposed riprap consistent with Section 17.36 H.6.(4)
of the Lower St. Croix Riverway District.
5. Immediately upon completing installation of the riprap, the applicants shall implement the re-
vegetation plan for the riprap in accordance with the plans received on September 13, 2006, with
the additional stipulation that native seed be included with the proposed cool season grasses to
provide adequate cover when the cool season grasses die off, and that within one growing season
the applicant plant deep-rooted native shrub species among the riprap at a density not to exceed
10 plants per 1000 square feet.
6. Immediately upon completing installation of the riprap, the applicants shall plant trees to replace
the three mature evergreen trees that will be removed in accordance with the Tree Replacement
Schedule in Section 17.36 H.8. of the Lower St. Croix Riverway District. Several young pine and
oak samplings that currently exist along the shoreline shall also be transplanted if possible.
7. The applicants shall implement the re-vegetation plan for the area that was cut within the slope
preservation zone, with the additional stipulation that fast-growing hybrid poplars be planted
along the bluffline to provide immediate site stabilization and screening of all structures from the
river; buckthorn be removed and treated with guidance from the Land and Water Conservation
Department; native shrub plugs be planted after the replacement trees have established; and any
remaining open areas be planted with a native seed mix approved by the Land and Water
Conservation Department. This work must be completed within one year of this approval.
8. Within 30 days of substantially completing the riprap project, the applicant shall submit to the
Zoning Administrator certification from the project engineer that the riprap has been installed as
approved, as well as photos of the completed construction and required plantings.
This approval does not allow for any construction beyond the limits of this request. Please be
advised that this approval does not extend to any modifications to the existing stairway on the property.
Reconstruction of the stairway will require a separate special exception permit pursuant to Section 17.36
.17.3.a.3) and subject to the standards in Section 17.36 H.12 of the Ordinance. Your information will
remain on file in the St. Croix County Planning and Zoning Department. Please contact the Town of
Troy to obtain the necessary permits and approvals under its Lower St. Croix Riverway Ordinance. It is
your responsibility to ensure compliance with any other local, state, or federal rules or regulations. Feel
