Dear Mr. Fraser: This letter confirms zoning approval according to plans submitted on June 27, 2014 to replace a flat roof with a pitched roof. Staff finds that the proposed activities meet the applicable St. Croix County Zoning Ordinances and the Lower St. Croix Riverway District based on the following fmdings: 1. The property consists of a 0.35-acre lot, which is located in the Rural Residential Management Zone of the Lower St. Croix Riverway District. 2. Reconstruction of non-conforming principal structures is allowed with a Land Use Permit is allowed if all the requirements of 17.36 1.2.d. 1) a) through j) are met. 3. The proposed roof replacement is compliant with the requirements in 17.36 1.2.d. 1) a) b) c) d) and e). 4. No mitigation is needed under 0. The new roof will be screened with trees so there are no impacts to scenic resources. There is no filling and grading so there won't be erosion or impacts to water quality and the Shoreland will be protected. 5. The sanitary system was replaced in 2015 and is in compliance with g) 6. The proposed roof replacement is in compliance with h) and i) since the foundation is not being replaced and there will be no filling and grading. 7. In order to be compliant with j) there will be a condition to install gutters with rain gardens or infiltration trenches. 8. The proposed roof replacement will be approximately 100 feet from the ordinary high water mark and will result in approximately 10% impervious surface. Therefore, this proposal is in compliance with the non- conforming structure section of the Shoreland Ordinance. 9. The structure is located in Zone X of the floodplain map and is outside the 100 year floodplain. This land use permit approval is to replace a flat roof with a pitched roof and as indicated in the plans submitted, and as provided in the conditions below: 1. Contact the Town of Troy to see if they have any building permit requirements. 2. Install gutters and a rain garden or infiltrative trenches. 3. All activities approved as part of this land use permit shall commence within one year from the date of approval and be substantially completed within two years, after which time the permit expires pursuant to Section 17.36 J.7 of the Ordinance. Prior to expiration, the applicant may request extensions of up to six months from the Zoning Administrator. The total time granted for extensions shall not exceed one year. This approval does not allow for any additional construction, grading, filling, or clearing of vegetation beyond the limits of this request. REVIEW: The Zoning Administrator will review the application for completeness and assign a file number to the application. The Zoning Administrator may require additional information and will notify the applicant of this within 10 days. Upon receiving a complete application and supporting documents, the Zoning Administrator will: • send copies of the applications to the appropriate reviewing agencies for comment. Applicants are encouraged to contact their town to discuss their application and inquire about necessary building permits and approvals at the town level; • schedule a site visit to the applicant's property, at which time the applicant shall flag all applicable property/project corners and label the flags accordingly; and • review the file and prepare findings for approval or denial of the permit within 60 days. Upon approval, the permit will be mailed to the applicant or to the applicant's agent. If approved, the land use permit will be valid for one year from the date of the permit issuance. The applicant may also be required to apply through the Town for a local building permit. All site plans, pictures, and other materials submitted with the application become the property of the Community Development Department and will remain in the file. Written statement of request: • This is a request to reroof my house. It currently has a flat roof, and we'd like to replace it with a new pitched roof, as allowed in S17.36. Questions regarding drainage, grading, color, etc are answered in the S17.36 responses below. Home has a flat roof, that is severely understructured, with multiple leaks. Current flat roof consists of 2x12x18' joists, 16" on-center, with a maximum of 3-1/2" slope from center to edge. 2. A statement indicating whether or not a private water or sanitary system is to be installed. We installed a brand new sanitary waste system in 2015. It was installed by Steiner Plumbing and was inspected and is on file with the county. 3. Response to 17.36 I. Requirements: Reconstruction of Nonconforming Principal Structures 1) Nonconforming principal structures located within the OHWM setback area, bluffline setback area or slope preservation zone may be structurally altered or reconstructed and foundations may be replaced, improved or structurally altered if all of the following requirements are met: a) The lot has an area of at least 7,000 square feet. RESPONSE: The lot is 0.353 acres, which equals 15,376 square feet. b) The altered or reconstructed structure will be visually inconspicuous or will be rendered so through mitigation per § 17.36 1.5. RESPONSE: The house is mostly hidden from the river by trees already. No vegetation will be disturbed, we will be reroofing only. c) The structure is altered or reconstructed in the same footprint as the preexisting structure. RESPONSE: Repairing roof only, not changing footprint. ORIGIN,^ d) The reconstructed structure may not be any taller than the pre-existing nonconforming structure, except that a flat roof may be replaced with a pitched roof, and may not be taller than allowed per § 17.36 G.4. RESPONSE: Replacing flat roof with simple peaked roof, and will be approximately 30' above average grade, which complies with the 35 foot limit. e) The color of the structure complies with § 17.36 H.1. RESPONSE: We will choose earth-tone colors to comply. f) The property owner submits a mitigation plan per § 17.36 1.5. i. If a permit is issued for the reconstruction, the mitigation plan shall be approved, or modified and approved, by the Zoning Administrator. ii. The mitigation plan shall be incorporated into the permit and the property owner shall be required to implement the mitigation plan as a permit condition. RESPONSE: We will be reroofing only. g) Private on-site wastewater treatment systems are brought into compliance with the requirements of the St. Croix County Sanitary Ordinance. RESPONSE: A brand-new system was installed, summer 2015 and is on file with the county. h) The foundation of the structure may not be replaced, improved or structurally altered, unless all of the following standards are met: i. It is being done in conjunction with the reconstruction of the structure, ii. It is entirely located more than 50 feet from the OHWM, and iii. It is not located in a slope preservation zone. RESPONSE: We will be reroofing only. i) No filling and grading activities are allowed during the alteration or reconstruction, except for the minimum necessary to accomplish the alteration or reconstruction in compliance with other provisions of this subchapter, and as needed to upgrade a private on-site wastewater treatment system, to replace sewer or water laterals, or to install storm water or erosion control measures. RESPONSE: We will be reroofing only. The new roof will shed water front and back, as the current roof does now. j) If the structure is located in a slope preservation zone, it may be reconstructed on the existing foundation only if WDNR storm water technical standards applicable to steeper sloped areas are implemented to control erosion.
