HI Mike and Laura,
I wanted you to know the trail maintenance work done thus far at 1502 Twin Springs Rd. has been inspected by county
staff. I was very pleased to find it functional both as a safe way negotiate the steep slopes and as erosion control
BMPs. The terracing effectively breaks up the flow of runoff and should really be helpful in stabilizing erodeable slopes
with native vegetation. Thanks, David, for doing such a good job of implementing the recommended techniques for this
type of trail improvement.

RE: Trail maintenance in the Lower St. Croix Riverway District
Parcel #14.30.20.822 in the Town of Somerset
Dear David and Spike:
After meeting David at the site and walking the foot trail used for access to the St. Croix River, we
discussed options for managing surface water erosion problems and long term trail maintenance. The
proposal is to use a combination of rock and/or wood materials (fallen logs are okay, but don't cut
timber in the slope preservation zone) to create water bars at intervals along the trail that will
disperse and dissipate energy of stormwater runoff. In between the water bars, exposed soil on the
trail may be stabilized with woodchips (where the slope angle allows), intermittent flat rocks, or
erosion control matting. The trail will not be expanded as part of the project and no stairway or
structural erosion control measures will be installed. The WI DNR website has a description of types
and specifications of erosion matting that may be helpful:

This project as proposed will be considered landscaping and will not require a zoning permit at this
time. Laura Hojem of the NPS visited your site and Christopher Stein's letter of July 2, 2014 notified
our office that they approve of the proposed plan with regard to the NPS scenic easement conditions
and restrictions on your property.
Thanks for submitting your project for CDD review and let me know if you use techniques shown in
the Minnesota trail manual.

It was a real pleasure to meet you this morning, to walk the trail, and to discuss our options. I'm really glad that our plan
resonates with the trail stabilization method. This is exactly what we're trying to achieve. I'm really grateful to you for

I am not going to do a thing on the trail itself until I get the determination letter so that we stay absolutely in line with

manual for non-commercial and educational purposes. So you can copy/paste applicable sections into
something to share with the folks you're working with in the riverway. The copyright language inside
the front cover should be included. The whole manual can be purchased from Minnesota's Bookstore
(ordering info in letter). I have an extra hard copy that is available to other agencies at no cost so I'll
bring it home for your office.
I checked the other reference I mentioned to you from IMBA. It has some design stuff but nothing that
isn't covered in the trail manual.

Dear Mr. Squire and Mr. Valentine:
We have received your email and project area drawings dated June 26, 2014 requesting
permission to recondition and landscape an existing foot path to the river. This project
holistically is in-keeping with the spirit and intent of the National Park Service scenic easement
in place on your property. Your property has been determined to be within line of sight of the St.
Croix River which means new structures are not permitted to be built. What you are proposing is
not considered to be a structure. You have a three-part goal for this project of stabilizing the
current path through landscaping including steps and erosion barriers, improving safety for
visitors, and keeping the visual impact to a minimum. The last goal is very important and care
must be taken, to prevent a negative impact on the view as seen from the water. The protection of
the scenery is the focal point of the NPS scenic easement program.
Lands Specialist Laura Hojem visited with you on the property and reviewed this project on May
8, 2014. Based upon this inspection of your property by Laura and her recommendations, we
believe the proposed landscaping of the current footpath to the river is permissible under the
terms of the easement presently in effect on your property. However, this approval does not
extend to future improvements or the "morphing" of this landscaped footpath into a defined
structure such as a staircase, stairway, or tram to the river.
You should note that our approval of this project is contingent upon your compliance with other
applicable land use controls as required by the easement. It in no way evaluates the merits of the
project in relation to local, county, or state zoning, and thus does not preclude or supersede any
actions by those units of government. Therefore, you need to comply with any land use controls
or requirements of Somerset Township, St. Croix County, and the Wisconsin Department of
Natural Resources, to whom a copy of this letter is being sent.

Concept and Proposal
River access at 1502 Twin Springs Road is currently via a
narrow footpath running along the edge of the bluff
and down the ravine at the western edge of the lot
Due to steepness, the path is hard to use; we plan to
develop low visual impact landscaping to make it safer
to use and at the same time ensure that use of the path
doesn't erode the bluff edge.
Our three-part goal is thus to:
stabilize the path through landscaping treatment including
steps and erosion barriers along the path;
Reduce risk and improve safety for users; and
keep visual impact to a minimum.
Our plan is inspired, in part, by the landscaped steps
from our drive to the ravine, pictured below (see next
slide)

To meet our three goals of stability, safety,

Maximize the use of existing natural

Dear Mr. Squire and Mr. Valentine:
We have received your email and project area drawings dated May 12, 2014 requesting
permission to cut and clear some understory vegetation mainly on the south side of the house.
Some future projects were also discussed in the email regarding the re-routing of the drive way
and the potential for an addition on the back side of the existing house. Thank you for meeting
with Lands Specialist Laura Hojem on May 8 and reviewing the plans with her during the on-site
visit.
Based upon an inspection of your property by Laura and her recommendations, we believe the
proposed vegetation cutting and replanting project is permissible under the terms of the easement
presently in effect on your property. The future plans of the driveway restructure and addition to
the house should be resubmitted with detailed drawings at the time you are ready to proceed with
them.
Only trees and vegetation that are less than 4.5 inches in diameter and described on the project
request will be allowed to be cut. No cutting of vegetation between the house and the river will
be allowed. The current vegetation here must be maintained so that it continues to screen the
house and all structures and human activity on the property from view of the river. The cutting
area is adjacent to the house, mainly on the south side or at the back half of the lot as it fronts
Twins Springs Road. The cutting is intended to create some open space and allow light to enter
for the planting of native white pines, birch and cedar to create a more solid vegetative screen
between the house and Twin Springs Road.
The cutting of specific identified branches on trees near the house as a safety and maintenance
measure is approved as a part of this project request. Please continue to work with an arborist or
tree service to be careful that the over-story canopy and the vegetative screen are allowed to
remain intact.

The St. Croix County Board of Adjustment conducted a public hearing
on April 27, 1982 to consider the request of William Nettekoven for
a variance to Article 3.12, Setback from Bluffline, ST. CROIX COUNTY
ZONING ORDINANCE.
The St. Croix County Board of Adjustment conducted an on-site
inspection of the site in question.
After inspection, the St. Croix County Board of Adjustment entered
an Executive Session to discuss the request.
After returning to open session the following decision was rendered:
Motion by Supervisor Stephens to deny the request of Mr. Nettekoven.
The reasons are that the structure would be within the 40 foot setback
from the bluffline and cannot meet the minimum setbacks from 3.12 of the
St. Croix Riverway District and N.R. 118, which Al Santala of the Depart-
ment of Natural Resources objected. Seconded by Supervisor George.
Motion carried. Vote to deny:

in regard to your complaint about beer parties and camping
at the end of Twin Springs Road and the islands in the St.
Croix River, I contacted the game warden Stanley Schneider,
about this problem. He informed me that the islands are
owned by the National Park Service and they are supposed to
do the policing.
As far as the boat launch area at the end of Twin Springs
Road, this is a portion of the subdivision where there is
some confusion as to ownership. As near as I can figure
out the plat, it is dedicated to the public for access to
the river. I discussed this problem with Sheriff Burka.

Sheriff Burke recommended that this matter be brought be-
fore the Somerset Town Board to get the area properly sign-
ed. After this has been completed the area can be properly
policed.

The $100 Board of Adjustment fee is to cover meeting and pub-
lication cost of your request to "construct an accessory use
to single family residential structure, provided that all
such structures shall be in compliance with a bluf.fline
setback line located 100 feet from the bluffline".
Your particular property lies under the jurisdiction of St. Jo-
seph Township, MN-WI Boundary Area Commission, Department of
Natural Resources, St. Croix County and State of Wisconsin.

easement Tract 12-167 within the Lower St. Croix National Scenic Riverway.

Based on the information provided and our determination that the proposed
addition would not be visible from the river during summer vegetation,
your request is granted.
You are no doubt aware of the need to comply with the regulations and
ordinances of Somerset Township, St. Croix County and the Wisconsin Depart-
ment of Natural Resources concerning sanitation and other land use controls.
Our approval means only that we have determined that the Riverway scenic
easement conditions are fulfilled; it is NOT a statement of intent or impli-
cation to influence or guide decisions of local units of government which
are completely free to deny granting permits or variances for which appli-
cations are made. Our approval in no way evaluates the merits of the proposal
in relation to local or Wisconsin requirements and thus does not preclude
