ST001 `' TRESOLUTION IN OPPOSITION TO SB506 & AB599
1 WHEREAS, the Department of Natural Resources has the obligation to determine
2 whether a stream is navigable under Wisconsin law; and
3
4 WHEREAS, SB 506 and AB 599 establishes conditions under which, if the DNR has
5 determined that a stream is not navigable, restrict the DNR's ability to change that determination
6 when water resources are changed by human alterations; and
7
8 WHEREAS, construction of dams on non-navigable streams change the hydrology of a
9 stream and in some cases cause a non-navigable stream to become navigable under the Supreme
10 Court's definition of a navigable stream; and
11
12 WHEREAS, if the DNR no longer has the authority to change the determination, it
13 would leave some navigable streams or water bodies without the required protections under the
14 Public Trust Doctrine; and
15
16 WHEREAS, Wisconsin has a long tradition of insuring our public resources are not
17 degraded and remain available for everyone to enjoy; and
18
19 WHEREAS, this legislative overreach is an attempt to address a specific and relatively
20 unique situation.

22 NOW THEREFORE, BE IT RESOLVED that the St. Croix County Board of
23 Supervisors is strongly opposed to 2017 SB 506 and 2017 AB 599; and
24
25 BE IT FURTHER RESOLVED the St. Croix County Board of Supervisors directs the
26 County Clerk to send a copy of this resolution to the Wisconsin Counties Association, State
27 Legislators, State of Wisconsin U.S. Legislators, and Governor Scott Walker.
