RE: A Conditional Use Permit amendment to change the hours of operation for a nonmetallic mining
operation. Property located in Section 2L T30N, R181K, Town of Richmond.
Dear Mr. Olin,
The St. Croix County Board of Adjustment (Board) has reviewed your request for the following
items:
1. Changing the hours of operation for your non-metallic mining operation pursuant to Section
17.15 (6) (g) of the St. Croix County Zoning Ordinance and the requirements of the St. Croix
County Nonmetallic Mining Ordinance.
After the hearing on March 22, 2018. the Board approved the Conditional Use request '"'Ith
conditions. The enclosed document is the formal decision regarding the application.
You must obtain any other required local, state, and federal permits and approvals. Feel free to

makes the following Findings of Fact and Conclusions of Law pertinent to the applicant's Conditional Use
requests:
1. The applicant is Roberts Concrete. The agent is Steve Becken.
2. The site is located at 1185 County Road G.
3. This site has been in operation for decades and was previously operated by Russell and Jeannette
Utecht.
4. The applicants filed with the Board of Adjustment a Conditional Use Application amendment to
change the hours of operation to;
Current hours
The current hours of operation are 7 a.m. to 7 p.m. Monday through Saturday for mining and
hauling.
The current hours of operation are 6 a.m. to 10 p.m. Monday through Saturday for crushing. and
screening for 6 weeks per year.
Requested chanties to hours
The requested changes are from 7a.m. to 7 p.m. to 6 a.m. to 6 p.m. Monday through Saturday for
mining and hauling.
The requested changes are from 6 a.m. to 10 p.m. Monday through Saturday for six weeks a year
to 6 a.m. to 6 p.m. Monday through Saturday, for March 1" to December 1" for crushing and
screening.
5. Staff from the Resource Management Division stated that this site is internally drained and there
are no concerns. Review is complete, no further comments.
6. Staff from the Land Use Division reviewed the permit Conditions from 2015 and this operation is
in compliance with those conditions.
7. There have been no complaints about this operation.
8. The Town of Richmond recommends approval of this request.
DECISION
On the basis of the above Findings of Fact, Conclusions of Law, and the record herein.. the Board approved
the applicant's Conditional Use request, with the following conditions:
1. All previous conditions of the existing Conditional Use Permit shall remain in effect.
2. Crushing shall be limited to materials currently on the site or naturally occurring within the site.
The following vote was taken to approve the request: Chairman Malick, yes; Peterson, Yes; Nelson. Yes;
Niccum, Yes- Sontag, Yes: All in favor, motion carries.
APPEAL RIGHTS
Any person aggrieved by this decision may file an appeal in St. Croix County circuit court within 30 days
after the filing date shown below, pursuant to Sec. 59.694(10), 'W-isconsin Statutes. St. Croix County
assumes no resporsibility fer action taken in reliance on this decision prior to the expiration of the appeal
period. St. Croix County does not certify that the identity of all persons legally entitled to notice of the
Board of Adjustment proceedings, which resulted in this decision, was provided to the County.
If an appeal is taken of this decision, it is the responsibility of the appellant to submit at his/her expense a
transcript of the Board of Adjustment proceedings to the circuit court. The Community Development
Department can be contacted for information on bow to obtain a transcript. It is the responsibility of the
Board of Adjustment to submit its record (file) of this matter to the circuit court.
