Re: Land Use Permit for a dog kennel fence pursuant to section 17.36 F.2.a.1) Property
located at 1502 Twin Springs Road in the Town of Somerset. Parcel number 032-2082-80-000.
Dear Mr. Squire:
This letter confirms zoning approval according to plans submitted on July 6, 2017 to install a dog
kennel fence with a crushed gravel base.
Staff finds that the proposed installation meets the applicable St. Croix County Zoning
Ordinances and the Lower St. Croix Riverway District based on the following findings:
1. The property consists of a 1.2 acre lot, which is located in the Rural Residential
Management Zone of the Lower St. Croix Riverway District.
2. Construction of a fence and crushed gravel base is allowed with a Land Use Permit if all
the requirements of 17.36 H. are met.
3. 17.36 H. 1. is met since the fence, posts and gravel will be earth tone in color.
4. The fence will not be in the slope preservation zone so it meets the requirements in 17.36
H.3. The gravel base is exempt from the structure definition because it is considered a
filled area. The disturbance of the sparse amount of vegetation is part of the landscaping
plan.
5. The disturbed area for installing the posts will be less than 100 square feet of disturbance
and so stormwater and erosion control plans will not be required.
6. The fence meets the required 50 foot road setback, 25 foot side yard setback. The fence
is approximately 80 feet to the slope preservation zone but is not visible so it meets the
criteria to be placed 40 feet from the bluffline.
7. The existing structures and proposed kennel gravel base will result in 6.8% of impervious
surface area. The vegetation disturbance is beyond the 75 foot vegetative buffer
boundary. Therefore, this proposal is in compliance with the Shoreland Ordinance

8. The structure is located in Zone X of the floodplain map and is outside the 100 year
floodplain.
This land use permit approval to construct a dog kennel fence with a gravel base is approved as
indicated in the plans submitted, and as provided in the conditions below:
1. Contact the Town of Somerset to see if they have any building permit requirements.

2. All activities approved as part of this land use permit shall commence within one year
from the date of approval and be substantially completed within two years, after
which time the permit expires pursuant to Section 17.36 J.7 of the Ordinance. Prior to
expiration, the applicant may request extensions of up to six months from the Zoning
Administrator. The total time granted for extensions shall not exceed one year.
This approval does not allow for any additional construction, grading, filling, or clearing of
vegetation beyond the limits of this request.
Your information will remain on file in the St. Croix County Planning and Zoning Department. It
is your responsibility to ensure compliance with any other local, state, or federal rules or
regulations.

Dear Mr. Squire and Mr. Valentine:
Thank you for submitting the updated plans for a dog run on your property located at 1502 Twin
Springs Road, Somerset, WI. We have also received your emails and site plan drawings dated
June 26, 2017 requesting permission to construct a dog run on the southeast side of the house off
of the garage. The proposed dog run will be approximately 17' x 50' x 5' with the side closest to
the road being slightly convex. The dog run will extend a maximum of 10' beyond the northern
side of the existing garage. The fencing materials will be a combination of wood which will be
stained or painted to match the color of the existing house at 6 ft high and black. non-climb horse
fence on the sides facing the river at 4 ft in height. Within the dog run you propose to place
crushed limestone. You also propose to plant shrubs on the river side of the 10" extension to
make the fencing even less visible. The current vegetation here must be maintained so that it
continues to screen the house and all structures and human activity on the property from view of
the river. The planting of shrubs will ensure that this dog run will not have a visual impact on
the St. Croix River, now or in the future.
Based upon an inspection of your property by Jody on April 21, 2017 and review of the updated
plans we believe the new location for the dog run and the fencing materials to be permissible
under the terms of the easement presently in effect on your property. The future plans of the
exercise area should be resubmitted with detailed drawings and construction materials at the time
you are ready to proceed with them.
You should note that our approval of this project is contingent upon your compliance with other
applicable land use controls as required by the easement. It in no way evaluates the merits of the
project in relation to local, county, or state zoning, and thus does not preclude or supersede any
actions by those units of government. Therefore, you need to comply with any land use controls
or requirements of Somerset Township, St. Croix County, and the Wisconsin Department of
Natural Resources, to whom a copy of this letter is being sent.
