Hudson, WI 54016 RE: Land Use Permit Conditional Approval: File# LUP-2018-013 Project Location: 260 Cove Rd; S24.T28N.R20W; Town of Troy Daniel Hartung, Community Development staff have reviewed the Land Use Permit application for Reconstruction of an existing nonconforming principal structure, replacement of the existing Private Onsite Wastewater Treatment System (POWTS), and construction of a new detached accessory structure, with minimal filling and grading outside of the 40-foot bluffline setback. The request has been conditionally approved based on the application submission and the following findings. • The property is Lot 24 of the St. Croix Cove Subdivision. • The reconstruction of existing principal structure will be within the existing footprint. The foundation will not be replaced, main supporting walls and the roof will be replaced. • Setbacks for the principal structure will remain unchanged; the new accessory structure meets all applicable setbacks. • The height of the reconstructed principal structure does not exceed the existing structure height of 817.3 feet. • No retaining walls or patios within the 40-foot bluffline setback are proposed to be replaced. • No land disturbance such as filling/grading to occur within the 40-foot bluffline setback. • Storm water management and erosion and sediment control plans are submitted per § 17.36 H.7. • All structures will remain screened and visually inconspicuous from the Riverway. No vegetation is being removed between the principal structure and Riverway. • The replacement of the existing stairway, deck and spiral stairway is to occur provided a Variance being granted to replace an attached accessory structure within the 40-foot bluffline setback of the Riverway Overlay District is approved. • The existing POWTS is to be replaced to meet current standards in CH. 12 of the St. Croix County Code of Ordinances. V Resource Management Community Development Department Based on these findings, approval of the Land Use Permit is subject to the following conditions: 1.A pre-construction inspection is required to verify the Erosion and Sediment control, best management practices have been installed as per site plan, sensitive areas flagged which are not to be disturbed. Areas to be flagged include: a. The bluffline and 40-foot bluffline setback. b. Private Onsite Wastewater Treatment System drainfield location. 2.A tracking pad shall be installed prior to any land disturbance or construction activities. 3.St. Croix County reserves the right to require additional sediment and erosion control measures to be installed if found necessary due to site-specific concerns and will be documented in an as-built site plan. 4.A post-construction inspection is required prior to removing the temporary sediment and erosion control measures and to verify vegetative cover. This inspection will also include inspection of the proposed rain garden and ensuring construction has met the application/site plan. Please call the inspector to schedule an inspection. 5. It is the applicant's responsibility to secure any other required local, state or federal permit(s) and approval(s) prior to land disturbance activity. 6. Failure to comply with the terms or conditions above may result in the revocation of this permit by the Zoning Administrator pursuant to Chapter 17.71. 7.The property owner shall execute and record an affidavit describing the approved storm water management plan and maintenance requirements with the County Register of Deeds within 30 days after construction is completed. This approval is subject to the conditions listed above; it does not allow for any additional construction, structures, or buildings beyond the limits of this request. Your information will remain on file at the St. Croix County Community Development Department suite. It is your responsibility to ensure compliance with any other local, state, or federal permitting and regulations, including contacting the Town of Troy and the Department of Natural Resources to inquire if additional permissions are required. This permit is valid for one year, with the possibility of up to two (2) six-month extensions if the applicant submits the appropriate permit extension fee and documentation to the Zoning Administrator. A copy of the Land Use Permit placard should be submitted to the local Building Inspector for the town upon application for the building permit. The placard must be posted on the job-site and visible from public view.
