In accord with Section H 62.24, Wisconsin Administrative Code, a variance
is hereby granted to install a septic system on a lot being initially
developed without a replacement system area. This approval 1s based on
an affidavit, signed, notarized and recorded, stating the noncompliance
to H 62.20 (2) (c) of the Wisconsin Administrative Code.
This approval is for the variance requested only and does not Include review
of the design and size of system.
This variance is subject to the following conditions:
1. That any locally concerned authorities having the responsibility of
enforcement of local ordinances permit the installation as proposed.
2. It shall be necessary to fulfill all permit requirements of the city,
village, township or county. Failure to obtain such permits will
automatically void this approval.
3. In the event that this variance creates liquid waste problems at
ground level or any other operational or maintenance problems occur, the
provisions necessary to resolve these problems shall be commenced upon
receipt of approval by this department.

Dear Harold:
I spoke to Mrs. Roland Peterson by phone on Saturday, August 5, 1978, in response
to a request from Mr. Peterson that I contact him. Apparently they did not
realize that I had been there on a previous occasion.
With regard to that earlier site inspection, I did not make a determination, al-
though it did appear that site suitability was questionable in the single bore
hole made. Mr. Hopkins indicated then that he felt the site had been altered
substantially where his testing was done, and Tom considered the soil mottled at
less than five feet. This preliminary information suggested that the site might
not qualify for conventional soil absorption, but did not confirm the situation.
In my conversation Saturday, Mrs. Peterson insisted the site had not been exten-
sively altered, a statement I cannot confirm or deny at this point. She also
indicated that, since my preliminary visit, further borings have revealed in-
sufficient suitable area exists for a conventional system.
My primary reason for writing you is so that you will know first hand what I said
regarding alternate system options. (1)In response to a question about the mound,
I said she could not get approval since the home is newly constructed, but in the
future may be able to, (2)if site is definitely unsuitable will need holding tank
and (3)may place fill to attempt over-coming site limitation, but gets no guarantee
that conventional system in fill will be approved by the state until it is demon-
strated that the limitation has been overcome. The holding tank could then be
converted to an approved septic tank if the fill system did get state approval.

Schmidt will be contacting you concerning this system and how you
would like it installed. If you have any questions concerning this

Dear Mr. Dunlap: re: Alternative to conventional sewage
disposal system; Roland Peterson site.
Your letter arrived while I was on vacation, hence the delayed reply.
I sympathize with your problem of finding a local plumber familiar with planning
and installation of the mound type disposal system. Unfortunately perhaps,
I also know of no plumbers in your immediate vicinity who have installed
this system.
I would suggest you contact the zoning administrators of nearby counties to
see if any of their plumbing contractors have had such experience. They may
be willing to help you make contact. I do know that Eau Claire, Dunn, Jackson,
Monroe and La Crosse counties have plumbers familiar with the mound.
I am enclosing some of the information which can be useful to your plumber
in designing a mound, should a plumber unfamiliar with the mound construction
be willing to install one. The full explanation of design criteria and
construction technique is too length for an enclosure with this letter, but
is available from: Division of Health, Section of Plumbing and Fire Protection
Systems, P. 0. Box 309, Madison 53701. Ask for Alternate Sewage Manual.

Administrator's office. These inspections were conducted on
Monday, May 22, 1978 after the home of Roland Peterson was almost
completed. In a letter to Roland Peterson dated May 25, 1978
it was expressed to Mr. Peterson by Mr. Tom Nelson, the Assistant
oning Administrator, that the sanitary and septic permits were

Roland Peterson appeals from a decision made by Tom Nelson,
Assistant Zoning Administrator, as stated in his letter dated
May 25, 1978 to Mr. Roland Peterson.
At the instructions of Mr. Roland Peterson, Richard W.
Hopkins submitted a report on soil borings and percolation tests
which were taken on March 14th and 15th, 1978. These tests were
made by Mr. Hopkins in the anticipation of Mr. Peterson building
upon the property owned by him in the Northwest Quarter of the
Southwest Quarter (NW-, SW4) of Section Fifteen (15), Township
Thirty-one (31), Range Eighteen (18) in the Township of Star
Prairie.
The permit application for a private domestic sewage system
(PLB 67) was prepared for Roland Peterson by Richard W. Hopkins
and dated March 22, 1978. The permit was issued for the private
domestic sewage system on March 223 1978 by Harold Barber, St.
Croix County Zoning Administrator.
Roland Peterson subsequently relied on the issuance of the
