The property owners are Jim and Linda Walsh; the agent is James (Louie) Filkins. 2. The site is located at 150 Glenmont Road, River Falls, Wl 54022 in part of Section 23, T28N, R20W, Town of Troy. 3. The site is 90 acres and is located in the Lower St. Croix Riverway Overlay District. 4. The Town of Troy has General Zoning jurisdiction. 5. The applicant filed an application with the St. Croix County Board of Adjustment for a Conditional Use Permit to fill and grade within 40 feet of a slope preservation zone. Section 17.36 F.3.a.5) of the St. Croix County Lower St. Croix Riverway Overlay District. 6. The applicant submitted an addendum to the Conditional Use Permit to fill and grade greater than 10,000 square feet outside of the slope preservation zone according to Section 17.36 F.3.a.6) of the St. Croix County Lower St. Croix Riverway Overlay District. A County Reconnection Sanitary Permit will be required to reconnect to the existing Private Onsite Wastewater Treatment System (POWTS). 7. A County Land Use Permit will be required to construct a single-family residence and is subject to the standards in Section 17.36 H. 8. Filling and grading activities have been designed in a manner to minimize erosion and sedimentation. 9. Vegetation removal for the new location of the driveway and single-family residence is required, however will be limited to the area within the approved boundary to fill and grade. 10. A stormwater management and erosion and sediment control plan has been submitted and approved by the Community Development Department Resource Management Division. • DECISION On the basis of the above Findings of Fact, Conclusions of Law, and the record herein, the Board approved the applicant's Conditional Use request, with the following conditions: 1. Conditional Use approval will allow the filling and grading activities within 40 feet of the slope preservation zone and to fill and grade greater than 10,000 square feet outside of the slope preservation zone in order for the applicant to reconstruct the existing home and relocate the driveway. 2. A County Reconnection Sanitary Permit will be required before any land disturbance or construction activities can commence onsite. 3. A County Land Use Permit for construction of the single-family residence will be required prior to any land disturbance or construction activities can commence onsite; compliance with Chapter 17.36 F.2.a.1) is required. 4. Any revision to the stormwater management plan shall be reviewed and approved by St. Croix County Community Development Department staff. 5. There shall be no filling and grading or vegetation removal within the slope preservation zone. 6. Vegetation that will be removed will be replaced with native vegetation. The property owner shall execute and record an affidavit describing the approved stormwater management, erosion and sediment control and vegetative management plans and maintenance requirements for each with the County Register of Deeds within 30 days after construction is completed. 7. The applicants shall have two (2) years from the date of this approval of this conditional use to begin land disturbance/construction activities to reconstruct the existing home. Failure to do so may result in expiration or revocation of the conditional use permit. Prior to expiration or revocation, the applicant may request an extension of up to six months from the Zoning Administrator. 8. These conditions may be amended or additional conditi,m~, rnN he added i? unanticipated circumstances arise that would affect the health and/or safety of citizens or degrade the natural resources of St. Croix County. Conditions will not be amended or added without notice to the applicant and an opportunity for a public hearing. 9. Any new owners of the property must adhere to the standards and conditions of the approved Conditional Use Permit. Any change or addition in use of the property, buildings; or modification of or addition to the property or buildings shall require review by the Zoning Administrator to determine if the use may be allowed. This decision applies to the property rather than to the individual, is valid for only the specified property, and is not transferrable to other properties. 10. Accepting this decision means that the applicant and their agent have read, understand, and agree to all conditions of this decision, and have no objections to County staff conducting unannounced onsite inspections to check for compliance with this permit. The following vote was taken to approve the request: Chairperson Malick, (Yes); Vice Chairman Peterson, (Yes); Nelson, (Yes); Niccum, (Yes); Sontag_ (Yes): Miller, (Yes). All in favor, motion carries. i APPEAL RIGHTS Any person aggrieved by this decision may file an appeal in St. Croix County circuit court within 30 days after the filing date shown below, pursuant to Sec. 59.694(10), Wisconsin Statutes. St. Croix County does not certify that the identity of all persons legally entitled to notice of the Board of Adjustment proceedings, which resulted in this decision, was provided to the County. If an appeal is taken of this decision, it is the responsibility of the appellant to submit at his/her expense a transcript of the Board of Adjustment proceedings to the circuit court. Conditional use for filling and grading 10,000 square feet or more outside of the slope preservation zone. Building a new 3 bedroom home slab on grade, not to exceed 35 feet in height, to replace existing 1800's farmhouse. The farmhouse will be torn down through the Town of Troy approval process. Refer to the Town of Troy Zoning Code Chpt 170 Section U (3 and 4) with respects to nonconforming structures and lots. Our plan includes approximately 15,600 square feet of filling and grading disturbance. 2) Describe the impact of your request on the enjoyment and value of surrounding properties. If there is no impact, explain why. No Impact. This building site is not visible from the St. Croix River. The dense tree and vegetation coverage of the area does not allow for any view of the home. See attached picture from the river. We are replacing an existing 3 bedroom white1800's farmhouse with a new 3 bedroom slab on grade single family home in approved earth tone exterior colors. The home will be occupied by the owners. Today the farmhouse is a rental property. The Walsh's own the surrounding acreage and a cabin. There is only one neighbor across the street on Glenmont Road. 3) Describe the compatibility of your request with the uses and character of the surrounding area. This will be a single family dwelling that the owners will live in for recreational use of the St. Croix river way and surrounding owned woodland areas. The Walsh's own 90 acres and 550 feet of river frontage to enjoy. This land has been in the Carlson (Walsh) family for over 100 years providing an area for hiking, hunting and family enjoyment. Our intent is to preserve what this homestead has represented to this area for many years. 4) Describe how your request is consistent with the spirit and intent of the zoning district in which your property is located. Consistent with the spirit of the purpose statement we are reducing the adverse effects of overcrowding of the bluff area by replacing one home for another and we have a proposed plan to prevent soil erosion and pollution. What measures will you take to minimize any negative impacts? We don't believe this project will have an impact on public health, safety or general welfare. Our intent is to use local contractors and build in accordance with the Lower St. Croix Riverway Overlay Ordinances. The Town of Troy has road improvement upgrades in the 5 year plan on Glenmont. We are working with them on coordination of their efforts to correct watershed issues on the current road in conjunction with our plans to build. This will help property owners that use this section of Glenmont Road and improve the overall safety of local residents. 6) How will you ensure that your request will not constitute a nuisance by reason of dust, smoke, odor, or other similar factor? What measures will you take to prevent a nuisance? This is a basic stick built home which will be a slab on grade construction that should have little impact on these factors. We have discussed our plan to build with closest neighbor, the Keopple's, and will work them. If any such nuisance develops we will work to resolve them. Our plan, once construction begins, is to complete work as quickly and efficiently as possible. 7) Additional comments: 1. Walsh's have yet to pick a contractor for the building of the new home. This project will be bid out by 2 or 3 local contractors. This will include Mark Rudesill, Hokeness Builders and one other possible local contractor yet to be determined. 2. Construction time frame and sequence is yet to be determined. This will be based on the sale of the Walsh primary residence in Stillwater, MN. Home is for sale at this time. 3. The new proposed 3 bedroom home will use the existing well and septic system installed 1998. No improvements or alterations are needed with this request. 4. Four trees will need to be removed in the construction disturbance area, along with invasive species that reside by the road side. These trees will be replaced as part of a landscaping plan yet to be determined. It will include the addition of crab apple, apple, and maple trees being planted to the east of the new home site. GENERAL CONDITIONAL USE APPLICATION PROCEDURE APPLICATION: The deadline for application submittals is the 1st Monday of the month before the regularly scheduled St. Croix County Board of Adjustment meeting. The Board of Adjustment generally meets on the 4th Thursday of the month. Applications will not be accepted until the applicant has: • Met with the Zoning Administrator to review the application; • Oriziual plus 10 copies submitted of the entire packet including all supporting information, maps & diagrams; • Resolved any land use violations and paid any outstanding fees owed to the Community Development Department; • Signed the application form (the signatures of the property owners and agents acting on their behalf are required); and • Submitted the appropriate application fee (nonrefundable) payable to St. Croix County. REVIEW: The Zoning Administrator will review the application for completeness and assign a file number to the application. The Zoning Administrator may require additional information and will notify the applicant of this within 10 days. Upon receiving a complete application and supporting documents, the Zoning Administrator will: • Schedule a public hearing with the St. Croix County Board of Adjustment and notify the applicant by mail of the date and time of the public hearing; • Notify adjoining property owners of the applicant's request; • Publish a public hearing notice in the local paper; • Send copies of the applications to the appropriate town and reviewing agencies for comment. Applicants are encouraged to contact their town and attend their town meeting to discuss their application; • Schedule a site visit to the applicant's property, at which time the applicant shall flag all applicable property/project corners and label the flags accordingly; and • Prepare a staff report on the application. The staff report will he mailed to the applicant and will he available for public review during the week prior to the public hearing. Conditional Uses are subject to conditions, compatibility with surrounding land uses, and compliance with the St. Croix County Zoning Ordinance. At the public hearing, the applicant may appear in person or through an agent or an attorney of his/her choice. The applicant/agent/attorney may present testimony, evidence and arguments in support of his/her application. The fact that an application for a permit has been filed does not automatically mean that a permit is granted. Upon the Board making a decision on the application, the Zoning Administrator shall notify the applicant of the decision in writing. All site plans, pictures, etc. become the property of the Community Development Department and will remain in the file. The proposed project consists of removing the existing home and driveway at the above address and constructing a new home and driveway in its place. The existing well and septic will remain in place and be utilized by the new home. The exact construction schedule is not yet known as the permits haven't been obtained. The following is a preliminary schedule for 2018/2109: Complete permitting - July, 2018 Install Sediment Control - August Remove existing home - August Install new driveway and temporary rain garden- August Construction new home foundation and begin framing house - September Connect utilities, install Infiltration Trench and complete site restoration- September Complete house construction - December Pave driveway, clean rain garden, remove sediment control after site is revegetated - Spring 2019 Storm Water Volume Two proposed storm water facilities will infiltrate more than 1.5" from the new home and driveway. A rain garden will be installed west of the new driveway and capture runoff from the drive and east half of the garage (see Site Plan). The remainder of the roof runoff will be transferred to an infiltration trench west of the house via buried drain tile. "HydroCad" hydrology software was used to model the developed flow volumes (see App. A). The following table summarizes the 1.5" rainfall high water elevations for the two storm water facilities: FACILITY HIGH WATER ELEVATION Rainfall Capacity Rain Garden 781.94 782.00 Infiltration Trench 781.21 781.30 The model was run using a conservative infiltration rate of 3.6"/hr. per the WDNR Technical Standard 1002. The site soils are Sattre Loam with a typical profile indicating Coarse Sand at a depth of 30". The Contractor shall install the infiltration facilities to a depth that encounters that sand layer. -1- The Infiltration Trench should be inspected annually 24 hours after rainfall events of 1.5" or more to verify that the water has infiltrated. The Rain Garden should also drain down in 24 hours or less in non-frozen conditions. It may be necessary to clean silt accumulation from the bottom periodically in order to promote proper infiltration. Vegetation Management The existing site contains scattered trees and brush north and east of the existing home. All of the trees/brush within the Limits of Disturbance shown on the Site Plan will be removed. A wooded area will remain west of Glenmont Road that completely screens the new home from the St. Croix River. The Site Plan contains notes regarding temporary, permanent and winter restoration. It also shows the silt fence and erosion mat locations. All disturbed areas that are not to be paved or landscaped shall be restored with a minimum or 4" topsoil (tilled or Harley raked prior to seeding), seeded, fertilized and mulched.
