RESOLUTION APPROVING AMENDMENTS TO THE TOWN OF 4 HUDSON ZONING ORDINANCE 105-12C(6)(A)[7], 105-13E(1)(G) AND 105-14D(1)(G) AMENDING EXTERIOR WALL FINISH REGULATIONS; 105-13F(6) AMENDING BUILDING HEIGHT REGULATIONS; 105-12H(1) 105-13F(5), AND 105-14G(1) AMENDING STRUCTURE SETBACKS; 105-19B(1)(B), 105-19B(2)(A), 105-19B(2)(B), 105-19B(3)(A), 105-19B(3)(B), 105-19B(4)(A), 105- 196(4)(6) AND 105-19B(5)(B) AMENDING STRUCTURE SETBACKS FROM HIGHWAYS;AND 105-19F AMENDING ACCESS DRIVEWAY REGULATIONS 1 WHEREAS, on March 19, 2018 the Town of Hudson Plan Commission reviewed and 2 provided recommendations on the proposed text amendments; and 3 4 WHEREAS, on April 10, 2018 the Town of Hudson Town Board held a properly noticed 5 public hearing on the proposed text amendments to the Town of Hudson Zoning Ordinance; and 6 7 WHEREAS, following the public hearing, the Hudson Town Board approved text 8 amendments shown in Exhibit A; and 9 10 WHEREAS, Section 60.62(3), Wisconsin Statutes states that in counties having a county 11 zoning ordinance no town ordinance amendment is effective unless approved by the county board; 12 and 13 14 WHEREAS, St. Croix County has a zoning ordinance; and 15 16 WHEREAS, the Community Development Committee has reviewed the proposed 17 amendment and recommends approval. 18 19 THEREFORE, be it resolved by the St. Croix County Board of Supervisors that the 20 amendments to the Town of Hudson Zoning Ordinance described above are hereby approved. Supervisors Ostby, Foster and Jordan and Clerk, Vickie Shaw were in attendance. The Town Board is amending the following zoning ordinances 105-12 C(6)(a), 105-13E(1), and 105-141)(1)to clarify exterior wall finishes; 105-13F(5), 105-12H(1),and 105-14G setbacks; 105-12G, 105-13F6, 105-14F Building height; 105-19B Highway setback requirements; 105-19F Access driveways. Chairman Johnson asked for comments for the proposal. There were none. Chairman Johnson asked three times for comments for the proposed change. There were none. Chairman Johnson asked for comments against the proposal. There were none. Johnson asked 3 times for comments against the proposal. Requirements on setbacks and yards. The minimum building setback from any Commercial District boundary or public street right-of-way shall be 50 feet from the right-of-way. 1. Building setbacks. a. Interior lot line :50 feet b. Agricultural Residential and Residential boundary: 100 feet 105-13F Industrial (5) Setbacks. The minimum building setback from any Industrial district boundary or public street right-of- way shall be 50 feet from the right-of-way. (a) Interior Side yard : 50 feet (b) Rear Yard: 50 feet (c)Agricultural Residential and Residential boundary: 100 feet 105-14 Commerical/Light Industrial G, ` Requirements on setbacks,yards and turn lanes. The minimum building setback from any Commercial/Light Industrail District boundary or public street right-of-way shall be 50 feet from the right-of-way. (1) Building setbacks (a) Interior Lot Line: 15 feet (b) Agricultural Residential and Residential boundary: 100 feet Building height 105-13 F. Requirements for building coverage, setbacks and height.. f6l Maximum building height. Maximum building height for any structure within the Industrial District shall be 70 feet. Measurement of the height shall commence at the top of the footings. Highway setbacks. For the purpose of determining the distance buildings and other structures shall be set back from streets and highways, the highways of the Town of Hudson are divided into the following classes. ('t� Class A highways. (a) All arterial highways classified as freeways or expressways are hereby designated as Class A highways. (b) The setback from expressways shall be 50 feet from the right-of-way line, These setbacks are also applicable to all officially mapped right-of-way for highway locations or where right-of-way has been purchased for future highway locations. This includes those parts of Interstate Highway 94, US Highway 1.2, and Wisconsin State Highway 35 located in the Town of Hudson. (c) C Prior to the issuance of a permit for any structure on the property adjoining right-of-way of Class A highways, the Department of Transportation, Eau Claire District, must be consulted. (2) Class B highways. (a) All highways classified as primary, standard and minor arterials and not further classified as a freeway or expressway are hereby designated as Class B highways._� ,--, t The setback from Class B highways shall be 50 from the right-of-way line. (c) Prior to issuance of a permit for any structure on property adjoining right-of- way of Class B highway, the Department of Transportation, Eau Claire District, must be consulted. ( ) Class C highways. (a) All highways classified as high or low collectors are hereby designated as Class C highways. _ vv� (b) The setback from Class C highways shall be 50 feet from the right-of-way fine. (c) Prior to issuance of a permit for any structure on property adjoining right-of- way of Class C highways, the agency having jurisdiction over the highway must be consulted (St. Croix County Highway Department). ( ) Class D highways. (a) All highways not included in the aforementioned classifications are hereby designated as Class D highways. nct (b) The setback from Class D highways shall be 50 feet from the right-of-way line. (c) Prior to issuance of a permit for any structure on property adjoining right-of- way of a Class D highway, which structure would require construction of a new means of access from the Town highway, the Town Chairman must be consulted. (5) Class E highways. (a) Local roads within a major subdivision may be designated by the Town Board, in its discretion, as Class E highways, notwithstanding the provisions of Subsection (4) above. Vickie Shaw Town Clerk 3/22/18; 3/29/18 Town of Hudson Plan Commission March 19, 2018 Present at the meeting were John Wendle, Gale Qualls, Brian Wert, Fred Dietze, and Sarah Wang. Wert called the meeting to order at 7:00 p.m. Qualls moved to approve February 2017 minutes,second by Wang. Motion carried. Norflex presented plans for an addition to their building at 720 Norflex Drive.They are in the process of requesting variances for the setbacks and height of the building.The new loading dock would encroach on the 50' setback.The Town is changing the ordinance to a 40' setback to match the Schommer Drive area and they are asking for a variance to be 30'.The fire chief is fine with the proposed building height of 70' since they are installing an access road around the building as requested.The 70' height is needed to accommodate machinery.The silos will be 80' high.The total square footage of the addition is 41,368, including the load dock and pump house. They will extend the railway spur by 500'.The site plan shows a future phase 3 but they are not asking for permission for that at this time. All lighting is downward cast and will be about 30' high on the building.There will be no new signage or increased noise. One of the blowers on the roof has been noisy and they will be replacing it.There is a gravel surface parking area for semis.The addition will be built with precast insulated wall panels with buff exposed aggregate raked finish.The addition will allow them to add production lines and about 32 more employees.They receive material by rail car and ship out by truck; truck traffic will double.They operate 24 hours a day, 7 days a week.The stormwater calcs are done and at the county. Dietze moved to recommend to the Town Board to approve the site plan for the addition to Norflex at 720 Norflex Drive as presented, second by Qualls. Motion unanimously carried. Doug Zahler and Shawn Bird presented the final plat of Hunter Hills Estates.There were questions if the Town Board approved a preliminary plat that the Plan Commission did not get to see.The County sent a letter in October of 2017 of items that needed to be addressed. Doug Zahler had not seen that letter but said the DNR and DOT issues have been addressed. The Town said they had what they required from the Town Board meeting.The 50' setback from wetlands is not shown and there are no LBOs on lots with the wetlands.They will stake the wetlands.There was discussion on benchmarks and staking the exterior boundaries. Road lengths should have been on the preliminary but they'll need that total again for the Town Board. Outlot 1 is going to be retained by the developer for construction purposes and may give it to Lot 5 once the development is built. Wendle moved to recommend to the Town Board to approve the final plat of Hunter Hills Estates,second by Dietze. Motion unanimously carried. Setbacks under 105-13F(5), 105-12H(1), and 105-14(G)were discussed.The State of Wisconsin has decided to not allow municipalities to impose a more stringent setback than 50'from freeways, highways, and Class A, B, C, or D roads. Wang moved to recommend to the Town Board to change the setbacks under 105-13F(5), 105-12H(1), and 105-14(G)to 50', second by Qualls. Motion unanimously carried. Building height under 105-12G, 105-13F(6), and 105-14F was discussed.The Town is proposing to change the maximum height from 45'to 75'.The fire department's upgraded equipment allows the increased height from when it was set 30 years ago. Dietze moved to recommend to the Town Board to change the maximum height under 105-12G, 105-13F(6),and 105-14F to 75', second by Wang. Motion unanimously carried. Highway setback under 105-19B were discussed. Qualls moved to recommend to the Town Board to change the setback to 50', second by Wang. Motion unanimously carried. Spacing between access driveways was discussed. On Class C roads the required separation is 200';this will need to change to 500' per County requirement. Class B and C roads will require 500' of separation; Class D will require 200'; and Class E will require 100'. Dietze moved to recommend to the Town Board approval of combining Class B and C roads and to separate Class D,second by Wendle. Motion unanimously carried. Discussion was held about highway designation/classification and questioning the wording under Class D,which reads "A minimum of 200' spacing between access driveways; adjoining driveways permitted to accomplish same."The Commission would like clarification on that wording.
