SR0l `' T RESOLUTION SETTING LIBRARY TAX LEVY FOR 2018
1 WHEREAS, Wis. Stat. § 43.12 requires that counties reimburse libraries for the cost of
2 serving residents living within municipalities located in the county that do not have their own
3 municipal library; and
4
5 WHEREAS, such residents are referred to in Wisconsin library finance terms as "rural
6 residents;" and
7
8 WHEREAS, the cost is determined by dividing the total operating expenditures by the
9 total number of circulations and then multiplying that amount by the number of actual
10 circulations provided to rural residents of the County who have used that municipal library; and
11
12 WHEREAS, the County, in its Plan of Library Service 2015-2018 ("Library Plan"), has
13 determined that it is just and proper to reimburse the libraries at no less funding than the full cost
14 (100%) of providing library services to rural residents; and
15
16 WHEREAS, the County retains the right under its adopted Library Plan to adjust funding
17 for reasons that are other than arbitrary; and
18
19 WHEREAS, the Town of Hudson and the Town of St. Joseph requested approval from
20 the County to join the Hudson Area Joint Library in 2002 and 2004, respectively; and
21
22 WHEREAS, there was concern that several of the neighboring municipalities with
23 existing libraries would lose rural circulation revenue if such approvals were granted; and
24
25 WHEREAS, it is documented in 2002, and again in 2004, that the Hudson Area Joint
26 Library and its participating municipalities pledged to continue to pay the neighboring libraries
27 in the same manner as the County had been doing so that the affected neighboring municipalities
28 would lose no rural circulation revenue; and

30 WHEREAS, the County relied on those representations in approving the participation of
31 the Town of Hudson and the Town of St. Joseph in the Hudson Area Joint Library in 2002 and
32 2004, respectively; and

34 WHEREAS, in 2013 the participating municipalities of the Hudson Area Joint Library
35 and the Board of Trustees of the Hudson Area Joint Library decided to renege on this promise;
36 and
37
38 WHEREAS, beginning in 2014 and continuing, Hudson Area Joint Library no longer
39 passes along to its neighboring libraries the share of tax revenue that had been promised; and

41 WHEREAS, the County is required to pay at least 70% of the cost of rural circulation by
42 March 1 of each year to each public library.

44 NOW, THEREFORE, BE IT RESOLVED that St. Croix County shall pay to the
45 Hudson
46 Area Joint Library 70% of the cost of rural circulation by March 1, 2019 and shall pay all other
47 municipal libraries serving residents living in municipalities that do not have their own
48 municipal library 100% of the cost of rural circulation by March 1, 2019.

50 THEREFORE, BE IT FURTHER RESOLVED that the difference between 100% and
51 70% of the cost of rural circulation reimbursement to the Hudson Area Joint Library, $28,078, be
52 distributed by the County among those libraries within the County in proportion to how they
53 have been adversely affected by the Hudson Area Joint Library's breach of its original promise
54 that was relied upon by the County when the County granted its approval for the participation of
55 the Town of Hudson and Town of St. Joseph in the Hudson Area Joint Library. Said payment of
56 this distribution shall be made to the affected libraries by March 1, 2019.

58 THEREFORE, BE IT FURTHER RESOLVED that this Resolution be reflected in the
59 County's budget for 2019.
