Construction on this tower must cormrmence within one year of the permit date and must be substantially completed in two years. Applicants can request extensions of one or both deadlines, for periods up to six months, from the Loninq_ Administrator. I he total time for extensions shall not exceed one year. 4. St. Croix County reserves the right to require additional sediment and erosion control measures to be. installed if found necessary due to site-specific concerns and will be documented in an as built site plan. This approval is subject to the conditions listed above; it does not allow for any additional construction, structures, or buildings beyond the limits of this request. If an application is to construct a new mobile service Support structure, an explanation as to why the applicant chose the proposed location and why the applicant did riot choose co-location. a) The explanation must include a sworn statement from an individual who has responsibility over the placement of the mobile service support structure attesting to one of the following: i. That co-location within the applicant's search ring would not result in the same mobile service functionality, coverage, and capacity. ii. That co-location is technically infeasible. iii. That co location is economically burdensome to the mobile service provider. 3. If the application is to construct a new mobile service support structure, a construction plan which describes the proposed rnobile service support structure and the equipment and network components, including antennas, transmitters, receivers, base stations, power supplies, cabling, and related equipment that will be placed on or around the new mobile service support structure. The Director is responsible for the placernerrt of the mobile Service support structure" described herein ('the I loultor rower",) and the County will be the exclusive owner/ operator of this structure. WisDOT also owns al. land that surrounds the tower. An appropriate and authorized official of WisDOT has signed the Land Use Permit Application as the ' Property Owner.' the tower will also be built in compliance with all applicable federal laws; rules, and regulations, including those of the Federal Communications Commission (FCC) and the Federal Aviation Administration (FAA). The County has received a "no hazard" to airspace determination from the FAA and a "Permit to Construct" the tower Structure from the Wisconsin Department of Transportation (Bureau of Aeronautics). By County Board decree. the SCCESS is responsible for operation of the County's 9-1-1 center and for providing essential emergency and non-emergency public-safety communications across the County. as we'J as on and along the St. Croix River (shared responsibility with Minnesota and the Federai Government), all in Support of public health, safety, and welfare. SCCFSS serves over three dozen law enforcement, fire, emergency medical services, and other state, county, township, zwd municipal first responder entities. As an integral part of the County's extensive multi year radio, dispatch, and 9-1-1 upgrade, the SCCESS is building out a 14-site VHF simulcast radio system to ensure county-wide coverage of pagers and two-way radios, including mobile and portable radios. One remaining needed piece of this project is the construction of the Hou'.ton Tower (and accompanying radio shelter) to house COUnty-owwned antennas and radio Communications Ccuiprnent capable of providing said essential public-safety communications for the 'lulnerouS Users described herein and whom operate in and around St. Joseph Township and surrounding cities and townships, as well as the nearby St. Croix River. 2 • • The SCCESS is also provicinq access on the I iouIto n Ioveer to a number of co-locators, incluclinq_ the Minnesota Department of Transportation ('•MnDOI and its broad array of ARMLRI J the Washington County Sheriff's O(Gcc ("WCSO"), and the Wisconsin Slate Patrol (°WSP"). Like SCCL=SS, these agencies will be utilizing Jre Houlton I over and the shared shelter space for their public-safety communications equipment necessary to provide emergency services to the broad population base they are charged with protecting. MJ and WCSO are financial contributors to this project: WSP (vis-a vis, WISDOT) is providing the leased land at no charge, entitling all of these entities to "lifetime, use of the Houlton Tower. The construction of this structure and the c_o-iocation of these entities will obviate the need for them to individually build additional mobile service support structures, some of Which would likely be built in SL Croix County. F,rthermore, in the interest of potentially reducing the number of other such structures in the area in the future: and in conformity with the County's recently enacted tower ordinance. the Houlton Tower build specifications provide for space fog at least two future additional c o locators. such as wireless service providers. The WisDO1 property was chosen because of its unique position Within the Town of St. Joseph. its proximity to the St. Croix River, and its location relative to Minnesota. Tne site was also specifically located to maxim'ze radio cornntunications propagation for the St. Croix County Sheriff's Office patrol vehicles and pduol boa; (on the SL Croix River): the SL Joseph 1l,I Fire Department/First Responders; the Somerset F re Department/First Responders; the I Judson and North I ludson police departments; and others. such as the Wisconsin Department of Natural Resom-ces. The HOUlton 1ovI should provide all of the County's co-locators WSP, MnDOT (including the Minnesota State Patrol and MnDOT trucks used to maintain/service the new St. Croix River Crossing), arid WCSO (including agencies it dispatches, inter olio, the Stillwater and Bayport Police and Fire Departments, Oak Park Heights Police Department, and Lakeview EMS)-the most advantageous locaton for their respective radio transmissions. the applicant, or agents on the applicant's heha.f, searched a wide area in the County, as well as in Minnesota, for a suitable. existing co location site. As a practical matter, no other potential co-location site within this search area could provide the necessary same mobile service functionality, coverage, or capacity. No other site was able to accommodate the varied radio needs of the numerous users, including the ability to provide technical feasibility and radio coverage, nor provide the needed capacity for tile. volume of two way radio antennas, microwave dishes, and corresponding coaxial cables that will attach to the Houlton Tower. In fact, the proposed Houlton Tower will house six (6) miciowave dishes and a minimum of seven (7) land mobile radio antennas, along JiI corresponding cables. essentially enough to overwhelm most area towers even without any other users onboard. In addition, no other Site was able to provide the necessary height for the microwave and land mobile radio antennas. The afore- mentioned site construction, with the up-front financial and land contributions from the County's co locators, is in the best interest of the State of Wisconsin and St. Croix County, and provides the Houlton Tower at the lowest cost to County taxpayers than any other option. For the record, at the request of the SCCESS, w) the evening of Thursday, March 9, 2017, the St. Josepl, To.vn Board held a "Public Informaf.on Meeting" at its Town Hall after the meeting had been publicly "noticed' by the Town Clerk in local ne vspapers in late February and early March. 2017. The stated purpose of the meeting was to discuss a proposed public. safety radio tower to be constructed in the Houlton area (the subject of the current application). The Town Board convened that night and, upon the time stated in the public notice, turned the meeting over to the SCCFSS for an approximately 30 minute informational meeting and question and answer period w:th the pub'.ic in attendance. SCCESS was represented by its Director, as well as Mr. Jeff Nelsor of PSC Alliance, the County's radio Consultants, and Mr. Terry Andersen, the County's 9-1-1 Manager. Questions from the audience were minimal aril related to some financial aspects of the tower. the M,nnesota partners (co-locators), and related matters. There t~:as no stated opposition to the tower by those in attendance. - Pursuant to the St. Croix County Coce of Ordinances, Land Use and Development, Section 17.50(D)(2)(c)(1 & 3), all required supporting documentation, including site plans, maps, and diagrams arc attached. As this is an application to construct a new mobile service support structure, a construction plan is also attached which describes the proposed mobile service support structure and the equipment and network components, including antennas, transmitters, receivers, base stations, power supplies, cabling, and related equipment that will be placed on or around the new mobile service support structure. Since the radio equipment shelter is designed only for infrequent, short-term maintenance/ service visits by radio technicians, no private water or sanitary system will be installed. No structure(s) will be built in a floodplain, public right-of-way, or aeronautical-affected safety zone, but the tower will be lit in compliance with FAA rules and regulations for such structures in excess of 200 feet.
