VALIDATE RENTAL UNIT WEATHERIZATION STIPULATIONS AND
WAIVERS

St. Croix County, Wisconsin
WHEREAS, ownership of rental units in Wisconsin may not be transferred
without meeting minimum energy efficiency requirements or without a stipulation
relating to or a waiver of the minimum energy efficiency requirements; and
WHEREAS, in the past, the Wisconsin Department of Commerce (DOC), the
agency responsible for rental units energy efficiency regulations, imposed a fee of $50.00
for validating stipulations and waivers; and
WHEREAS, in the past, the DOC validated stipulations and waivers, or allowed
agents to validate and reimbursed the agents $5.00 for each stipulation and waiver
validated; and
WHEREAS, in May, 2008, the DOC discontinued imposing the $50.00 fee for
validating stipulations and waivers, and discontinued reimbursing agents $5.00 for
validating stipulations and waivers, but did not discontinue the use of agents; and
WHEREAS, as before, stipulations and waivers can still be sent to the DOC for
validation or can be taken to an agent for validation; and
WHEREAS, the St. Croix County Register of Deeds wishes to continue to be an
agent for the Department of Commerce for validating stipulations and waivers; and
WHEREAS, the Wisconsin Register of Deeds Association recommends a fee of
$20.00 be charged for validating stipulations and waivers.
THEREFORE, BE IT RESOLVED by the St. Croix County Board of Supervisors
that the St. Croix County Register of Deeds is authorized to continue as an agent for the
Department of Commerce and to offer to validate stipulations and waivers.
FURTHER, BE IT RESOLVED that the Register of Deeds collect a fee of $20.00
for each stipulation or waiver validated.

RESOLUTION AUTHORIZING REGISTER OF DEEDS TO CHARGE
A FEE FOR PROCESSING RENTAL UNIT
WEATHERIZATION STIPULATIONS AND WAIVERS

WHEREAS, effective May 1, 2008, the Department of Commerce discontinued charging a fee
of $50.00 for processing rental unit weatherization stipulations and waivers; and
WHEREAS, St. Croix County will no longer receive a $5.00 reimbursement payment from the
Department of Commerce for processing services provided by the St. Croix County Register of
Deeds as agents for the Department of Commerce; and
WHEREAS, the St. Croix County Register of Deeds wishes to continue to be an agent for the
Department of Commerce for processing rental unit weatherization stipulations and waivers; and
WHEREAS, the Wisconsin Register of Deeds Association recommends a fee of $20.00 be
charged for rental weatherization agents that provide this processing service; and
THEREFORE, BE IT RESOLVED, that the St. Croix County Register of Deeds continue as
an agent for the Department of Commerce.
FURTHER, BE IT RESOLVED that the Register of Deeds collect a fee of $20.00 for each
rental unit weatherization stipulation or waiver processed.
