CROIX COUNTY AND THE AFSCME HIGHWAY UNION FOR 2008 - 2010 Resolution No. j 4 / CaboS) St. Croix County, Wisconsin WHEREAS, St. Croix County representatives have negotiated a labor agreement with the AFSCME Highway Union for the years 2008 through 2010; and WHEREAS, all the terms of the labor agreement in effect for 2006 through 2007 become the terms of the agreement for 2008 through 2010, except as modified by the attachment to this resolution; and WHEREAS, the Finance Committee recommends approval of the agreement. THEREFORE, be it resolved by the St. Croix County Board of Supervisors that the labor agreement for January 1, 2008 through December 31, 2010 between St. Croix County and the AFSCME Highway Union is approved. Health Insurance An optional plan will be developed for 2009. If agreement on the optional insurance plan is in place by July 1, 2008 then the following additional wage increase will be given to employees: 7/1/08 1% 7/1/09 1% 7/1/10 1% The plan will be optional in 2009 but all employees must move to this plan by open enrollment in 2010 for coverage in 2011. Tentative Agreements St. Croix County For a 2008 -2011 Highway Agreement Proposed additions are indicated by underlining; Proposed deletions are indicated by strikeout. 1. ARTICLE 5— PROBATION, Section 5.01- Revise last paragraph as follows (for clarification purposes): Probationary employees may not post for position changes pursuant to Article 8 of this Agreement; however they may apply, without rights, through the general recruitment process. 2. ARTICLE 6 - -HOURS OF WORK, CLASSIFICATION, PAY, Section 6/06- Part -time Benefits- Correct reference in second paragraph by changing "Section 14.03" to "Section 14.04 ". 3. ARTICLE 7— SENIORITY— Section 7.01, Definition- Revise first paragraph as follows: Union seniority means an employee's total length of service in the bargaining unit. Union seniority is used for purposes of posting rights and bumping rights. Union seniority is only applicable within the jurisdiction of the individual bargaining units in this Agreement. - . - . - - - - . - , _ _ 4. ARTICLE 13— PERSONAL TIME OFF (PTO), Section 13.09- Restrictions- Revise last sentence of last paragraph, as follows: Review the applicable Union Appendix or departmental rules to determine specific restrictions. 5. ARTICLE 13— PERSONAL TIME OFF (PTO), Add new Section 13.12 as follows: Probationary period. An employee who does not successfully complete his /her probationary period is not eligible for a pay -out of PTO upon termination. 6. ARTICLE 13— PERSONAL TIME OFF (PTO), Section 13.04 PTO Accumulation. The PTO accumulation of hours cannot exceed 320 hours for a full -time 1 C employee and 240 hours for a part-time employee. Full -time employment is defined as working an average of 35 or more hours per week; part-time is defined as working an average of 20 to 34.9 hours per week. Anytime the total number of accrued PTO hours is in excess of what is permitted, the excess hours are automatically subtracted from the total and the employee remains at 320 hours (full -time) or 240 hours (part- time). These excess hours will be automatically added to the employee's long term sick bank. 6. ARTICLE 14— HEALTH INSURANCE, Section 14.03, An alternative health plan option for 2009 coverage will be developed and included. 7. ARTICLE 23- DURATION, Section 23.04- Bargaining Representatives - Revise first paragraph as follows: The County shall be represented by a committee and /or representative(s) of its choice. In addition to any designated AFSCME staff representative(s), the Union shall be represented by up to two (2) employee representatives per bargaining unit. 8. ARTICLE 25— DIRECT DEPOSIT, Add the following: All employees will be paid by direct deposit effective 07/01/08. 9. LANGUAGE CLEANUP: Replace any reference to Personnel Department with Human Resources Department. Replace any reference to Personnel Director with Human Resources Administrator. 10. WAGE GRID- Revise as follows: *Shift differential: Employees regularly scheduled to commence work after 3:15pm or before 7:00 am shall receive a premium of twenty cents ($.20) per hour. This shall not apply when working a 4 x 10 schedule which starts prior to 7:00 am. 11. Eliminate Foreman Sideletter 12. Payment for hazmat endorsement For positions requiring hazmat endorsement the County will pay $100 for up to 4 ees to cover the cost. 13. Posting Language ARTICLE 8 —JOB POSTINGS SECTION 8.04 JOB ASSIGNMENT. The posted position shall be assigned to the bargaining unit employee with the greatest seniority provided that such employee meets all of the stated qualifications for the position. If there are no qualified applicants among current bargaining unit employees, the Employer may recall qualified employee(s) on lay -off, if any. If there are no qualified bargaining unit employee applicants, the Employer may fill the position by selecting any other qualified applicant(s). County employees will receive preference in selection when two or more final applicants are determined to be substantially equal. If selected employee retrocedes within the allowable ten (10) days or the Employer returns the employee to their position within the allowable trial period of up to sixty (60) days, the position shall be offered to the next qualified applicant from the original posting. After the sixty (60) days trial period, the position shall be reposted if it becomes vacant.
