FINDINGS OF FACT AND CONCLUSIONS OF LAW
11m ine heard all the lestimom, considered the entire record herein, and visited the sift, the Board of Adjustment
makes the following Findings of Fact and Conclusions off avv pertinent to the applicant's Conditional Use
requests:
1. 'I he applicant and property owner is 'I yler "Ironies.
2. The site is located at 1 ?84 +2nd Street in putt of Sec.l 8. T.')W R 19W. Town of Somerset.
The site is approximately i acres, is zoned as Commercial District and is surrounded by
commercial property.
4. The applicant filed an application with the St. Croix County Board of Adjustment for a
Conditional Ilse Permit lair a Dealership pursuant to Section 17.18 (9)(h) of the St. Croix
County zonine Ordinance. to operate a trailer, tool and small cquiptneut rental and sales
bUSiuCSs.
5. Operation hours arc 8AM to 611M. Monday through Saturday and Sundays by appointment
only.
6. There is an existing pole building that will used as the business office and to store smaller
equipment. 'I he larger equipment %Nill be stored outside rnt the gravel storage yard area.
7. Additional parking spaces proposed in the site plan will comply with Section 17.57 (5),
Oil=Street Parking, and will be paved.
8. There is existing green space that meets the minimum landscaping area and there is no
adjacent residential land use that requires immediate vegetative screening.
9. '1 lie Town of Somerset recommended approved of the request.
DECISION
On the basis of the above Findinp of Fact. Conclusions of ki%k, and the record herein, the Board approved
the applicant's Conditional Use request, with the following conditions:
1. Conditional Use Permit approval will allow the operation of a Dealership for a trailer, tool
and small equipment rental and sales business.
2. f lours of operation shall be from 8ANT to 611M, Monday through Saturday and Sundays
by appointment only.
3. All driveways and parking lots as shown in the site plan shall be paved by October 25,
2020.
4. The existing drivcwav that will provide access 1br servicing the wireless communication
tower facility shall have restricted access, by use of a gate or other appropriate device. to
prevent use by the general public.
5. '1 he applicant shall maintain the existing vegetative screening.
6. All lighting associated with the business shall be illuminated downward and shielded away
from public view.
7. All signagc shall comply with Section 17.65 Sign Regulation of the St. Croix County
Zoning Ordinance.
9. The applicant shall secure all necessary permits and approvals from any other required
local, slate or federal permits.
9. These conditions may be amended or additional conditions may be added if unanticipated
circumstances arise that would allect the health ano.Vor safety of citizens or degrade the
natural resources of St. Croix County. Conditions will not he amended or added without
notice to the applicant and an opportunity for it public hearing.
10. Any new owners of the property must adhere to the standards and conditions ol- the
approved Conditional t_sc permit. Any change or addition in use of the property,
buildings; or modification of'or addition to the property or buildings shall require review
by the Zoning Administrator to determine i f the use may be allowed. 't his decision applies
to the property rather than to the individual. is valid ]Or only the specified property. and is
not translen-ablc to other properties.
1 I . Accepting this decision means that the applicant and their agent have read, understand, and
agree to all conditions of this decision, and have no objections to County stalYconducting
unannounced onsitc inspections to check for compliance with this permit.
The following vote was taken to approve the request Chairperson Malick, (Ycs); Vice Chairman Peterson.
(Ycs); Nelson, (Ycs): Miller, (Yes); Scltalla, (Yes). All in favor. motion carries.
APPEAL RIGHTS
Any person aggrieved by this decision stay' file an appeal in St. Croix County circuit court within 30 days
alter the tiling date shown below, pursuant to Sec. 59.694(10), Wisconsin Statutes. St. Croix County
assumes no responsibility for action taken in reliance on this decision prior to the cxpiralion of the appeal
period. St. Croix County does not cenil'v that the identity of all persons legally entitled to notice of the
Board of Adjustment proceedings, which resulted in this decision- was provided to the County.
It an appeal is taken of this decision, it is the responsibility of the appellant to submit at his-`her expense a
transcript of the Board of Adjustment proceedings to the circuit court. 'I he Community Devclopntent
Department can he contacted for information on ho%% to obtain a transcript. It is the responsibility of the
Board of Adjustment to submit its record (tile) of this mailer to the circuit court.

CONDITIONAL USE CRITERIA
Pursuant to the St. Croix County Xoning Ordinance Section 17.70(7), please answer the follo+ving questions tojustity
the approval of your request fauach additional paper if necessary):
1) Describe the details of your request.
Requesting approval to operate a trailer, tool, and small equipment rental and sales business.
2) Describe the impact of your request on the enjoyment and value of surrounding properties. If there is no impact,
explain why.
The current conditional use permit approved for this property was a dog boarding business. This conditional
use would impact the surrounding properties in roughly the same way. Storage of outside trailers and
equipment will visually impact the surrounding properties.
3) Describe the compatibility of your request with the uses and character of the surrounding area.
This proposed use would provide the local community with trailer, tool, and equipment rental and sales
options.
4) Describe how your request is consistent with the spirit and intent of the zoning district in which your property is
located. (plem'e refer to the purpose siatement for Vour zoning district in the .St. Croix County Zoning Ordinance.)
This use would provide the local community with rental and sales services.

This use will have no major public health, safety, or general welfare impacts.

The property will have paving at the entrance and parking areas to eliminate any dust. I don't believe there are
other concerns related to this proposed use
7) Additional comments:
This proposal includes a new driveway entrance to allow proper traffic flow and paving. The current access is
used for heavy crane traffic for the existing cellular tower located onsite and should not be paved or used for
the main entrance. The existing entrance could possibly be gated and only be used for cellular tower
construction traffic if approved.

GENERICL CONDITIONAL USE APPLICATIO9PROCEDURE
APPLICATION:
The deadline for application submittals is the Ist Monday of the month before the regularly scheduled St. Croix County Board of
Adjustment meeting. The Board of Adjustment generally meets on the 4"Thursday ofthe month.
Applications will not be accepted until the applicant has:
• %let with the Zoning Administrator to review the application;
• Oririnal plus 10 copier submitted of the entire packet including all supporting information, maps & diagrams;
• Resolved any land use violations and paid any outstanding fees owed to the Community Development Department
• Signed the application form ((he signatures ofthe prolrrrty unmers and agents acting on their hehaljare required): and
• Submitted the appropriate application fee lnonre%unduble) payable to St. Croix County.
REVIEW:
The Zoning Administrator will review the application for completeness and assign a file number to the application. The Zoning
,Administrator may require additional information arid will notify the applicant of this within 10 days. Upon receiving a complctc
application and supporting documents, the Zoning Administrator will:
• Schedule a public hearing with the St. Croix County Board of Adjustruent and notify the applicant by mail of the date and
time of the public hearing:
• \otify adjoining property owners of the. applicant's request;
• Publish a public hearing notice in the local paper;
• Send copies of the applications to the appropriate town and reviewing agencies for conmrenf. Applicants are encouraged to
contact their town and attend their town ntceting to discuss-the ir a Iication:
• Schedule a site visit to the applicant's property, at which time the applicant shall flag all applicable propertyiproject corners
and label the flags accordingly; and
• Prepare a staffreport on the application. The stalfreport will he mailed to the applicant and will be available for public
review during the week prior to the public hearing.
ACTION:
Conditional Use permits are granted at the discretion of the St. Croix County Board of Adjustment. They are made avadahlc to
validate uses that, while not approved within the toning district in question, are deemed to be compatible with approved uecs and or
not found to be hazardous, harmful, offensive or otherwise adverse to otter uses. Conditional Uses are subject to conditions.

At the public hearing, the applicant may appear in person or through an agent or an attorney of hisihcr choice. The
applicanvagenU.attorney may present testimony, evidence and argumcnts in support of hisRtcr application. the fact that an application
Ibr a permit has been filed does not automatically mean that a permit is punted.
I!pon the hoard making a decision on the application, the Zoning :Administrator shall notify the applicant of the decision in writing.
All nQ plans, pictures, etc. become the property of the Community Development Department and will remain in the file.
