Michael & Louise I luster,
Community Development staff have reviewed the Land Use Permit application for land disturbance
necessary to replace an existing Private Onsite Wastewater Treatment System (POWTS) in the Lower
St. Croix Riverway Overlay District. The request has been conditionally approved based on the
application submission and the following findings.
On November 20, 2018, State Sanitary Permit 11606971 was approved to replace the existing septic
SySlem.
• smiled vegetation will be necessary in order to replace the POW fS.
• Best Management Practices and Stormwater Management will be incorporated during land
disturbance activity.
Based on these findings, approval of the I and tJse Permit is subject to the following conditions:
1. All temporary erosion control measures shall be installed before any land disturbing aclivily and left
in place and maintained until the site has reached a point of at least 70% permanent vegetation
and/or retaining walls have been set. Seeding to be done immediately following final grading.
2. Community Development Deparlrnenl staff reserve the right to require additional erosion control
measures it found necessary due to site conditions.
3_ It is the applicant's responsibility to secure any other required local, state or federal permit(s) and
approval(s) prior to land disturbance activity.
4. Failure to comply with the terms or conditions above may result in the revocation of this permit by
the Zoning Administrator pursuant to Chapter 17.36.

construction, structures, or buildings beyond the limits of this request. Your information will remain

to ensure cornpliame with any other local, state, or federal permitting or regulalions, including
contacting the Town of Troy and the Department of Natural Resources to inquire if additional
permissions are required.
This permit is valid for one year, with the possibility of up to two (2) six-month extensions if the
applicant submits the appropriate permit extension fee and documentation to the Zoning
Administrator. A copy of the Land Use Permit placard should be submitted to the local Building
Inspector for the town upon apphcalion for the building permit. The orange placard must be posted
on lhejob site and visible from public view.

THIS APPLICATION IS FOR THE REPLACEMENT OF THE PRIVATE ONSITE WASTEWATER SYSTEM
(POWTS) SERVING THE EXISTING DWELLING AT THIS LOCATION. THIS SYSTEM IS FAILED AND COULD
POTENTIALLY BE A HEALTH ISSUE. ALL DEPARTMENT OF SAFETY AND PROFESSIONAL SERVICES CODE
SPS 383 WILL BE FOLLOWED. THE SANITARY PERMIT APPLICATION AND DESIGN IS BEING SUBMITTED
AT THE SAME TIME AS THE LAND USE APPLICATION.
ATTACHED ARE THE CONTOURS AND LOCATION OF THE POWTS TO BE INSTALLED. ALL CONTOURS
WILL BE MAINTAINED AFTER THE INSTALLATION OF THE INGROUND TRENCHES. IT IS POSSIBLE THAT
ONE TREE HAS TO BE REMOVED. THE EROSION CONTROL BARRIER WILL BE IN PLACE ON THE
DOWNSLOPE SIDE. THERE WILL BE NO RUNOFF ISSUES.
THIS PROJECT WILL BE STARTED IMMEDIATELY AFTER THE PERMIT IS ISSUED AND WILL TAKE PLACE
IN ONE DAYS TIME.
TIIE AREA DISTURBED WILL BE SEEDED IMMEDIATELY WITH AN APPROVED SEED MIXURE OF RYE AND
