FINDINGS o1' FACT AND CONCLUSIONS OF LAW
Having heard all the testimony. considered the entire record herein, and visited the site, the Board of.Adiustrnent
makes the follo%%ing, Finding= o' Fact anJ Conclusions of Law pertinent to the applicant's Conditional Use
reilucs1s:
1. The applicant and property owner is Jetlrey Lan.
The site is located at 1 138 132nd Ave in pan of Sec. 28, T30N. R 18` . Town of Richmond.
3. 'The site is 2.48 acres and is zoned as Rural Residential District and is surrounded b\
residential and agricultural land uses.
4. The applicant received approval from the St. Croix County Board of Adjusnnent in 2008
for a Conditional Use Permit (lonnerly known as a Special Exception Permit) SE01 ?3, to
operate a Major hone Occupation pursuant to Section 17. 15 ('6)(r) of the St. Croix County
7-cm ring Ordinance, for a woodworking shop.
. The applicant is requesting to amend condition number live of Conditional Use Permit
SL0173 to adjust the operational hours on Nlon lay I'ridays, from 4PM to 711M, to
operation hours on Monday - Friday. from SAM to iPM. The operational hours on
Saturda 's will remain. ?ANI Noon.
6. The applicant is requesting the amendment for a temporary situation.
The request will comply with the general standards listed in Section 1-.155, St. Croix
County Code of Ordinances.
8. The Town of Richmond recommended approval of the application for expanded
conditional use permit with the condition that :he hours of operation will be from 8AA1 -
Monday through Friday. \\uh the ,mderstandino that the existing hours of 4P\1 -
7PM as well as the SaturdaN hours 7AM - 121'M at the existin_: location in the Town would
terminate as of September 30, 2019 - a date by which the business's moye to Somerset
would be completed. The Town Board fell that the hours of 8AM - 3P\f would less likely
to disturb surrounding residential. properties than the existing hours of4PM -'YM, as most
people would likely be at work during the daytime hours.
DECISION
On the basic of the above Findings of Fact, Conclusions of Lae'. and the record herein. the Board approved
the applicant's Conditional Use request, %%ith the following, conditions:

Operational hours on Saturdays shall remain the samc_ ?AM to Loon on Saturday.
All other conditions in the 3008 decision fSF017 31 shall be incorporated as if full stated.
4. 'f he applicant shall maintain the existing vegetative screening.
5. The applicant shall secure all necessary permits and approvals from any other required
local, state or federal agencies.
n Accepting this decision means that the applicant and their agent have read. understand. and
a_rce to all conditions of this decision. and have no objections to County staff conducting
unannounced onsitc inspections to check for compliance with this permit.

assumes no responsibility for action taken in reliance on this decision prior to the expiration of the appeal
period. St. Croix County does not certify that the identity of all persons legally entitled to nonce of the
Board of Adjustment proceedings, which resulted in this decision, was provided to the County.
If an appeal is taken of this decision, it is the responsibiliq of the appellant to submit at hisiher expense a
transcript of the Board of Adiustment proceedings to the circuit court. The Couununity Development
Department can be contacted for information on hat io obtain a transcript. It is the responsibility of the
3oard of Acimunent to suhnin its record (File) of this matter to the circuit court.
