N Lake Elmo, MN S5042 RE: Land Use Permit Conditional Approval: File# LUP-2018-024 Project Location: 1404 Hilltop Ridge, Houlton, WI 54082 Project Address: S22.T30N.R20W; Town of St..Joseph Mark & Kristin Wallace., The Community Development Department staff have reviewed the Land Use Permit application for the construction of a principal structure, utilvutg the existing well and septic, and filling and grading less than 10,000 square feet in the lower St. Croix Riverway District. The request has been conditionally approved based on the application submission and the following findings. • The principal Structure meets the 200' setback to the ordinary high water mark, the 40' bluffline setback. • The height of the principal structure does not exceed the 35' maximum height, nor protrude above the bluffline site line 250' riverward from the ordinary high water mark. • No land disturbance such as filling/grading to occur within the 40 toot blutlline setback. • Storm water management and erosion and sediment control plans are submitted per y 17.36 H.7. • All structures will remain screened and visually inconspicuous from the Riverway. No vegetation is being removed between the principal structure and slope preservation zone. • The existing private onsite wastewater treatment system and well was inspected and approved by a licensed plumber. Based on these findings, approval of the Land Use Permit is subject to the following conditions: 1.A pre-construction inspection is required to verify the Erosion and Sediment control, best management practices have been installed as per site plan, the 40-foot bluffline setback is to be flagged. 2.A tracking pad shall be installed prior to any land disturbance or construction activities. 3.St. Croix County reserves the right to require additional sediment and erosion control measures to be installed if found necessary due to site-specific concerns and will be documented in an as-built site plan. 4.A post-construction inspection is required prior to removing the temporary sediment and erosion control measures and to verify vegetative cover. This inspection will also include inspection of the proposed rain garden and ensuring construction has met the application/site plan. Please call the inspector to schedule an inspection. It is the applicant's responsibility to secure any other required local, state or federal permit(s) and approval(s) prior to land disturbance activity. 6. Failure to comply with the terms or conditions above may result in the revocation of this permit by the Zoning Administrator pursuant to Chapter 17.71. 7.1 he property owner shall execute and record an affidavit describing the approved storm water management plan and maintenance requirements with the County Register of Deeds within 30 days after construction is completed. This approval is subject to the conditions listed above; it does not allow for any additional construction, structures, or buildings beyond the limits of this request. Your information will remain on file at the St. Croix County Community Development Department suite. It is your responsibility to ensure compliance with any other local, state, or federal permitting and regulations, including contacting the. Town of St. Joseph and the iiepdr lnient of Narwal Resources ru inquire if additionai permissions are required. This permit is valid for one year, with the possibility of up to two (2) six-month extensions it the applicant submits the appropriate permit extension fee and documentation to the Zoning Administrator. A copy of the Land Use Permit placard should be submitted to the local Building Inspector for the town upon application for the building permit. The placard must be posted on the job-site and visible from public view.
