HOLDING TANK MANAGEMENT PLAN FOR:
Owner's Name
This Private Onsite Wastewater Treatment System ( POWTS) has been designed, and is to be
installed and maintained according to Comm 83, Wis. Admin. Code, the Holding Tank
Component Manual (SBD- 10855 -P N. 03/07), and the County Sanitary Ordinance.
1. This POWTS is designed to accommodate a wastewater flow of less than �S"Qr;f) gpd.
2. The owner of this POWTS is responsible for system operation and maintenance, manhole
security and all provisions in the Holding Tank Servicing Contract and Maintenance Agreements.
3. Each time the wastewater in the tank reaches 90% of the tank(s) capacity or a level of 12"
below the inlet (at which time the alarm will activate), the pumper listed in the current Service
Contract must be called to empty the tank's contents and dispose of them in accordance with NR
113, Wis. Adm. Code.
4. At each service event, the service provider should visually inspect the condition of the tank,
risers and manhole cover(s) and verify that the alarm system functions and that the manhole is
secure against unauthorized entry. Discrepancies are reported to the owner in a timely manner
for corrective action. All corrective actions shall comply with the county sanitary ordinance and
Comm 83 and 84 Wis. Adm. Code.
5. All service events or inspections of this POWTS shall be reported to the county within 30 days.
6. The owner may not remove any wastewater from the holding tank(s), or cause such wastes to
be removed by any person not authorized to do so under Ch. 281, Wis. Statutes. The discharge
of wastewater to the ground surface, including unintentional discharges and discharges caused
by neglect, constitutes a failing POWTS and may result in issuance of orders for correction or a
citation by the county or state.
7. No one should enter a holding tank for any reason without being in full compliance with OSHA
standards for entering a confined space. The atmosphere within these tanks may contain lethal
gases, and rescue of a person from the interior of the tank may be difficult or impossible.
8. In the event that this POWTS falls and cannot be repaired, a code compliant replacement
holding tank may be installed in the same location (a new sanitary permit is required for such a
replacement). Connection to municipal services would also be considered at this time if they are
deemed available to the property.
9. If this POWTS is replaced, or its use discontinued, components no longer in use it shall be
abandoned in accordance with Comm 83.33 Wis. Adm. Code.

L The owner agrees to file a copy of this contract with the local governmental unit that has signed the
pumping agreement required in Comm 83.52(1)(c)1. Wis. Adm. Code and the approved Holding Tank
Component Manual. This agreement will also be filed with the St. Croix County Zoning Department.
2. The owner agrees to have the holding tank(s) serviced by the pumper and guarantees to permit the pumper
to have access and to enter upon the property for the purpose of servicing the holding tank(s). The owner
agrees to maintain the access road or drive so that the pumper can service the holding tank(s) with the
pumping equipment. The owner further agrees to pay the pumper for all charges incurred in servicing the
holding tank(s) as mutually agreed upon by the owner and pumper.
3. The pumper agrees to submit to the local governmental unit that has signed the pumping agreement and to
the County, a report for the servicing of the holding tank(s) on a semiannual basis. The pumper further
agrees to include the following in the semiannual report:
a. The name and address of the person responsible for servicing the holding tank;
b. The name of the owner of the holding tank;
c. The location of the property on which the holding tank is installed;
d. The sanitary permit number issued for the holding tank;
e. The dates on which the holding tank was serviced;
f. The volume in gallons of the contents pumped from the holding tank for each servicing;
g. The disposal sites to which the contents from the holding tank were delivered.
4. This agreement will remain in effect until the owner or pumper terminates this contract. In the event of a
change in this contract, the owner agrees to file a copy of any changes to this service contract or a copy of a
new service contract with local governmental unit and the County named above within ten (10) business
days from the date of change to this service contract.

Holding tanks are allowed on replacement systems if site conditions (soils and
space limitations) indicate a holding tank is the only available option. However no
physical evidence could be provided indicating the shed /garage has an existing
septic system and no permits or maintenance information are on file with this
department. Therefore the shed /garage cannot be considered for a replacement
holding tank.
Further soil testing may present a suitable site location for a POWTS to service the
shed /garage or connecting to Village Utilities may be another option to expand the
use of the property.

FACILITY DESCRIPTION
Facility Description: The Village of Somerset owns and operates a wastewater treatment plant to treat
domestic, commercial and industrial wastewater. A new treatment system began operation in 2001 and
includes primary treatment with fine screening and grit removal and secondary treatment via a
sequencing batch reactor (SBR). The SBR is a dual basin system that alternates fill and draw modes,
with post equalization regulating discharge to the chlorine disinfection system. Dechlorination is
accomplished via addition of sodium bisulfate, however the permittee will be switching to ultraviolet
disinfection during the permit term. Biological phosphorus removal is incorporated in the SBR design
and has the ability for alum addition as a back -up measure. The limits in this permit are for the design
flow of 0.30 million gallons per day (MGD). The actual annual average flow for 2005 was 0.20 MGD.
Sludge is stored in an aerated storage tank. Sludge is then hauled to the West Central Biosolids
Facility in Ellsworth, WI. Operational changes proposed during this issuance include increasing
sludge storage capacity and replacing chlorination/dechlorination disinfection with ultraviolet radiation
disinfection. Major monitoring changes proposed is the addition of two Acute Toxicity Tests and the
discontinuation of ammonia nitrogen monitorin for the effluent outfall.

Sec. 9 -2 -7. Connection required when possible; permit for private sewage disposal system.
(a) The owner of each parcel of land adjacent to a sewer main on which there exists a building
usable for human habitation or in a block through which such system is extended, shall connect
to such system in the prescribed regulated manner per Title 8, Chapter 1 of this Code of
Ordinances.
(b) Permits. No private septic tank and other private sewage disposal systems may be installed
or replaced in the Village of Somerset without a permit approved by the Village Board. It is the
property owner's obligation that the private septic tank or other private sewage disposal systems
conform to State of Wisconsin Plumbing Code and Department of Natural Resources
regulations.
(c) At such time as a municipal sewer becomes available to a property served by an individual
wastewater treatment system, a direct connection shall be made to the municipal sewer in
compliance with this Section, and any septic tanks, cesspools and similar individual wastewater
disposal facilities shall be abandoned and filled with suitable material at the owner's expense.
(d) No statement contained in this Section shall be constructed so as to interfere with any
additional requirements that may be imposed by the Health Officer or other authorized Village
official.
(e) In lieu of the above, the Somerset Village Board at its option may impose a penalty for the
period that the violation continues, after ten (10) days written notice to any owner failing to
make a connection to the sewer system of an amount equal to one hundred fifty percent (150 %)
sewer charge based on metered water usage and size of water meter or estimated water usage and
estimated meter size. This sewer service a charge will be able quarterly for the period in which

the failure to connect continues. Failure to make such payment said charge shall be assessed as a
special tax lien against the property, pursuant to Wis. Stats. § 144.06.
(f) This Section ordains that the failure to connect to the sewer system is contrary to the
minimum health standards of said Village and fails to assure preservation of public health,
comfort, and safety of said Village.

Sec. 8 -1 -7. Connection to sewer and water system required.
(a) When Required. Whenever a sewer or watermain becomes available to any building used
for human habitation, the owner of the property upon which the building is located shall connect
the building to such main or mains in the manner prescribed by law, except the Village Board
may defer connection to such water or sewer main or mains for those properties which have
existing septic systems or wells whose construction was permitted by the Village of Somerset,
but such deferment shall not exceed five (5) years from the date of installation of such main or
mains.
(b) Notice. Whenever a sewer or watermain becomes available to any building used for human
habitation, the Health Officer shall notify the owner or his/her agent in writing by registered mail
addressed to the last known address of the owner or his/her agent.
(c) Health Officer May Cause Connection at Expense of Owner. If the owner or his/her agent
fails to comply with the notice of the Health Officer or Building Inspector within ten (10) days of
service or mailing thereof, the Health Officer or Building Inspector may cause connection to be
made and the expense thereof shall be assessed as a special tax against the property.
(d) Privies, Cesspools, Etc., Prohibited After Connection With Sewer. After connection of any
building used for human habitation to a sewer main, no privy, cesspool or waterless toilet shall
be used in connection with such human habitation.

As an inducement to the county to issue a sanitary permit for the above - described property, we agree to do the following:
1. Owner agrees to conform to all applicable requirements of Ch. Comm 83, Wis. Adm. Code relating to holding tanks. if the owner fails to have
the holding tank properly serviced in response to orders Issued by the governmental unit or the Department of Commerce to prevent or abate
a human health hazard as described In s. 254.59, Stats., the governmental unit (Town) may enter upon the property and service the tank or
cause to have the tank to be serviced and charge the owner by placing the charges on the tax bill as a special assessment for current
services rendered. The charges will be assessed as prescribed by a. 66.0703, State.
2. The owner agrees, pursuant to s. Comm 83.54 (2), and Comm 82.40(3)(e). Wis. Adm. Code, to have a water meter installed in the structure.
The water meter shall be installed by a plumber authorized by the Department of Commerce to make such Installations, with said installation
complying with State regulations and manufacturers specifications. The owner agrees to be financially responsible for the purchase,
installation, maintenance, and repair of the water meter, and agrees to allow the governmental unit or the Department of Commerce to enter
the above- described property on a regular basis to read and /or inspect the water meter.
3. Owner agrees to pay all charges and costs incurred by the governmental unit or county for inspection, pumping, hauling, or otherwise
servicing and maintaining the holding tank in such a manner as to prevent or abate any human health hazard caused by the holding tank.
The governmental unit shall notify the owner of any costs which shall be paid by the owner within thirty (30) days from the date of notice. In
the event the owner does not pay the costs within thirty (30) days, the owner specifically agrees that all the costs and charges may be placed
on the tax roll as a special assessment for the abatement of a human health hazard, and the tax shall be collected as provided by law.
4. The owner, agrees to contract with a person who is licensed under Ch. NR 113, Wis. Adm. Code, to have the holding tank serviced and to
file a copy of the contract with the governmental unit. The owner further agrees to fib a copy of any changes to the service contract, of a
copy of a new service contract, with the governmental unit within ten (10) business days from the data of change to the service Contract.
5. The owner agrees to contract with a person licensed under Ch. NR 113, Wis. Adm. Code, who shall submit to the county on a semiannual
basis a report detailing the servicing of the holding tank. The governmental unit or county may enter upon the property to investigate the
condition of the holding tank when pumping reports and meter readings may indicate that the holding tank is not being properly maintained.
6. This agreement will remain In effect only until the county office responsible for the regulation of private onsite wastewater treatment systems
certifies that the property Is served by either a municipal sewer or a private onsite wastewater treatment system that complies with Ch. Comm
83. Wis. Adm. Code. In addition, this agreement may be cancelled by executing and recording said certification with reference to this
agreement in such manner which will permit the existence of the certification to be determined by reference to the property.
7. This agreement shalt be binding upon the owner, the heirs of the owner, and assignees of the owner. The owner shall submit this agreement
to the register of deeds, and the agreement shall be recorded by the register of deeds in a manner which will permit the existence of the
agreement to be determined by reference to the property where the holding tank Is Installed.

715- 386 -4674 On September 23 , 2008, 1 inspected the property mentioned above after being
contacted by Adam Shoemaker who stated that he was no longer residing or
Real Property conducting business on the property. All of the business signs referring to the ATV
715- 386 -4677 repair business have been removed from the property. After my inspection, I
concluded this Department no longer has reason to believe that you are in violation

abate this violation. During a phone conversation with you that same day, you
expressed interest in constructing a bathroom in the pole shed. If you have any

We spoke again on October 8` 2008, with regards to the previous uses on the
property mentioned above. After reviewing the types of land uses over the past
eight years, this Department has made the following determinations:
• The house on the property has been used, in part, as a residence
since the property was officially zoned commercial. Because of this, it
is considered a legal nonconforming use and would not require a
special exception to be allowed. Please note that if this use is
discontinued at anytime for 12 consecutive months, it will no longer be
considered a legal nonconforming use and will require a special
exception permit to be allowed. Because of this, a minor home based
business could also be conducted in the residence without a special
exception permit.
• The shed on the property has been used for many activities since the
property was officially zoned commercial. Like the house, these
activities were considered legal al nonconformin .However, there was
a point longer than 12 consecutive months between 2005 and 2007
where the shed was used only as commercial storage. Therefore,
any new use other than commercial storage in the shed will
require a special exception permit.

Hey Ryan,
Just wanted to let you know that Kent Kramer called regarding the unpermitted business on
Highway VV in the Town of Somerset. He is part of the Kramer Limited Family Partnership, which
owns the property. Kent informed me that he leases the property to a party that sub - leases it to
another party that is currently running the business from the site. He has provided notice to his
leasee, who in turn has noticed his sub - leasees, but they have yet to hear from the sub - leasees
on whether or not they plan to shut the business down or apply for an after - the -fact special
exception permit.
I told Kent that if they plan to apply for the permit, then the next deadline for submittals is April 7th
and they should contact me with any questions about the application requirements and process. If
they decide to shut down the business, I informed Kent that he should notify you with an
anticipated timeline for closing ASAP. He said he would follow -up with everyone and get back to
us. He might be calling you with questions.

Dear Mr. Routson,
Please find enclosed your application for a motor vehicle dealer license. I have reviewed
your proposal to locate an automotive dealership on property owned by Kent Kramer at
534 STH 35/64 in the town of Somerset, Saint Croix County, Wisconsin. An automotive
dealership is allowed to operate from the Kramer property provided that the business
complies with the rezoning resolution and the attached memorandum dated September
11, 2000. 1 have included a copy of both documents for your reference.
Please note that any major change and/or additions to the property beyond those
established in the resolution and memorandum will go through the special exception
approval process, where applicable, as stated in the ordinance.
