Dear Renee & Torn Patnode.
Community Development staff have reviewed the application to construct a new single family
residence and an accessory structure ;detached garage) on the property in the Lower St. Croix
Riverway Overlay District. The request has been conditionally approved based on the application
submission and the following findings. Please see the enclosed site plan to reference the general
erosion control and grading notes.
• On February 28, 2019, the applicants received Conditional Use Permit approval to fill and grade within
40 feet of the slope preservation zone and to till and grade 10,000 square feet or more outside of
the slope preservation zone At that time of application, site plans were provided, however a land
Use Permit is still required to construct the residence and subject to Chapter 17.36.
• Lrosron and Sediment Control plans have been submitted that meet Wisconsin Department of
Natural Resources Iechnical Standards. Best Management Practices will be incorporated.
A retaining wall will be installed at the toe of slope preservation zone, approximately 200' long with
a 3' maximum height: there is riot a bluffline setback at the bottom of slope preservation zone.
• Limited vegetation removal is required and approved as a part of this permit. Vegetation located
veithin the slope preservation zone, bluffline setback or OHWM setback will not be. removed.
• 1 he height of the accessory structure is regulated by the base zoning district. The Town of Troy
administers general zoning.
• The new residence will require a State Sanitary Permit to install a Private Onsite Wastewater
Treatment System (POINTS).
Based on these findings, approval of the Land Use Permit is subject to the following conditions:
1. The slope preservation zone and side yard setback shall be flagged prior to site construction. Silt
fence (or other adequate erosion and sediment control) shall be placed along the slope preservation
zone near the building site to protect this zone from any land disturbance and vegetation removal.
2. the grassed infiltration area shall be flagged off to prevent compaction from construction activities.

4. An affidavit shall be required describing the approved stromwater managernenl, erosion and
sedirent control and maintenance requirements within 30 days after construction is completed
pursuant to Chapter 1130 11 7.g.
S. there shall be no grading within 40 feet of the bluffline, otherwise all construction activities vvrould
need to cease and an after the-fact Conditional Use Permit would need to be secured.
6. All structures will be earth tone in color.
7. All temporary erosion control measures shall be left in place and maintained until the site has reached
a point of at least 70% permanent vegetation. Permanent vegetation shall be established once final
grade !s reached or as soon as applicable per plan.
8. A post-construction inspection is required to close out the permit. It is the applicant's responsibility
to schedule this appointment, please contact me at (715) 386-4680 to schedule.
9. It is the applicant's responsibility to secure any other required local, state or federal pen-nit(s) and
approval(s) prior to land dsturbance activity. Including permission from the Town of Troy regarding
temporary occupancy Of the existing structure, if applicable,
10. Failure to comply with the leans or conditions above may result in the revocation of this permit by
the Loning Administrator according to Chapter *17.36.
this approval is subject to the conditions listed above, it does not allow for any additional
construction, structures, or buildings beyond the limits of this request. Your information will remain
on file at the St. Croix County Community Development Department suite. It is your responsibility
to ensure compliance with any other local, state. or federal permitting or regulations, including
contacting the Town of Troy to inquire if additional permissions are required.
This permit is valid for one year, with the possibility of up to two (2) six-month extensions if the
applicant submits the appropriate permit extension fee and documentation to the Toning
Administrator. A copy of the I and Use Permit placard should be. submitted to the local Building
Inspector for the town upon application for the building permit. The orange placard must be posted
on the job-site and visible from public view.
