The submittal described above has been reviewed for conformance with applicable Wisconsin Administrative Codes
and Wisconsin Statutes. The submittal has been CONDITIONALLY APPROVED. The owner, as defined in
chapter 101.01(10), Wisconsin Statutes, is responsible for compliance with all code requirements. } nSAI

The following conditions shall be met during construction or installation and prior to occupancy or use:
General Approval Conditions:
• This system is to be constructed and located in accordance with the enclosed approved plans and with the
design manuals noted above.
• In the event this soil absorption system or any of its component parts malfunctions so as to create a health
hazard, the property owner must follow the contingency plan as described in the approved plans. In addition,
the owner must insure that the operation, maintenance and monitoring duties as described in the "In- Ground
Soil Absorption Manual System" are complied with. A copy of this information must be given to the owner
upon completion of the project.
Key item(s)
• This approval is based on the petition for variance transaction number 1124107 approval. All conditions of that
approval shall be adhered to.
• Comm 83.02. This approval covers only the domestic wastewater directed into the POWTS. The Department
of Natural Resources must be contacted regarding the treatment and disposal of non - domestic wastewater,
including those mixed with domestic wastewater. Please refer to the following website for more information:

• This approval does not include plans for the general plumbing systems or sewer piping leading to the
septic/holding tank that may be required for this project. See section COMM 82.20, Wis. Adm. Code, to
determine if plan submittal and approval is required.

• The designer proposes to install an outlet filter to achieve the requirement of wastewater particle size.
Maintenance information must be given to the owner of the tank explaining that periodic cleaning of the septic
tank outlet filter will be required. The outlet filter shall be installed per product approval stipulations.
• The designer wishes to use a Huffcutt 800 gallon septic tank rather than a 400 gallon septic tank.
• The changes made to this plan by this reviewer were discussed with and approved by the system designer.'
• The gravelless system components must be installed in accordance with the manufacturer's printed instructions,
the plan approval, and COMM 83 system sizing criteria. If there is a conflict between the manufacturer's
instructions and the plan approval, the plan approval and code requirements will take precedence.
Reminder
• Materials shall conform to the requirements of COMM 84.
• The revised soil test on which this approval is based shall be recorded with the original soil test.
• Surface water drainage shall be diverted away from the system area.
• The existing POWTS must be properly abandoned per s. Comm 83.33 Wis. Adm. Code.
• Maintain well and waterline set backs per COMM 83.43(8)(i).
A copy of the approved plans, specifications and this letter shall be on -site during construction and open to
inspection by authorized representatives of the Department, which may include local inspectors. All permits
required by the state or the local municipality shall be obtained prior to commencement of
construction /installation/operation.
In granting this approval the Division of Safety & Buildings reserves the right to require changes or additions
should conditions arise making them necessary for code compliance. As per state stats 101.12(2), nothing in this
review shall relieve the designer of the responsibility for designing a safe building, structure, or component.

FOR: PETITION FOR VARIANCE TO COMM 83.43(8)(i)
Your Petition for Variance of the code section(s) noted above has been reviewed.
Departmental Action: CONDITIONAL APPROVAL
The code section petitioned requires POWTS treatment, holding and dispersal components shall be located as to
provide the minimum horizontal setback distances as outlined in Table 83.43 -1 as safety factors for public health,
waters of the state and structures in the event of component failure. Table 83.43 -1 requires an exterior subsurface
treatment tank to be a minimum of 5' from any building. Table 83.43 -1 requires a POWTS treatment component
consisting in part of in situ soil or to be a minimum of 10' from any building.
The variance requested is to allow the construction of POWTS that will have a 3' setback from the septic tank and
a 6' setback from the distribution cell to the building, and the septic tank will have a 3' setback from the lot line and
the dispersal cell will have a 0' setback from the lot line.
• The intent of the code section petitioned is to provide the minimum horizontal setback distances as outlined in
table 83.43 -I as extra safety factors for public health, waters of the state and structures during construction and
in the event of component failure.
The petitioner submitted a notarized SB -9890 application form including additional page(s) of supporting
documents and/or plans.
Reviewer's Comments:
1. In reviewing the petition, it was noted that the request is similar to other petitions accepted by this department.
2. Based on the precedent established by the previous petitions, this petition for variance is being processed as
permitted by Wisconsin Statute s. 101.02(6)(g), and Comm 3.
3. This approval does not cover any part of the soil absorptions stem or system

All of the petitioner's statements included on the variance application form, any other documents submitted to the
Department, and all conditions of approval, if any, listed below shall be carried out. This variance is specific to the
subject petition and cannot be used for any additional modifications.
Conditions of Approval:
• The slab for the building shall be of reinforced concrete.
• The building sewer shall be installed between the footings.
• There is to be no construction on or damage to the neighboring parcel without the written permission of the
land owner.
This decision will become final unless.the department within 30 days from the date of this letter receives a written

RE: Petition for Variance
To Whom it may concern:
The tested area does not meet the current setbacks found in table 83.43 -1 in Comm
83. Currently, the airplane hanger is built but no slab has been constructed. The septic is
to have a 3' setback from the building and the leaching chambers are to have a 6' setback.
For safety, the proposed slab in the hanger is to have added rebar in order with stand
potential settling around the tank and possible caving in when the tank is being dug, The
tank is to dug as shallow as the code allows, and the tank is as shallow as the code allows
and the shallowest septic available (40" inlet). Also, the building sewer is to be installed
between the footings, in order to prevent caving in of soil.
The septic tank and leaching chambers will not make the setback for a property line.
The cell is to have a 0' setback from the lot line and the septic tank is to have a 3' setback
from the lot line. This problem is satisfied because the parcel is being leased by Allison
Gowan and the City of New Richmond owns both parcels. Thus, lot line issues can be
avoided due to 1 owner.

HANGAR AREA LEASE
THIS AGREEMENT, made and entered into on the date indicated below by and
between the <'.ity of New Richmond, State of Wisconsin, a municipal corporation,
hereinafter called the Lessor, and Alison Gowan, hereinafter called the Lessee.
WITNESSETH:
WHEREAS, the Lessor owns and, aerates an airport known as the New
Richmond Municipal Airport and said Lessee is desirous of leasing from the Lessor a
certain parcel of land on the said airport, hereinafter more fully described, for the purpose
of: aircraft storage
WHEI.ZEAS, the Lessee will use the below described property for the purpose of
storing aircraft and shall conduct only such aircraft maintenance on its own aircraft as
performed by the Lessee or by regular employees of the Lessee.
NOW, THEREFORE, for and in consideration of the rental charges, covenants,
and agreements herein contained, the Lessee does hereby hire, take and lease from the
Lessor and the Lessor does hereby grant, demise, and lease unto the Lessee the following
premised, rights, and easements on and to the airport upon the following terms and
conditions:
1. I'rc Description Lot 5, Row 16 of the Airport Layout Plan - New
r:c:hmond Municipal Airport. Leased Property equals 6,400 square feet
2. Ha ngar Construction The Lessee shall have the right to erect, maintain and
alter building:; or structures upon said premises providing such buildings or structures
conform to the applicable requirements of the Wisconsin Department of Industry, Labor
& Human Relations and pertinent provisions of any local ordinances in effect. All plans
for such buildings or structures shall be reviewed and approved in writing by the Lessor
prior to construction.
3. Terms The term of this lease shall be for a maximum of ten (10) years
commencing on July 1, 2000 and ending on June 30, 2010.

4. Rent: The Lessee agrees to pay to the Lessor for the use of the premises,
rights, and easements herein described, a yearly rental of ten (10) cents per square foot for
the land leased, for a total annual charge of $640.00, payable on July 1 annually. It is
understood and agreed that the rental rate herein specified shall be subject to re-
examination and readjustment at the end of each three year period of this lease, provided
that any readjustment of said present rates, or as same may be amended hereafter, shall be
reasonable.
5. No - Exclusive Use The Lessee shall have the right to the non - exclusive use,
in common with others, of the airport parking areas, appurtenances and improvements
thereon; the right to install, operate, maintain and store, subject to the approval of the
Lessor in the ,nterests of safety and convenience of all concerned, all equipment
necessary for the safe hangaring of the Lessee's aircraft, the right of ingress to and egress
from the demised premises, which right shall extend to the Lessee's employees, guests,
and patrons; the right, in common with others authorized to do so, to use common areas
of the airport, including runways, taxiways, aprons, roadways, and other conveniences for
the take -off, flying and landing of aircraft.
6. La and Regulations The Lessee agrees to observe and obey during the term
of this lease all laws, ordinances, rules and regulations promulgated and enforced by the
Lessor, and by other proper authority having jurisdiction over the conduct of operations at
the airport.
7. fIol Harmless The Lessee agrees to hold the Lessor free and harmless from
loss from each and every claim and demand of whatever nature made upon the behalf of
or by any person or persons for any wrongful act or omission on the part of the Lessee,
his agents or employees, and from all loss or damages by reason of such acts or
omissions.
8. Ins urance : The Lessee agrees that he will deposit with the Lessor a policy of
comprehensive liability insurance upon 90 days written notice from the Lessor.
9. Mai ntenance of Premises The Lessee shall maintain the structures occupied
by him and the surrounding land premises in good order and make repairs as necessary.
No outside storage shall be permitted except with the written approval of the Airport
Commission. In the event of fire or any other casualty to structures owned by the Lessee,
the Lessee shall either repair or replace the leased area to its original condition; such
action must be accomplished within 120 days of the date the damage occurred. Upon
petition by the Lessee, the Lessor may grant an extension of time if it appears such
extension is warranted.
10. Ri to Inspect The Lessor reserves the right to enter upon the premises at
any reasonable: time for the purpose of making any inspection it may deem expedient to
the proper enforcement of any of the cover ^!its or conditions of this agreement.

11. Taxes: The Lessee shall pay all taxes or assessments that may be levied
against the personal property of the Lessee or the buildings which he may
erect on lands leased exclusively to him.
12. Si s : The Lessee agrees that no signs or advertising matter be erected
without the consent of the Lessor.
13. De fault : The Lessee shall be deemed in default upon:
a. Failure to pay rent within 30 days after due date;
b. The filing of a petition under Federal Bankruptcy Act or any mendment
thereto including a petition for reorganization or an arrangement;
c. The commencement of a proceeding for dissolution or for the
appointment of a receiver;
d. The making of an assignment for the benefit of creditors without the
prior written consent of the Lessor;
e. Violation of any restrictions in this lease, or failure to keep any of its
covenants after written notice to cease such violation and failure to
correct such violation within thirty days.
Default by the Lessee shall authorize the Lessor, at its option and without legal
proceedings, to declare this lease void, cancel the same, and re -enter and take possession
of the premises.
14. Title: Title to the buildings erected by the Lessee shall remain with the
Lessee and shall be transferable. Upon termination of this lease, the Lessee may, at the
option of the Lessor, remove the buildings, all equipment and property therein and restore
the leased property to its original condition.
. 15. Sn Removal The Lessor agrees to provide NO snow removal services to
the Lessee's leased premises in the hangar area.
16. Le Transfer The Lessee may not, at any time during the time of this lease,
assign, hypothecate or transfer this agreement or any interest therein, without the consent
of the Lessor.

17. Ai rport Development The Lessor reserves the right to further develop or
improve the landing area of the airport as it sees fit, regardless of the desires or view of
the Lessee, and without interference or hindrance. If the development of the airport
requires the relocation of the Lessee, the Lessor agrees to provide a compatible location
and agrees to relocate all buildings or provide similar facilities for the Lessee at no cost to
the Lessee.
18. Su bordination Clause This lease shall be subordinate to the provisions of
any existing or future agreement between tha Lessor and the United States or the State of
Wisconsin relative to the operation or maintenance of the airport, the execution of which
has been or may be required as a condition precedent to the expenditure of federal or
stated funds for the development of the airport. Furthermore, this lease may be amended
to include provisions required by these agreements with the United States or the Stated of
Wisconsin.
19. ,Ar bitration : Any controversy or claim arising out of or relating to this lease
or any alleged breach thereof, which cannot be settled between the parties, shall be settled
by arbitration in accordance with the rules of the American Arbitration Association, and
judgment upon the dispute rendered by the arbitrator(s) shall be final and binding on the
parties.
20. Flo Height The Lessee agrees to erect a building on the leased remises

the taxilane nearest the front of the building.
21. Ta xiway Access The Lessee is prohibited from operating automobiles on
runways or main taxiways.
22. Parking: Automobile parking must be on the leased premises or on
