Comm 83.54(1). • Comm 83.52(2) A POWTS that is not maintained in accordance with the approved management plan or as required under s. Comm 83.54(4) shall be considered a human health hazard. • Comm 83.55 The owner is responsible for submitting a maintenance verification report acceptable to the county for maintenance tracking purposes. Reports shall be submitted at intervals appropriate for the component(s) utilized in the POWTS. All permits required by the state or the local municipality shall be obtained prior to commencement of construction /installation/operation. In granting this approval the Division of Safety & Buildings reserves the right to require changes or additions should conditions arise making them necessary for code compliance. As per state stats 101.12(2), nothing in this review shall relieve the designer of the responsibility for designing a safe building, structure, or component. Adm. Code General The conventional septic system shall be operated in accordance with Comm 82 -84 Wis. Adm. Code, and shall be maintained in accordance with component manual SBD- 10705 -P (N.01/01). All local and/or state rules pertaining to system maintenance and maintenance reporting shall be complied with. Septic Tank Septic tank servicing mechanics comply with Comm. 83.54(l)(e). Septic tank to be located within 150' of service pad, with bottom of tank to be <_ 15' below service pad elevation. The operating condition of the septic tank and outlet filter shall be assessed at least once every two years by inspection. The contents of the septic tank shall be disposed of in accordance with NR 113. Wis. Adm. Code, by an individual certified to service septic tanks under s. 281.48, Slats. If the contents of the tank are not removed at the time of a biannual assessment, maintenance personnel shall advise the owner of when service will be needed to maintain less than 1/3 scum and sludge accumulation in the tank. The outlet filter shall be cleaned as necessary to ensure proper operation. The filter cartridge should not be removed unless provisions are made to retain solids in the tank that may slough off the filter when removed from its enclosure. If the filter is equipped with an alarm, the filter shall be serviced if the alarm is activated. Septic tank manholes risers, access risers, and covers should be inspected for water tightness and soundness. Access openings used for service and assessment shall be sealed watertight upon the completion of service. Any opening deemed unsound, defective, or subject to failure must be replaced. Exposed access openings greater than 8 inches in diameter shall be secured by an effective locking device to prevent accidental or unauthorized entry into the tank. No individual should ever enter the septic tank as dangerous gases may be present that could cause death. Septic tank abandonment shall be in accordance with Comm83.33, Wis. Adm. Code when the tank is no longer used as a POWTS component. The addition of biological or chemical additives to enhance septic tank performance is generally not required. if such products are used they shall be approved for septic tank use by the Department of Commerce, Safety and Buildings Division. Soil Absorption Cell Trees or shrubs should not be planted directly on the soil absorption system. The area above and around the system should be seeded and mulched as necessary to prevent erosion and provide some degree of frost protection. Traffic (other than for vegetative maintenance) over the system is to be avoided. Soil compaction may hinder aeration of the infiltrative surface within and above the system and will promote frost penetration during cold weather months. Cold weather installations (October - February) dictate that the system be heavily mulched for frost protection. Influent quality into the system may not exceed 220mg/L BOD5, 150 MG/L TSS, and 30 mg/L FOG. Influent flow may not exceed maximum design flow specified in the permit for the installation. Observation pipes within the dispersal cell shall be checked for effluent ponding. Ponding levels shall be reported to the owner. Levels above 4 inches indicate an impending hydraulic failure requiring additional, more frequent monitoring. Effluent flow shall be alternated between dispersal cells on a two -year schedule by use of a diversion valve. Valve to be switched diverting effluent from dispersal cell currently in use to resting cell on a two -year cycle coinciding with septic tank inspection and maintenance. Contingency Plan If the septic tank or any of its components become defective the tank or component shall be repaired or replaced to keep the system in proper operating condition. Excessive ponding within the dispersal cell will be eliminated by installing a new soil absorption cell to bring the system into proper operating condition. RATIONAL FOR APPROVAL: 1. The existing hanger is of post and beam construction with posts set on footings at an approx. elevation of 96.10'. The proposed system will be installed at an elevation of 96.40', or approximately 51.6" below grade. System elevation is slightly above the footing elevation, preventing disturbance of or otherwise affect building footings. 2. Soil loading rate at system elevation and 48.4" below system elevation = 0.7/1.2 gpd/sq. ft., indicating that effluent flow will be vertical and not horizontal, preventing seepage into or under the structure. 3. POWTS dispersal cell will be constructed two chamber lengths at a time. Trenches will be backfilled as chambers are set, preventing collapse of trench sidewalls and eliminating possibility of undermining structure. Floor within building will be 4" reinforced concrete, which will withstand undermining should any occur. 4. If the owner chooses to sell the "other lot" at some future point it will be in their best interest to obtain an easement to allow the POWTS to remain or make arrangements to remove the POWTS but that is not something we need to address during the plan review and permitting process for the initial POWTS Installation. At least one county requires that an easement document between the owner and themselves be prepared and recorded when the lots are owned the same owner. Non - Exclusive Use The Lessee shall have the night to the non - exclusive use, in common with others, of the airport parking areas, appurtenances and improvements thereon; the right to install, operate, maintain and store, subject to the approval of the Lessor in the interests of safety and convenience of all concerned,, all equipment necessary for the safe hangaring of the Lessee's aircraft, the Tight of ingress to and egress from the demised premises, which right shall extend to the Lessee's employees, guests, and patrons; the right, in common with others authorized to do so, to use common areas of the airport, including :runways, taxiways, aprons, roadways, and other conveniences for the take -off, flying and landing of aircraft. 6. Laws and ReMdations The Lessee agrees to observe and obey during the term of this lease all laws, ordinances, rules and regulations promulgated and enforced by the Lessor, and by other proper authority having jurisdiction over the conduct of operations at the airport. 7. Hold Harmless The Lessee agrees to hold the Lessor free and harmless from loss from each and every claim and demand of whatever nature made upon the behalf of or by any person or persons for any wrongful act or omission on the part of the Lessee, his agents or employees, and from all loss or damages by reason of such acts or omissions. S. Insurance The Lessee agrees that he will deposit with the Lessor a policy of comprehensive liability insurance upon 90 days written notice from the Lessor. 9. Maintenance of Premises: The Lessee shall maintain the structures occupied by him and the surroanding land premises in good order and make repairs as necessary. No outside storage shall be permitted except with the written approval of the Airport Commission. In the event of fire or any other casualty to structures owned by the Lessee, the Lessee shall either repair or replace the leased area to its original condition; such action must be accomplished within 120 days of the date the damage occurred. Upon petition by the Lessee, the Lessor may grant an extension of time if it appears such extension is warranted. 10. Right to Inspect The Lessor reserves the right to enter upon the premises at any reasonable time for the purpose of making any inspection it may deem expedient to the proper enforcement of any of the covenants or conditions of this agreement. 2 12/19/2005 14:47 FAX 715 246 6965 NEW RICHMOND INSURANCE 10004 11. Taxes The Lessee shall pay all takes or assessments that may be levied against the personal property of the Lessee or the buildings which he may erect on lands leased exclusively to him. 12. Suns The Lessee agrees that no signs or advertising matter be erected without the consent of the Lessor. 13. lie ault The Lessee shall be deemed in default upon= a. Failure to pay rent within 30 days after due date; b. The filing of a petition under Federal Bankruptcy Act or any mendment thereto including a petition for reorganization or an arrangement; c. The commencement of a proceeding for dissolution or for the appointment of a receiver; d. The making of an assignment for the benefit of creditors without the prior written consent of the Lessor, e_ Violation of any restrictions in this lease, or failure to keep any of its covenants after written notice to cease such violation and failure to correct such violation within thirty days. Default by the Lessee shall authorize the Lessor, at its option and without legal proceedings, to declare this lease void, cancel the same, and re -enter and take possession, of the P remises. 14. Title Title to the buildings erected by the Lessee shall remain with the Lessee &Dd shall be transferable. Upon termination of this lease, the Lessee may, at the option of the Lessor, remove the buildings, all equipment and property therein and restore the leased P ro erty to its original condition. P 15. Snow Removal The Lessor agrees to provide NO snow removal services to the Lessee's leased premises in the hangar area. 16. Lease Transfer The Lessee may not, at any time during the time of this lease, assign, hypothecate or transfer this agreement or any interest therein, without the consent of the Lessor. Airport Development The Lessor reserves the right to further develop or improve the landing area of the airport as it sees fit, regardless of the desires or view of the Lessee, and without interference or hindrance. If the development of the airport requires the relocation of the Lessee, the Lessor agrees to provide a compatible location and agrees to relocate all buildings or provide similar facilities for the Lessee at no cost to the Lessee. 18. Subordination Clause This lease shall be subordinate to the provisions of any existing or future agreement between the Lessor and the United States or the State of Wisconsin relative to the operation or maintenance of the airport, the execution of which has been or may be required as a condition precedent to the expenditure of federal or stated funds for the development of the airport. Furthermore, this lease may be amended to include provisions required by these agreements with the United States or the Stated of Wisconsin. e 19. Arbitration Any controversy or claim arising o ut of or relating to this lease or any alleged breach thereof, which cannot be settled between the par. ties, shall be settled by arbitration in accordance with the rules of the American Arbitration Association, and j judgment upon the dispute rendered by the arbitrator(s) shall be final and binding on the parties. 20. The required 20' separation between hangers within the airport prevents the POWTS dispersal cell from comply with the 10' setback from a structure as required by Comm. 83.43(8)(1). Accordingly, we propose to install the dispersal cell 5.0' from the hanger that the POWTS will serve, leaving a 6' separation from the future hanger. The replacement system is to be installed 1.0' below proposed system elevation if & when necessary. CODE SECTION PETITIONED: Comm. 83.43(8)(i), Table 83.43 -1, Horizontal setback requirements. POWTS treatment component to building to be >t 10'. The intent of the code requirement is to prevent structural damage to the building during system construction, to prevent damage to the structure in the event of a future collapse or failure, and to prevent system effluent discharge from flowing under or into the structure. RATIONAL FOR APPROVAL: I. The existing hanger is of post and beam construction with posts set on footings at an approx. elevation of 96.10'. The proposed system will be installed at an elevation of 96.40', or approximately 51.6" below grade. System elevation is slightly above the footing elevation, preventing disturbance of or otherwise affect building footings. 2. Soil loading rate at system elevation and 48.4" below system elevation = 0.7/1.2 gpd/sq. ft., indicating that effluent flow will be vertical and not horizontal, preventing seepage into or under the structure. 3. POWTS dispersal cell will be constructed two chamber lengths at a time. Trenches will be backfilled as chambers are set, preventing collapse of trench sidewalls and eliminating possibility of undermining structure. Floor within building will be 4" reinforced concrete, which will withstand undermining should any occur. 4.
