Community Development staff have reviewed the application to construct a new principle structure ;single-family residen(e) lo(ated within in the Shoreland Overlay District f he request has been conditionally approved based on the application submission and the following findings. Please see the enclosed site plan to reference the general erosion control and Grading notes. • A complete application was submitted on April 15, 7019. • 1I'c required setback has been reduced from 75-feet from the Ordinary High Water Mark (OI IWM) to the average shoreland setback us rig the nearest principal structure on each acfiacenl lot per Section 1230 o The adjacent lots are developed within 250-fact of the proposed structure and do not meet the required building setback. Stall. 59.692(lf;(b). • Repiacemenl of a portion of the walkway is required due to construction adivilies. A walkway may be permitted within the 15 foot setback, provided the width does not exceed 60 inches per NM l1 .0S(1)(b)1rn.F • t:)!) square feet of sidewalk is proposed within the 75-loot setback, although is not required in order to provide pedestrian access to the shoreline. Best Management Practices will be incorporated. Based on these findings, approval of the I and Use Permit is subject to the following conditions: 1. A State Sanitary and Budding Permit are required prior to construction. J. The 35 foot setback from the OHWM and RFF: 890.0' shall be flagged prior to site construction. Silt fence (or other adequate erosion and sediment control) shall be installed per the site plan to protect the shoreline from any land disturbance and unnecessary vegetation removal The structure shall be placed no closer than 36-feat from the OI ]WM. 3. 1 he sunnnwater infiltration area and mound syslern shall he flagged off to prevent compaction front construction activities. 4. Stat. to allow 100 square feet of an open-sided/screen structure within the required 75-foot setback. 6. All temporary erosion control measures shall be left in place and maintained until the site has reached a point of at least 10% permanent vegetation. Permanent vegetation shall be established once final grade is eached or as soon as applicable per plan. A post-construction inspection is required to close out the permit. Puge 2 of 2 01/22/19 Project Description, Van Dyk Cabin: This project consists of the removal and replacement of the existing cabin with a new cabin, along with replacement of well and POINTS systems on the property. The existing structure is non conforming. The new structure will bring the parcel into greater compliance with tuning regulations by moving farther from Cuss lake and accounting for slorrnwater on the site. The site will have a new private well and POW IS system. i J
