April 26' 2019 FINDINGS OF FACT AND CONCLUSIONS OF LAW I iav nc; hoard ai tnu testimony, conside ed the entire -et zxc ~re,eln anc vi- ,;-.Pd the site the 6aa"d of Adjustmcnt makes fie following Findings of fa:t and Conclusions o` Law pertinent to the applicant's Conditional Use reques-s 1. the applicant Tammec LIC.. submitted an apDiicalior requesting Conditional Use Permit Renewal for a nonmetallic raining site, subject to the provisions of Chapter 14 Nonmetallic Mining; Pursuant to Section 17.15 (6)(g). the appiicant has Nonmetallic Mining Reclarnation Permit anc meets the criteria and standards set forth in Chanter 14. 1'he Rural Residential DVstrict allows a Nonmetallic mine site provided a Conditional Use Permit is obtained. The applicants request noes not violate the spirit or general intent of the St. Croix County Zoning Ordinance, Section 17.15 (6)(g). The WPDFS General Perrnit issued by the DNR assesses the site's storm water discharge, any potent.al impacts to groundwater and surface water. The boundary of the mine site has a 100- foot setback with a 25-foot high vegetated berm. A turning lane was added to the existing driveway access to help improve safety along C1H G. "No trespassing' signs are posted along CTH G. The site is subject to lAine Safety and Health Administration (MSHA) Standards and Regulations regardi x: the operations o` the nonmetallic mining site. The'efore, the use is not contrary to the public health, safety or general welfare. Tne pit has existed since the '950 s and provides constriction rnaterials for local development. The view from neignboring properties is screened. The applicants' reuuest is not substantially adverse to property values in the neighborhood affected. S. Dust control measures are in place and rnonitored by Tammec LLC., the operations are shielded from public view by a 25-foot high vegetated berm which also acts as a noise barrier. The site has a WisDNR WPDES perrnit. The site does not constitute a naisance by reason of noise, dust, smoke. odor or other sir-war factors. 6. Conclusions of Law anc tine record herein, the Board approved the applicant's Conditional Use requests, with the following Condition: The applicant steal! maintain conformance to the Chapter 14 standards for nonmetallic mining reclamation. 2. The aopiicant shall be responsible for adhering to at local: state. and federal rules, regulations and permits during the Ffe of the operation. 3. The •nining operation shall not extend into groundwater. 4. The 100 foot buffer and 25-foot high berm around the actively ruined area shall be maintained. 5. The applicar- shat maintain the hours of operation from 6:00 AM to 10:00 PM Monday-Friday and 6:00 AM to 8 PM on Saturday. In the event that the mailer cannot be resolved administratively, the matter shall be taken before the Board of Adjustment at a public hearing. Upon any change in ownership or operation of the mine, the applicant shall submit to the Loring Administrator the name and contact information, of the owner and primary mine o~e'ator. The operator shall comply with all of the general requirements and conditions listed it the nonmetallic mining and reclamation standards in Chapter 14 - Nonmetallic Mining :hdinance. 10. Any change or addition to the project. including but not limitec to design of the project, may require review and app,oval by the Board o' Adjustment. This must be submitted as a permit arrtcndment with all applicable fees. 11.
