CROIX COUNTY GOVERNMENT CENTER, HUDSON WI March 10, 2009 Present: Committee: Supervisors Lorin Sather, Sharon Norton - Bauman, Steve Hermsen, Peter Post, Gene Ruetz Staff: Dave Fodroczi, Kevin Grabau, Ellen Denzer, Alex Blackburn, Monica Lucht, Jennifer Havens, Chuck Whiting, Judy Olson Guests: Jerry Ripley, Debbie Calleja, Steve Kopp Call to Order: Chair Ruetz called the meeting to order at 8:30 a.m. Adoption of Agenda: Motion by Hermsen, 2nd by Norton -Bauman to adopt the agenda. Motion carried. Approval of Previous Minutes: Motion by Norton- Bauman, 2 nd by Sather to approve the minutes of February 10, 2009. Motion carried. Date of Next Meeting: April 14, 2009, 8:30 a.m. Old and New Business: Public Hearing WAIVER FROM LAND DIVISION REGULATIONS APPLICANT: Bernard, Shirley and Steve Kopp LOCATION: NW 1 /4 of NW '/4, SEC 23 T30N RI 8W, Town of Richmond ADDRESS: 1477 State Highway 65, New Richmond REQUEST: Waiver to the contiguous land area requirement of 1.5 acres in the Commercial zoning district and the requirement for a landscaping buffer pursuant to section 13.7 J. 5.a. and 13.7 H. L -6. of the St. Croix County Land Division Ordinance. Chair Ruetz opened the public hearing. Blackburn reviewed the staff report. He compared the current CSM with DOT future road corridor and the proposed CSM. He noted that the landscape buffer is required on new commercial property that borders property zoned other than commercial. He stated that the Town approved the CSM with conditions. Jerry Ripley spoke in favor of the request. He reviewed the background of the lots. The property is in the extraterritorial jurisdiction of the City of New Richmond. Creating lots 8 and 9 is required to satisfy the City. The City will extend public sewer to this site in the future. He showed the access easement across lot 9 for lot 8. The City approved the CSM. Ripley explained how the request meets the five conditions of Section 13.10A1a. There is a 150 foot setback line from Highway 65. This parcel is unique. Debbie Calleja spoke in opposition of the request. She owns property that borders the Kopp She spent 300 000 on extra land landscaping, — l0 5 of the current CSM. S e e on the north t $ p property p etc. including $15,000 for roadway. She asked the Committee to be consistent with requirements. Ripley noted the differences between the Calleja project and this one. The Calleja project was done under the old ordinances, and requirements were conditions required by the Board of Adjustment as part of a special exception permit. With no additional comments, Chair Ruetz closed the public hearing. Motion by Sather to recommend approval of the waiver to the lot size and the waiver of landscaping requirements since landscaping at this time would be wasteful. There are conflicting requirements by the City and County. Motion 2nd by Post. Norton -Bauman stated concern regarding money for the future intersection. Grabau stated that the land division ordinance requires the perimeter landscape screening, and that any other landscaping requirements would be determined with the special exception permit based on the proposed use and improvements. It is necessary to find something unique with this property to grant a waiver to the ordinance. Norton- Bauman recommended holding off until the Committee has had opportunity to view the property. Grabau noted that perimeter landscaping is required on all new commercial lots that border property zoned other than commercial. Sather withdrew his motion and Post withdrew his 2 to the motion. Motion by Sather to grant a waiver of lot size of lots 8 and 9 and not require 1 -1/2 acres buildable area based on findings included in the staff report. Motion 2nd by Post and carried unanimously. Motion by Sather to grant the waiver of the landscaping requirements based on the following findings: The DOT will construct a corridor to connect Highway 65 and 131 Street on the property in the future. The applicants are not doing any lot preparation or development at this time. The hardship was not self created. Landscaping would apply to future development as required by the Board of Adjustment. Motion 2nd by Post and carried unanimously. Land Use Ordinance Applications Municipal Plats - none Waivers and rezones to be scheduled — Three rezoning applications were received this month. The Committee agreed to schedule the public hearing on April 22 at 7 p.m. in Hudson. Discussion of Plats and GSM's currently in the review process - Blackburn reviewed the list of the February submittals as well as corresponding Technical Review Committee letters. Six applications were received this month. Planning and Zoning Business Comprehensive Plan Public Opinion Survey Report — Dr. David Trechter & Jim Janke, Survey Research Center UWRF Denzer introduced Dr. Trechter and Mr. Janke. Trechter gave a summary of the report. He stated that the survey surely provided some perspective. He has done many of these surveys around the State for many different jurisdictions. He noted how these results compare with others. The Survey Center tries to serve the public and do it as cost effectively as possible. The response rate was very good with 500 responses. More men responded than women. There was lower response from younger residents. There were also differences in the responses from the east and west parts of the County. They tried to get many dynamics. When asked how do you rate life in St. Croix County, 90% responded good or excellent. This was very high. Normally the percentage is high 70s or low 80s. That rating seems to be driven by three factors: physical qualities - people come because of beautiful vistas; social - drawn by friends and families; and economic factors — many assets that make it a good place to live. People are interested in the things that drew them here. When asked if they are interested in regulations to maintain qualities here, the answer was "yes." More people here support purchase of development rights than support that in other areas. People here are interested in preserving agricultural land. Another aspect that came through was the nervousness about the future and the economy. There is concern about population growth with more concern in the eastern part of County. There is 2 also concern about traffic congestion, affordability and the level of property taxes. Being on the edge of the metro area, we see concern about the future of our quality of life. Trechter stated there are differences between responses from women and responses from men about planning and the need for education. We are trying to represent a very diverse population. Norton - Bauman noted that few renters responded to the survey. Trechter stated that this list included renters, but typically renters are a difficult group to get responses from. They move frequently. A lot more of those mailings are undeliverable. Renters don't have the same economic stake in the outcome as others. Property owners have more of a vested interest in planning. Trechter also stated that, as typical, more responses are received from the older than from younger population. Hermsen stated that he thought the survey was biased. Some questions should not have been asked. They did not have any bearing on government activity. Economic development is private sector, as is housing. He expected to see more questions in the survey related to public sector. Trechter stated that housing and economic development are elements in comprehensive planning that are required by State statute. Part of the pubic participation process is to get public opinion about those items. The questions in the survey are as neutral as possible. The survey went through this Committee before it was sent out. So any biases would have been caught then. This Committee has an impact on the types of housing that will be built and can encourage sensible economic development. It has a role in creating a climate that results in the type of housing and economic development that makes the high quality of life that people in this area appreciate. Jim Janke stated that in the State comprehensive planning statutes housing and economic development are required elements to be addressed as well as public participation. It makes sense to ask questions about housing and economic development as it pertains to the comprehensive plan. Trechter stated that people may not attend public meetings, but more often, will respond to surveys such as this. The Committee recessed from 10:10 to 10:20 a.m. Bills and Revenue Reports - The February 2009 Planning and Zoning Bills and Revenue Reports were reviewed by the Committee and signed by Chair Ruetz. Fodroczi explained the land records bills, and survey services. Motion by Post, 2 nd by Norton - Bauman to approve. Motion carried. 2009 -2011 Wisconsin State Budget - Fodroczi reviewed the two areas of the State budget proposed by Governor Doyle that affect this Committee and Department. Governor Doyle is proposing to eliminate funding for the clean sweep program. The 2009 -2011 budget will not be finalized until June. Fodroczi explained the Northwest Cleansweep Program. The Northwest Regional Planning Commission has provided excellent service for many years. The grants are competitive each year. We have been successful in getting grants for the last five or six years. Collections were held even in years when we did not receive grants. Grants of $30,000 a year have been awarded to support the $50,000 budget. The grant covers disposal costs. Committee discussed charging a user fee, but if it would be high enough to cover costs it would be a disincentive for people to properly dispose of hazardous waste. There will be hearings on the 3 State budget this month in Eau Claire. Fodroczi asked for Committee support in having this funding restored. Sather asked about costs of the clean sweep collection. Post said we may have to postpone the first event. Sather stated concern that if the collection was not held, hazardous materials would be dumped in ditches or in landfills. Fodroczi stated that there may be a reasonable chance that some of this funding could be restored in the state budget with several counties asking. We won't know until June. Chuck Whiting stated there may be a possibility of using County contingency funds for this. It could come at the expense of something else. Sather suggested this Committee ask finance for the money and it could agree to ask County Board for use of contingency funds. Motion by Norton -Bauman to take a recommendation to County Board telling them we wish to do this program in May and ask for their support for funding for the clean sweep program funding from the State for this project. Motion 2nd by Post and carried unanimously. Fodroczi reviewed and explained the Wisconsin Working Lands Initiative. With this we would be obligated to update our farmland preservation plan by 2010 and the ordinance by 2012. It would be best to integrate this with the comprehensive planning. These changes need Committee support. Between now and budget hearing Committee comments should be submitted. He stated that this is a restructuring of the program. We can look at the details and make comments to the legislature on details of the budget. Fodroczi will develop a statement for the Committee to submit. Post recommended that the use value assessment process be changed Fodroczi wants to get some comments on this regarding the planning and zoning requirements. Ruetz will work with Fodroczi and Bob Heise on comments to submit to the State for the budgetary process. Recycling Ordinance Review - Fodroczi reported that Greg Timmerman has done some research on this and staff will be discussing the broader scope of the ordinance with him soon. Comprehensive Plan Update - Denzer reported that she does not have results of the Visioning Workshops from Anna Haines yet, but it should be received soon. She noted that the workshops were very positive and very productive. There was good turnout each night and most people felt like they had accomplished a lot. She will post the results and send out to participants at the workshop and Committee members who were not there. She stated that Town of Star Prairie will be holding its last open house on Tuesday, March 24 at the town hall. They are nearing the end of their project. A public hearing will be scheduled after the open house. She invited Committee members to attend both events. Code Administration Report — Grabau reported on the Sukowatey case. The judge visited the sight the previous week but made no comments regarding what items should go and what would stay. He looked at all the items and will hold a discussion about that at a later date. Grabau hopes he will then make a ruling on the items. Grabau noted that Mr. Sukowatey's interpretation of the definition of junk is different than the staff's interpretation. Grabau stated that he is completing the report on the Bettendorf case for Don Gillen. Floodplain Ordinance Amendments - Grabau provided copies of the final draft document prior to the meeting. 4 Reconvene Public Hearing - Motion by Post to reconvene the public hearing. Motion seconded by Sather and carried. Because Chair Ruetz was not present at the hearing on February 25, Vice Chair Norton -Bauman opened the public hearing. Norton- Bauman asked if anyone wished to speak in favor of the amendments. No one asked to speak. She asked if anyone wished to speak in opposition. With no one wishing to speak in favor or in opposition and no written communication had been received, Post moved to close the public hearing. Motion 2nd by Hermsen and carried. Action on Floodplain Ordinance Amendments - Motion by Sather to approve the ordinance amendments and send to County Board for adoption. Motion 2nd by Post and carried.
