Public Hearing
1) Proposed Amendments to Subchapter IV, Section 17.40, Floodplain Overlay District
Ordinance:
Comments and questions from the public will be heard and addressed. The proposed
amendments to the County's Floodplain Overlay District Ordinance, Section 17.40,
are required to maintain compliance with recent changes to Chapter NR 116,
Wisconsin Administrative Code, and corresponding Model Floodplain Ordinance, by
the Wisconsin Department of Natural Resources. The proposed amendments to
Section 17.40 will also adopt the new Flood Insurance Study (FIS) and Flood
Insurance Rate Map (FIRM) that have been completed by the Department of
Homeland Security's Federal Emergency Management Agency (FEMA). The
amendments to Section 17.40 are required to maintain participation in the National
Flood Insurance Program (NFIP).

Call to Order: Vice Chair Norton -Bauman called the meeting to order at 7:00 p.m.
Adoption of Agenda: Motion by Post, 2 nd by Sather to approve the agenda. Motion
carried.

OLD AND NEW BUSINESS
Public Hearing: Vice Chair Norton- Bauman opened the public hearing at 7:03 p.m.
Fodroczi read the public hearing notice for the record.

Fodroczi stated that for the purpose of the hearing staff have copies available of the
public meeting notice, public hearing notice, copies of the ordinance amendments as
proposed and one complete set of FIRM maps, including the index map. There are a
number of minor text amendments of which staff reviewed with the Committee at a
meeting prior to the public hearing. Since that time we've received additional comments.
On February 10, 2009 Gary Heinrichs (DNR) sent come comments to Kevin Grabau and
the comments are also available tonight. Kevin has also received verbal comments from
regional and District FEMA staff. These comments are highlighted in the proposed
ordinance changes. Staff has also received comments from Corporation Counsel of
which are highlighted and will be in proposed final draft. Staff will incorporate all
highlighted areas into the text of the proposed ordinance changes.
Fodroczi stated that no comments prior to tonight have been received concerning the
maps. We have only received comments regarding minor text changes necessary to make

our ordinance comply with the current model ordinance promulgated by the DNR.
That is all staff will present tonight. Staff suggests that due to the weather, that the
Committee does not adjourn the hearing tonight but rather recess until the March 10
Planning and Zoning Committee meeting. So that if we hear from anyone who would
like to comment, but could not make it tonight because of the weather, that staff will take
comments until that time. In preparation for the next Committee meeting staff will take
the highlighted text amendments in the draft and incorporate those. Staff will distribute
the final text document with the Committee packet for the March 10 meeting.
Post asked if these maps will be available on the County website. Fodroczi stated that it
will be our intent to have them available on the website but that we do not have the
electronic data yet. Staff has asked for a digital product and once adopted we will likely
get the digital version.
Sather stated that Kevin had previously stated that our ordinance is more restrictive than
the model ordinance. Can Kevin indicate which portions are more restrictive than model
ordinance? Fodroczi stated that he would. Kevin has had all the contact with the DNR
and FEMA, so he will defer this to Kevin.
Post asked if Kevin had contacted Julia McCarthy as Heinrichs from the DNR stated.
Fodroczi answered yes, and stated that Kevin found her to be very helpful.
Norton- Bauman asked what LOMR means. Fodroczi answered Letter of Map Revision.
This refers to a formal process to alter any of the lines on the maps due to updated
engineering studies and information.
Post asked "what is CDMT' Fodroczi stated that it is the contractor who did the map
work.
Norton- Bauman stated that Kevin had previously said something about the lowest level
of buildings. Fodroczi state that this is covered in Heinrichs comments. Norton- Bauman
also asked how this will change for a homeowner. Fodroczi said that the new maps are
supposed to be more accurate. Some properties may move in or out of the Floodplain
based on the new maps. The National Flood Insurance Program relies on these
regulations and maps to minimize development in the Floodplain.
Hermsen asked if the verbiage in 17.40.H1.8 is in here. Post responded that these items
have been addressed.
Fodroczi stated that the places in the text that are highlighted in green is where it talked
about the regional flood elevation. This is what we had in our ordinance. This has to do
with nonconforming buildings. He will confirm with Kevin on places in the ordinance
that are still more restrictive than the model ordinance.

Norton- Bauman asked if the regional flood elevations are available to the public.
Fodroczi answered yes. He also said that all the definitions are in the definitions section
of the general ordinance. None of the definitions have changed. Staff will send a final
version and the adopting ordinance with the Agenda packet for the Committee's March
10 meeting.
Motion by Sather to recess the public hearing until March 10 seconded by Post.
Motion carried.
