PUBLIC HEARING NOTICE
The St. Croix County Planning and Zoning Committee will be conducting a public hearing on
Wednesday, December 2, 2009 at 7:00 p.m. at the St. Croix County Agricultural Center, 1960 Eighth
Ave., Baldwin, Wisconsin, to consider the following petition(s):

Chair Ruetz called the meeting to order at 7:00 p.m.
Motion by Norton- Baumann to adopt the agenda, 2 nd by Post. Motion carried.
The next committee meeting is scheduled for December 8, 2009 at 8:30 a.m, in Hudson.
Action on previous minutes: Motion by Sather, 2 nd by Post. Motion carried.
The public hearing notice was acknowledged for the record and turned over to Grabau.
APPLICANT: Peter and Bridget Kling
LOCATION: Part of the NW1 /4 of NW1 /4, Section 19, T3 IN, R16W, Town of Cylon
ADDRESS: 2095 200 Street
REQUEST: To rezone approximately 8.56 + /- acres from Agricultural- Residential to Agricultural
pursuant to Section 17.72 of the St. Croix County Zoning Ordinance.
Grabau reviewed the staff report as well as a current county zoning map and a map of the proposed rezoning.
The purpose of the request is to revert rezoning of two lots that were previously rezoned from Agricultural to
Agricultural Residential. The reason that the reversion is required is to combine these lots to an existing
parcel that is currently zoned Agricultural to maintain a parcel size of greater than 35 acres as required in the
Agricultural District. Staff recommends that the Committee approve the rezoning of the lots listed in this
application based on the following findings of fact:
1. Based on TRC findings (# 1 -17) the rezoning is consistent or generally consistent with the County
Development Management Plan and the County Natural Resources Management Plan.
2. It appears that the proposed use can comply with standards in the Land Use, Subdivision and Sanitary
ordinances.
3. The proposed use is consistent with the spirit or intent of the Ordinance.
Grabau asked if the Committee had any questions. Discussion between Committee members regarding the
affects of change in land values and assessments of rezoned lands. Discussion between Committee members
and staff regarding the applicability of Wisconsin State Statutes Chapter 91.77 as it pertains to the rezoning
of property. The Town of Cylon recommended approval of the rezoning request but the recommendation did
not include a finding that the request is consistent with WSS 91.77. It was determined by Committee that
this application did not need a finding concerning WSS 91.77 since the rezoning was to change the zoning of
the lots back to Agricultural.
Chair Ruetz asked three times if there was anyone wishing to speak in favor of this request. He also asked
three times if there was anyone wishing to speak in opposition of this request. Hearing none he closed the
public hearing.

Motion by Sather to approve the rezoning with no conditions. Additional discussion. Motion 2 nd by
Hermsen.
Chair Ruetz asked for a vote to approve the rezoning. Motion carried.

LOCATION: Part of the SWIA of NW1 /4, Section 19, T3 IN, R16W, Town of Cylon
ADDRESS: 207'' Avenue
REQUEST: To rezone approximately 2.75 + /- acres from Agricultural to Agricultural- Residential
pursuant to Section 17.72 of the St. Croix County Zoning Ordinance.
Grabau reviewed staff report as well as a current county zoning map and a map of the proposed rezoning.
The purpose of the request is to allow for the applicant to create a 2.75 acre lot through this rezoning request
and the county's certified survey mapping process.
Staff recommends that the Committee approve the requested rezoning for the parcels listed in this application
based on the following findings of fact:
1. Based on TRC findings (4 1 -10, 13 -17) the rezoning is consistent or generally consistent with the County
Development Management Plan and the County Natural Resources Management Plan.
2. It appears that the proposed use can comply with standards in the Land Use, Subdivision and Sanitary
ordinances.
3. The proposed use is consistent with the spirit or intent of the Ordinance.
Grabau asked if the Committee had any questions.

Discussion about the finding by the Town of Cylon that may be required to be included in their
recommendation that the request is consistent with WSS 91.77.
Motion by Post to approve the rezoning of 2.75 acres from Ag to Ag -Res pursuant to section 17.72 of the St.
Croix County Zoning Ordinance contingent upon the finding document received from the Town of Cylon.
2 nd by Hermsen.
Chair Ruetz asked if there was any further discussion. No response.
Chair Ruetz asked for a vote to approve the rezoning. Motion carried.
Chair Ruetz adjourned the meeting at 7:50 p.m.
