Register of Deeds* ANNOUNCEMENTS & CORRESPONDENCE POSSIBLE AGENDA ITEMS FOR NEXT MEETING ADJOURN (Items may be taken in different order) * Additions /Changes /Corrections DATE: November 5, 2009 MINUTES PLANNING AND ZONING COMMITTEE NOVEMBER 10, 2009 CALL TO ORDER: Chair Ruetz called the meeting to order at 8:00 a.m. PRESENT: Supervisors Gene Ruetz, Lorin Sather, Steve Hermsen, Sharon Norton - Baumann, Peter Post. STAFF PRESENT: Dave Fodroczi, Monica Lucht, Beth Pabst. GUESTS: County Board Supervisor Julie Speer ADOPTION OF AGENDA: Motion by Norton - Baumann, 2nd by Sather to adopt the agenda. Motion Carried. CONSENT AGENDA: Motion by Sather, 2 by Post to adopt the consent agenda approving the minutes of October 13, 2009; approving the bill and revenue reports; and setting the date of the next meeting for December 8, 2009, 8:30 a.m. at the Government Center. Motion carried. OLD AND NEW BUSINESS Land Use Ordinance Applications Municipal Plats: Heritage Cottages, City of Hudson. Motion by Sather, 2 by Post for no objections to the plat. Motion carried. Waivers to be scheduled: One waiver application was received for a reduction in the setback as recorded on the plat in the Town of Warren. The public hearing was scheduled for December 8, 2009, 8:30 a.m. at the Government Center. Rezones to be scheduled: None Discussion of Plats and CSM's currently in the review process: Fodroczi reviewed the list of October and November submittals. Two CSM applications and a major concept plat for the Town of Hudson were received in November. Planning and Zoning Business Resolution Approving Amendment to Town of Hudson Zoning Ordinance — 7.32 acres from Residential to PUD: Fodroczi reviewed this resolution that was brought to the committee at the October 13th Planning and Zoning committee meeting. Prior to that meeting, this development was identified as subject to the extraterritorial zoning of the City of Hudson. Staff referred to Corporation Counsel for an opinion on the County's jurisdiction, and Corporation Counsel verified our concern that the County does not have jurisdiction in area's covered by municipal extraterritorial zoning.. Motion by Norton - Baumann, 2 by Sather to take the Town of Hudson Zoning Ordinance amendment off the table. Motion carried. 1 Comprehensive Plan: Fodroczi indicated that an open house is scheduled at WITC in New Richmond from 4:00 p.m. to 7:00 p.m. on November 18, 2009 for the Comprehensive Plan, including the three communities we are working with. The Advisory committee is also invited to attend. Press releases went out informing the public of the informational meeting. Working Lands Initiative: Fodroczi reviewed two handouts sent to the Committee on the newly nacted Working Lands Initiative that became law on Jul 1 He highlighted Y g Y � ghted the overall program and focused on two items of immediate concern. The new law requires the County to update the Farmland Preservation Plan, which hasn't been updated since 1980. Email instructions for planning grants were received with a deadline of January 11, 2010 to submit the application. St. Croix County is one of the first required to update their Farmland Preservation Plan, and staff would like to develop a work plan to incorporate into the Comprehensive Plan project. The second item discussed was the conversion fee for rezoning land out of exclusive AG zoning previously certified by the state. The conversion fee will be three times the highest assessed value of AG land per acre in the Town where it is located. The County will need to collect the fee and submit to the state. The County is allowed to add an additional fee at their discretion, but is limited to using the funds for farmland preservation planning and zoning or monitoring conservation compliance. Staff suggests delaying consideration of the addition of a local fee until the process of updating our Farmland Preservation Plan and Zoning Ordinance is complete. Committee and staff discussed concerns about the conversion fee and the relation to the zoning ordinance certification and tax credits. Sather asked to have this item on the agenda next month for further discussion. 2010 Fee Schedule: Fodroczi stated that the 2010 fee schedule needs to be distributed. The only change is the description of the new State conversion fee for lands rezoned out of the Agricultural District. Motion by Sather, 2nd by Post to approve the new fee schedule with the addition of the Working Lands conversion fee. Motion carried. 2010 Budget: Fodroczi discussed the status of the department budget and the reduction of the FTE position. There was an offer from one staff member to take a voluntary layoff. The offer required a three -way agreement with the County, Union and staff member, which was just completed. This will take effect January 1, 2010. Register of Deeds Pabst stated she is having ankle surgery and will be taking some time off for recovery.
