Working Lands Initiative* 3. 2010 Budget ANNOUNCEMENTS & CORRESPONDENCE POSSIBLE AGENDA ITEMS FOR NEXT MEETING ADJOURN (Items may be taken in different order) * Additions /Changes /Corrections DATE: October 8, 2009 s• a- MINUTES PLANNING AND ZONING COMMITTEE OCTOBER 13, 2009 CALL TO ORDER: Chair Ruetz called the meeting to order at 8:32 p.m. PRESENT: Supervisors Gene Ruetz, Lorin Sather, Steve Hermsen, Sharon Norton - Baumann. Peter Post was absent and excused. STAFF PRESENT: Dave Fodroczi, Monica Lucht, Beth Pabst. GUESTS: County Board Chair Roger Rebholz ADOPTION OF AGENDA: Motion by Sather, 2nd by Hermsen to adopt the agenda. Motion Carried. CONSENT AGENDA: Motion by Sather, 2 by Norton - Baumann to adopt the consent agenda approving the minutes of September 15, 2009; approving the bill and revenue reports; and setting the date of the next meeting for November 10, 2009, 8:00 a.m. at the Government Center. Motion carried. OLD AND NEW BUSINESS Land Use Ordinance Applications Municipal Plats: None Waivers to be scheduled: None Rezones to be scheduled: Three rezone applications were received this month. The Committee agreed to schedule the public hearing on December 2, 2009 at 7:00 p.m. in Baldwin. Discussion of Plats and CSM's currently in the review process: Fodroczi reviewed the list of September and October submittals. Three CSM applications were received in October. Planning and Zoning Business Resolution Approving Amendment to Town of Hudson Zoning Ordinance — 7.32 acres from Residential to PUD: Fodroczi explained that all Town of Hudson Zoning Ordinance amendments need approval from the County Board. This is a map change, district change and rezone change. Town minutes indicated approvals were subject to the City of Hudson extraterritorial zoning ordinance. The City of Hudson extraterritorial zoning ordinance supersedes any other general zoning ordinance, so the County doesn't have the jurisdiction to approve the rezone. Staff would like to refer this to Corporation Counsel for a legal opinion on jurisdiction for the extraterritorial zoning. Staff recommends tabling this until we receive the opinion from Corporation Counsel on jurisdiction of the ordinance. Motion by Norton - Baumann, 2 by Hermsen to table the resolution concerning the Town of Hudson property that is listed as agenda item 2.a. Motion carried. Report on Ordinance Work: Fodroczi stated Chair Ruetz would explain the ordinance work being done by the Land and Water Conservation Committee and Department. The Planning and Zoning Department is not involved in any other ordinance work. Chair Ruetz explained the Land and Water Conservation Committee and Department have been working on the Animal Waste Ordinance. This ordinance 1 a .J� is being updated to include changes in State rules and policies. Hermsen questioned the time that was spent on this ordinance. Fodroczi answered that Planning and Zoning staff have reviewed the changes for consistency with our Zoning Ordinance. The Animal Waste Ordinance will ultimately be administered through the Zoning Ordinance, but most review and technical work will be done by the Land and Water Conservation Department. Hermsen stated his reason for bringing forth the question is from a budget standpoint to find out how much resources come out of Planning and Zonings budget for demands on ordinance changes. Norton - Baumann questioned if billing takes place between the departments. Fodroczi answered these are levy supported activities in both departments and billing only occurs when separate funding is available such as grants. Fodroczi stated that staff does not initiate ordinance work without committee approval. Comprehensive Plan: Fodroczi indicated staff would like to hold an open house to review and present the Comprehensive Plan workshop results. There are many materials on trends and programs that will also be put on display for the public. This will generate additional public feedback on any modifications needed before further work on the Comprehensive Plan proceeds. Fodroczi gave possible dates for the open house of November 4th, 5th, 11th or the 18th. The Committee indicated November 18 to be the best date. Staff will put together an agenda for this public informational meeting, in an open house format, to be held in Baldwin or New Richmond from 4:00 p.m. to 7:00 p.m. Working Lands Initiative: Fodroczi summarized the major initiative from the Wisconsin Department of Agriculture, Trade and Consumer Protection ( DATCP) which went into effect on July 1, 2009. The major component is the overhaul of Chapter 91 of the statutes for the Farmland Preservation Program. Based on the growth rate, the law requires us to update our Farmland Preservation Plan before the end of 2011. These requirements can be met through our Comprehensive Plan project. The details are still being finalized, but DATCP staff has verified grant applications and funding requirements should be available within the next week. Norton - Baumann questioned how much funding would be coming. Fodroczi answered we would be receiving a 50% reimbursement. There will be an annual allocation of $400,000 between 14 counties with a 2011 deadline. Fodroczi highlighted another related change in Wisconsin state law, effective January 1, 2010, is the conversion penalty payable to the state when land is rezoned out of Agriculture. The County will collect this fee locally to submit to the state, but a provision in the law authorizes local zoning jurisdictions to add an amount for zoning purposes. Detailed documentation is forthcoming as to how conversion penalties will be administered. The committee will have to decide if the County will add an additional amount at the local level, and the fee schedule will need to be amended to incorporate this fee for the public. 2010 Budget Fodroczi updated that there were no further actions taken on the budget. Norton - Baumann indicated that the October 14 Finance Committee meeting will be strictly on the budget. Chair Rebholz discussed recovery bonds. Norton - Baumann questioned the staffing solution for the Planning and Zoning Department. Fodroczi stated the solution is still being worked on and cannot be discussed in open session; more will be discussed at the next committee meeting. The meeting adjourned at 9:36 a.m. 2
