Dave Fodroczi, Kevin Grabau, Ellen Denzer, Jennifer Havens, Alex Blackburn, Monica Lucht, Chuck Whiting Guests: none Call to Order: Chair Ruetz called the meeting to order at 8:33a.m. Adoption of Agenda: Motion by Post, 2nd by Sather to adopt the agenda. Motion carried. Approval of Previous Minutes: d tes: Motion by Hermsen, 2 by Sather to approve the min May 12, 2009. Motion carried. pp minutes of Date of Next Meeting: July 14, 2009, 8:30a.m. at the Government Center. Old and New Business: Land Use Ordinance Applications Municipal Plats - none Waivers to be scheduled — none Rezones to be scheduled — none. Discussion of Plats and CSM's currently in the review process - Blackburn reviewed the list of the May and June submittals as well as corresponding Technical Review Committee letters. Five CSM applications were received in June. Planning and Zoning Business Bills and Revenue Reports — The May 2009, Planning and Zoning Bills and Revenue Reports were reviewed and discussed by the Committee. Notable were several escrow accounts being paid out due to cleanup of projects. Mallalieu Dam maintenance cost came in under budget for the year. Bill for the spring newsletter was paid, and the final bill for office remodeling was paid out of 2008 resources. Hermsen moved to approve the expense and revenue reports submitted, and approve bills for a total of $41,285.07, 2 by Post. Motion carried. 2009 -2011 Wisconsin State Budget Joint Finance committee took up clean sweep funding and did restore $750,000 of the $1 million in clean sweep program and maintained authorization for the clean sweep program. One unusual thing was they eliminated the clean sweep position in Department of AG and transferred program back to the Department of Natural Resources where it had been up until five years ago. Of importance, the Fiscal Bureau staff gave the Joint Finance an alternative to prohibit lapsing those segregated funds into the general fund, and they chose not to do that. We'll have to wait and see what they do with the funding after the budget is passed. 2010 Budget Instructions Instructions were finalized by Finance Committee last week. The expectation is to have budget instructions by the end of the month to discuss at the next meeting. Whiting indicated alternative 5% and10% levy cuts, similar to last year to determine priorities in each department. Post asked if budget instruction could be sent by email, but Whiting indicated a format is being developed. Norton - Baumann stated department heads were told to figure out an ideal budget, then provide 1 alternatives to reduce 5% and 10% of the levy contribution, so we aren't taking grant dollars. We are trying to reduce the expenses that the County supports with levy dollars. Resolutions on SB 107 /AB 278 and SB 186 Fodroczi explained that SB 107 /AB 278 were companion bills in the legislature to establish electronic collection statewide. Manufacturers and retailers would be responsible and liable for receiving and recycling electronics. If the bill is successful, the County could get out of the electronic collection business. This has been supported by Wisconsin County Association and related recycling and solid waste associations statewide. Fodroczi stated he would like the committee to endorse these bills for full County Board support. The second bill SB186 is for adding oil filters and oil absorbent to the banned materials list statewide as far as being able to be landfilled. The recycling of oil filters has been offered as part of our clean sweep program for several years, so the process is in place to take care of these. A primary sponsor of this particular bill is our State Senator Sheila Harsdorf. Post moved to approve the proposed resolutions to support electronic collection and recycling, and law banning filters and absorbents from landfills, 2" by Norton - Baumann. Ruetz called for a vote, 4 ayes, 1 abstention. Hermsen abstained for lack of information. Supervisor Post left the meeting at 9:54a.m. 2010 Capital Outlay Plans Fodroczi presented a proposed 2010 capital outlay plan, which needs to show five years out, and is segregated by the Land Records, Planning and Zoning budgets. He emphasized items that were added and modified on the outstanding capital outlay plan. Notable items for 2010 included consultant services and replacement of a copier and vehicle. Another vehicle was included in the normal replacement rotation for 2014. The Committee and staff discussed the vehicle rotation and copier replacement. Ruetz moved to approve capital outlay plan, 2nd by Hermsen. Motion carried. Recycling Ordinance Review Fodroczi updated that after the last Committee meeting the DNR Solid Waste and Recycling staff was contacted. They were sent a copy of the proposed ordinance and the link to existing ordinance and a copy of the May 11th e -mail from Corporation Counsel. They sent us preliminary comments within a few days. The Recycling Coordinator in Madison also consulted with their staff attorney and we received preliminary comments. Key items were that we do have latitude in what we can do under recycling statutes and rules in terms of waste issues. The one thing they specifically cautioned us on was inclusion of banned material, so we will revisit that. Comments otherwise were general and favorable. The DNR reply was forwarded to Greg Timmerman and he was invited to submit additional questions and participate in a conference call with the DNR. Comprehensive Plan Update Denzer reported results from three nights of workshops. Anna Haines from the UWSP Center for Land Use Education compiled all the ideas into a single vision statement for St. Croix County. Citizen advisory committee members have been emailed for their additional thoughts and asked to provide comments by the next committee meeting. Data will go into the County Comprehensive Plan. The vision statement should guide us in goals, policies and objectives in regards to all plan elements. 2 Code Administration Report Grabau reported on the enforcement for the Sukowatey property. The Judge made a decision and found Sukowateys to be in contempt of the court's original decision. Gillen insisted on the Judge revisiting the site to witness for himself. The enforcement team did put together a list of what was considered to be junk. The Judge went through the list and made accurate determinations on what has to go. Sukowateys were given 90 days to comply with the junk list and 120 days to comply with the vehicle list. Grabau reviewed the Bettendorf file and will be sending additional information regarding the non - metallic mining to Heather Wolske. No new information to report on the trucking business. Norton - Baumann indicated it might be good to continue monitoring if trucks are moving again. Grabau brought to the Committees attention that he received a copy of the order to dismiss the C.A. Richards /Sienna Corp property land division. The plat received conditional approval m received conditional approval for three special fro the committee for preliminary plat, and also recei exception permits and two variances from the Board of Adjustment. One significant condition for all approvals was obtaining a Chapter 30 permit from the DNR, which was denied. A subsequent lawsuit over the denial of the Chapter 30 was recently dismissed with the agreement of all parties. Grabau stated he received a copy of the Attorney General's opinion regarding dual ordinance authority between the County and Town of Troy for the Riverway District. State statutes allow both entities to have Riverway ordinances, but the ordinances are not identical. The Town of Troy questioned duality of the ordinances with the DNR. The DNR submitted a letter to the Attorney General's office, and they noted the County ordinance is enforceable even in a Town with its own Riverway ordinance. Landowners will need to meet the most stringent of the requirements. Sather questioned how landowners would know which is more stringent. Denzer stated they still have to go through both entities and meet both ordinances. Grabau also noted the County ordinance is approved by the DNR, but the Town ordinance is not at this time. Committee Meeting Structure Ruetz spoke for Post in discussing going to consent agenda. He indicated that one member could look over the bills and revenue report, then report on them. Sather thought it was important that discussion occurs on this, and it should remain on the agenda. He felt that the structure shouldn be left as is. 't change at this point with possible new committees in a few months. Ruetz stated that things can Committee recessed at 11:25 a.m. Committee reconvened at 11:35 a.m. Fee Schedule Hermsen started the discussion by questioning state sanitary permit fees. Hermsen indicated he found our fees, compared to other counties, are the highest. He questioned what criteria were used to set the fees and what drives the dollar amount as high as is. Ruetz stated that St. Croix County has one of highest costs of living compared to surrounding counties. Fodroczi explained that ten years ago we had a fee structure similar to other counties, and that very few counties in this area based fees on actual costs to do the necessary work to issue permits. The Planning and Zoning committee at that time worked with the Finance committee 3 { and came to a consensus to recoup our costs. We generalized as an average, but looked at a great deal of cost accounting to cover all associated costs. We also included indirect costs for administrative staff and overhead. The amounts and variability in the fee structure is based on our own St. Croix County cost accounting. Secondly, the counties shared information and there was a great deal of interest in our process regarding cost recovery from many other counties. Fodroczi said he would review available information on the cost accounting to share with the Committee.
