Dear Mr. Olson: Code Admrnrs r rarity 715 -386 -4680 A" This letter confirms after - the -fact zoning approval according to the plans you have submitted Land Information &.:a for filling and grading an area of approximately 9,750 square feet on slopes less than 12 percent Planning within the Shoreland District of the Kinnickinnic River to construct a driveway, single - family 715 386 4674 " dwelling, and sanitary system on the property referenced above in the Town of Kinnickinnic. Staff finds that the proposed project meets the spirit and intent of the St. Croix County Zoning Read P nJ Ordinance and Shoreland District with the following findings: 715 -4677 1. Filling and grading less than 10,000 square feet in area on slopes less than 25 percent is R . allowed with a land use permit in the Shoreland District pursuant to Section 17.29(2)(c) of 5 - 386 - 4675 the St. Croix County Zoning Ordinance; 2. Construction is nearly complete on the portion of the driveway that falls within the Shoreland District of the Kinnickinnic River. The proposed single - family dwelling is located outside of the Shoreland District, but some of the filling and grading required for installing the foundation and sanitary system is located within the district. The proposed driveway, single- family dwelling, and sanitary system meet all required setbacks and dimensional standards provided in the St. Croix County Zoning Ordinance; a 3. The applicant submitted an erosion control and storm water management plan featuring an infiltration pond along the south side of the proposed driveway. With conditions to supplement the silt fence with straw waddles or sediment logs below the construction area as recommended by Pam Quinn, Sanitary Specialist, in her approval of the sanitary pennit, :. to maintain erosion control measures until self - sustaining permanent vegetation is "? established on all disturbed areas; prohibit the use of phosphorous fertilizer to establish and maintain a lawn; implement the storm water management plan; and record a maintenance and monitoring agreement against the property for the infiltration pond, negative in =. to the water quality of the river and wetland will be minimized; r r <w 4. The Wisconsin Department of Natural Resources has reviewed the plans and informed County staff that the disturbance for the project appears to be greater than one acre, in which event an NR 216 storm water permit would be required from the Department of Natural Resources. Based on these findings, approval of the land use permit is subject to the following conditions: 1. The applicant shall be responsible for implementing the erosion control and storm water management plan submitted, and as provided in the conditions below. 2. In addition to the proposed silt fencing, the applicant shall install straw waddles or sediment logs below the construction area for the proposed house and sanitary system. 3. The applicant shall maintain all erosion control measures until permanent, self - sustaining vegetation is successfully established on all disturbed areas of the site. 4. The applicant shall contact the Zoning Administrator when all construction is completed. 5. No phosphorous fertilizers shall be used on the disturbed areas of the site, unless a soil test confirms that phosphorous is needed. 6. The current level of native trees, shrubs, and groundcover along the shoreline of the Kinnickinnic River and within the delineated boundary of the wetland shall be maintained. 7. Within 30 days of completing construction, the applicant shall execute and record an affidavit against the property referencing the storm water management plan and a maintenance and monitoring agreement for the infiltration area and for native vegetation along the shoreline of the Kinnickinnic River and within the delineated wetland boundary with the Register of Deeds, and provide the Zoning Administrator with recorded copies of these documents. 8. Within 60 days of completing construction, the applicant shall submit to the Zoning Administrator photos of the completed project as viewed from all angles. The photographs must also show all storm water management measures and vegetation on the site. This approval does not allow for any additional construction, structures or structural changes, grading, filling, or clearing of vegetation beyond the limits of this request. Avoid muddy, rutted conditions that may allow contaminated runoff to reach waterways and/or drainage ditches. Property owner must repair damage to ditches resulting from multiple access points and sediment tracked on public roadways must be removed at the end of each workday. 3. Do not allow contaminated runoff to be directed onto neighboring property or into surface water conveyances. 4. Installation of approved sediment control products (straw wattles, silt fence, and /or erosion control matting) is a requirement of the Special Exception Permit. Install sediment logs /straw wattles per manufacturer specifications as a perimeter sediment control barrier along the 50' setback from the wetland. Leave a buffer of undisturbed soil between the wattles and grading/excavation areas. The POWTS inspector and/or building inspector will evaluate ESC plan effectiveness and make recommendations to owner for any action required to comply with applicable regulations.
