Rochester, MN 55901 RF: Conditional Approval: Land Use Permit, f ile# LUP-2019-043 Project Location: Sec.7 T28N R19W Town of Troy Address: 418 Whispering Pines Rd N Jeff and Ashley, Community Development staff have reviewed the application to construct a new single-family dwelling attached garage and driveway within the Lower St. Croix Riverway Overlay District. The request has been conditionally approved based on the application submission and the following findings. Please see the enclosed site plan to reference the general erosion control and grading notes. • On August 15, 2019, the applicant submitted a Conditional Use Permit to fill and grade less than 10,000 square feet outside of the slope preservation zone and greater than 40 feet from the slope preservation zone. If the applicant exceeds 10,000 square feet of land disturbance, the applicant will have to apply for a Conditional Use Permit. • Stormwater management plans and erosion and sediment control plans have been submitted that meet Wisconsin Department of Natural Resources Technical Standards and meet the standards set forth in the Lower St. Croix Riverway Overlay District Section 11.36 H.7. Best Management Practices will be incorporated. • 1 opsoil to be stockpiled and stored onsite to preserve during construction. Plans to be replaced once construction is complete after which revegetating is planned. • Limited vegetation removal is required as a part of this permit approval. • The height of the principal structure is not within the view of the bluffline. • The new residence will require a State Sanitary Permit to install a Private Onsite Wastewater Treatment System (POWTS). Based on these findings, approval of the Land Use Permit is subject to the following conditions: 1. The following shall be flagged prior to site construction: slope preservation lone, side yard setback, and buildings. Silt fence (or other adequate erosion and sediment control) shall be placed along the filling and grading boundary nearest the building site to protect undisturbed areas from erosion, land disturbance and vegetation removal. A pre-construction inspection is required to discuss the construction timeline and to verify the areas above and have been flagged and that erosion and sediment control are installed. It is the applicant's responsibility to schedule this appointment, please call to schedule this inspection. 3. An affidavit shall be required describing the approved stromwater management, erosion and sediment control and maintenance requirements within 30 days after construction is completed pursuant to Chapter 11.36 H 7.9. 4. All structures will be earth tone in color as per the performance standards set forth in Section 17.36 11.1. S. All temporary erosion control measures shall be left in place and maintained until the site has reached a point of at least 70% permanent vegetation. Permanent vegetation shall be established once final grade is reached or as soon as applicable per plan. 6. A post-construction inspection is required to close out the permit. It is the applicant's responsibility to schedule this appointment, please call to schedule. 7. It is the applicant's responsibility to secure any other required local, state or federal permit(s) and approval(s) prior to land disturbance activity. Including permission from the Town of Troy for driveway access. 8. Failure to comply with the terms or conditions above may result in the revocation of this permit by the Zoning Administrator according to Chapter 17.36. This approval is subject to the conditions listed above; it does not allow for any additional construction, structures, or buildings beyond the limits of this request. Your information will rernain on the at the St. Croix County Community Development Department suite. It is your responsibility to ensure compliance with any other local, state, or federal permitting or regulations, including contacting the Town of Troy to inquire if additional permissions are required. This permit is valid for one year, with the possibility of up to two (2) six-month extensions if the applicant submits the appropriate permit extension fee and documentation to the Zoning Administrator. A copy of the Land Use Permit placard should be submitted to the local Building Inspector for the town upon application for the building permit. The orange placard must be posted on the job site and visible from public view.
