Dear Ben & Nicole Hanke,
Community Development staff have reviewed the application to construct an accessory structure
;detached garage), expand an existing accessory structure (driveway) and for filling and grading on the
property located within the I ower St Croix Rivenvay Overlay District. The request has been conditionally
approved based on the application submission and the following findings. Please see the enclosed site
plan to reference the general erosion control and grading notes.
• A cornplete application was submitted on September 13, 2019
• The applicant proposes to construct the detached garage and expand the driveway while disturbing less
than 10,000 square feet and greater than 100-feet from the bluffline. It is anticipated the project will
include approximately 1,500 square feet of land disturbance according to the site plans.
• Slorrnwater rnanagernent plans and erosion and sediment control plans have been submitted that meet
Wisconsin Department of Natural Resources Technical Standards and meet the standards set forth in the
I ower St. Croix Riverway Overlay District Section 17 36 H"/ Best Management Practices will be
incorporated.
• the existing structures had existing storrnWater management plans as part of a previous permit (LUP-
1016-027 & CUP-2016-011). Verification of installed stormwaler rnanagernent is required as this was never
finalized.
• Vegetation removal (trees) is required and approved as a part of this permit. As vegetation is outside of
the OHWM and Bluffline setbacks and shall limited to the minimal amount necessary to complete this
project.
• The proposed accessory structure will meet the following setbacks as measured to the nearest part of the
struclurc, including the roof overhang:
0 200 foot Ordinary High Water Mark (01 IWM) setback
o 100-fool bluffline setback
o 25 foot side yard setback
• The maximurn structure height for an accessory structure shall be governed by the base-zoning dislrkt.
I he I own of Troy General Zoning Ordinance will prevail.
• The new accessory stnxture will be an earth tone color.
Based on these findings, approval of the Land Use Permit is subject to the following
conditions:

1. I he following shall be flagged prior to ,rte construction 2;-foot exterior lot line setback The stormwater
infiltration Swale area shall also be flagged off to prevent compaction from construction activities.
7 Silt fence (or other adequate erosion and sediment (ontrol) shall be placed per plan to protect
undisturbed areas from unplanned land disturbance and vegetation removal.
3 A pre-construction inspection is required to discuss the construction timeline, verify the areas above and
have been flagged and that erosion and sediment control are installed prior to land disturbance. Staff
will also need to inspect the storrnwaler features have been installed as identified in LUP-2016-027. It is
the applicant's responsibility to schedule this appointment, please. contact (715) 386-4680 to schedule
this inspection.
4, Vegetation removal (trees) is limited to the construction limits identified in the site plan.
5 All temporary erosion control measures shall be left in place and maintained until the site has reached a
point of at least 70% permanent vegetation. Pcrrnanenl vegetation shall be established once final grade
is reached or as soon as applicable per plan.
6. A post-construction inspection is required to close out the permit. It is the applicant's responsibility to
schedule this appointment, please contact (115) 386-4680 to schedule
1. An affidavit shall be required describing the approved stormwater management, erosion and sediment
control and marrtlenance requirements within 30 days after construction is completed pursuant to
Chapter 1736 H /.g to ensure the devices continue to serve their purpose of preventing storrnwaler from
leaving the property,
8 It is the applicant's responsibility to secure any other required local, state or federal permit(s) and
approval(s) prior to land disturbance activity.
9. Failure to comply with the terms or conditions above may result in the revocation of this permit by the
Zoning Administrator according to Chapter 17.36.
This approval is subject to the conditions listed above; it does not allow for any additional construction,
structures, or buildings beyond the lirnits of this request- Your information will remain on file at the St.
Croix County Community Development Department suite. it is your responsibility to ensure compliance
with any other local, state, or federal permitting or regulations, including contacting the [own of I toy to
inquire if additional permissions are required This permit is valid for one year, with the possibility of up
to two (2) six-month extensions if the applicant submits the appropriate permit extension fee. and
documentation to the Loninq Administrator. A copy of the Land Use Permit placard should be submitted
to the local Building Inspector for the town upon application for the building permit. The orange placard
must be posted on thejob site and visible from public view.
