The reason for the variance is that there is not enough room to meet the setbacks from the
property line and the builtling. There is only 17' of space for the draindeld and the code
requires 10' Hom a building and 5' from a lot line. The chambers are 3' wide so the system
simply does net lit. I am proposing to be>3' from the property line and within 8' of the
building. The county does not have a issue with the setback being reduced in the industrial
park. The building is a slab on grade so there would be rro horizontal intrusion to the
builtling. Extra care will be used to make sure the building is not undermined Additionally,
the code allows septic tanks which are deeper to than the chambers to be cheer to the
building. The dronfield will not cause a additional hardship with the neighboring building
being closer man 5' from the property line. A smaller excavator shall be used to avoid
thing the fence and the building.

LEL Holdings,
Our department has received a request from the Department of Safety and Proffessional
Services (DSPS) to comment on a potential variance to the building setback for a new POYVI S
(Private Onsite Wastewater System) at the above mentioned property.
The St. Croix Community Development Department recommends approval of the variance
based on these recommendations:
1. The drainFleld would still meet the 5 ft. setback to the property line.
2. Based on the Soil Test Plot Plan (attached) the existing building is a slab on grade.
3. There would Still be a minimum of 5 ft from the building to the dronfield
If these recommendations are met there is unlikely to be any health, safety, or adverse effects
of granting the variance.
