CROIX COUNTY GOVERNMENT CENTER, HUDSON, WI August 24.1999 PRESENT: Supervisors Art Jensen, Gerald Larson and Dave Hense. Linda Luckey and Ron Raymond were excused: Steve Fisher, Debbie Zimmermann, Dave Fodroczi, Bob Heise, Fran Bleskacek. Guests: Ted Mackmiller, Denise Gunderson, Julie Speer and Doug Zahler Vice Chairman Dave Hense called the meeting to order at 9:00 a.m. Motion by Larson, second by Jensen to adopt the agenda. Motion carried. Minutes/ Meeting Dates Motion by Jensen, second by Larson to approve minutes for meetings held on July 26, July 28 and August 10, 1999. Motion carried. Rezonements Fisher stated that there are three new rezonement applications that need to be scheduled for a hearing. The committee decided to hold the hearing on September 22, 1999 at 7:00 p.m. at the Ag Center in Baldwin. They will hear rezonement requests for Harvey Christensen (Stanton), Marvin and Sharon Utecht (Baldwin) and Robert and Sharon Austrum (Pleasant Valley). Gaylen Schilling Rezonement Decision This rezonement request was heard on August 18, 1999 and was postponed until this meeting to get a town recommendation and to get comments from the town on the consistency of this request with their land use plan. Fisher informed the Committee that the Town of Somerset believes this request meets their land use plan. A motion was made by Jensen, second by Larson to approve the rezonement. Motion carried with Hense voting no, as he believes it does not meet the town plan. There was some discussion by the Committee with regard to towns following their plans where rezonements are concerned. The Committee asked Fisher to send a letter to the clerks asking the towns to address their town plan when approving or denying a request. By doing this, the Committee will know the reason for the decision made by the town. Jensen stated that he believes the towns are waiting for the county to pass the land use plan before creating a plan or changing their current plan. Fisher will take care of writing a letter. Minor Subdivisions See Attachment A Major Subdivisions See Attachment B Municipal Plats City of Hudson- Bieneman Farms, 1s' Addition - Motion by Jensen, second by Larson to certify no objection. Motion carried. Hearing -10:00 a.m. Public Hearing to consider the following appeals to the St. Croix County Ordinance: a. An Ordinance Amending an existing ordinance known as Section 17.36 St. Croix River Valley District b. Adopting a new Zoning Ordinance District to be referenced as Section 17.37 Lower St. Croix River Valley District II C. An Ordinance Amending Section 17.32 Districts of the St. Croix River Valley District ordinance A motion was made by Larson, second by Jensen to open the hearing. Fisher read the public hearing notice as published. He then gave a recap of how we got to this point. There has been much discussion 1 - - - ` I on the area of land outside of the state and federal boundaries on the St. Croix River. It has been decided that this area may need a separate ordinance. Fisher stated that we are here today to look at three drafts of proposed ordinances. Fisher went over the handouts of these drafts with the Committee. Fisher handed out maps that were put together by the zoning staff showing the River Valley districts, state, federal and county boundaries. He then presented maps of the state and federal visibility zone with county overlay showing the visibility zone. He further stated that the new ordinance proposals do not cover any other areas than are now included. There were several questions to the Committee by people attending the hearing on why they are considering a new ordinance. The Committee explained that the boundaries will remain the same, it is just that the county boundaries need to be clarified separately from the state and federal boundaries. The main reason for these boundaries along the St. Croix River is to protect the Scenic Riverway District. After some discussion with the people present, a motion was made by Jensen, second by Larson to close the hearing. Vice Chairman Hense stated that there will not be a decision made on these proposed changes today, but rather, a decision will be made at the September 14, 1999 meeting. The decision will then go to the County Board meeting on September 21, 1999. Town of Hudson Ordinance Fisher explained that the Town of Hudson has amended Section 2 of their Zoning Ordinance (attached). He asked the committee to review this resolution. After reviewing, a motion was made by Hense, second by Larson to approve the ordinance resolution. Motion carried. Violations and Citations The Committee reviewed the report. Bills. Invoices and Revenue Report Committee member reviewed the Zoning Department Revenue Report. Motion by Jensen, second by Larson to approve bills in the amount of $9,741.49 for the month of July. Violations and Citations The Committee reviewed the report from Zoning. Please see attached. The Committee departed at 10:55 a.m. to conduct the viewings. Marcello Acres Subdivision - Preliminary and Final Owner: Steve Marcello Location: NE%-NW% , Section 14, T30N-R1 9W, Town of Somerset, 1 lot totaling 10.29 acres Staff Recommendation: Conditional Approval for preliminary and final plat: 1)The Developer to pay for the costs of two (2) 45-mph road signs, township to install the signs; 2)45 mph speed limit signs to be posted on either end of 75t1 street; 3)Final plat will not be signed by the Zoning Director until the signs are installed; 4)The Town of Somerset is to send a letter to the Zoning Director stating they agree to install the signs; 5) Financial guarantees in the amount of 120% are required for erosion control and road construction. Financial guarantees to be submitted prior to beginning construction; road construction and erosion control practices to be completed as planned. Committee action: Motion by Larson, second by Jensen to approve with above conditions. Motion carried. 2. Frontier Subdivision - Preliminary Owner: Sam Miller Location: Section 5, Town of Troy, 24 lots totaling 67.8 acres. Staff Recommendation: Conditional approval with the stipulation that a special exception use permit be obtained if filling and grading of more that 1,000 square feet on slopes of 12-20% or 2,000 square feet on slopes of less than 12% within 300 feet of navigable water is required for any construction. There are two navigable wetlands located to the south of the subdivision on a neighboring property. Committee action: Motion by Larson, second by Jensen to postpone until issues are addressed with neighbors. Motion carried. Roger Humphrey, with Humphrey Engineering, will meet with the concerned neighbors and try to work out issues. 3. Exit Four Business Park Subdivision -Preliminary Owner: CPT, LLC (Terry Pirius) Location: Section 27, Town of Hudson, 24 lots totaling 61.459 acres Staff Recommendation: Conditional Approval: 1)Certification from Surveyor's Department that no further map revisions are needed; 2)Construction waiver may not be approved until preliminary approval has been received from DOT and financial guarantees are submitted. The Committee will allow the DOT to respond to this no later than August 315`. If no response by then, will not accept any conditions from them. Sunrise Meadows - Final Owner: Bill Derrick, Sr. Location: Section 26, T30N-R1 8W, Town of Richmond, 8 lots totaling 39.837 acres. Staff Recommendation: Conditional approval: Certification from the Surveyor's Department that no further map revisions are required; the final DOT certification must be placed on the map. Motion carried. 4 i RESOLUTION APPROVING AMENDMENT TO TOWN OF HUDSON ZONING ORDINANCE SECTION 2 Resolution No. WHEREAS, the Town of Hudson adopted amendments to its zoning ordinance on August 3, 1999 as follows: Section 2.3.6: Special Exceptions deleting (f) 2. Non-residential Daycare Center Section 2.4.6: Special Exceptions deleting (a) Wood chippers and sawmills Section 2.5.6: Special Exceptions deleting (e) Wood chippers and sawmills, (i) Public and Private dumping grounds, and (s) Non-residential Daycare facility as published. WHEREAS, Section 60.62(3), Wisconsin Statutes and Section 7.0 of the Town Ordinance, requires in counties having a county zoning ordinance that no town zoning ordinance amendment of a zoning ordinance is effective unless approved by the county board; and WHEREAS, St. Croix County has a zoning ordinance; and WHEREAS, the Planning, Zoning and Parks Committee has reviewed the proposed amendments and recommends approval. THEREFORE, be it resolved by the St. Croix County Board of Supervisors that the amendments to the Town of Hudson Zoning Ordinance set out above are hereby approved. The area subject to the proposed amendment includes land located outside of the official Federal and State boundaries delineated in the Lower St. Croix National Scenic Riverway Minnesota/Wisconsin Final Master Plan adopted February of 1976.
