Location: A parcel of land located in the SW'/4 of the NW '/4, the SW % of the NE % and the SE % of the NW %4, all in Section 11, T29N-R1 6W, Town of Baldwin, St. Croix County, Wisconsin. 2) Robert and Sharon Austrum to rezone approximately 5.03 acres of land from Agriculture to Ag/Residential. Location: A parcel of land located in part of the NE % of the SE'/4 and the SE % of the SE all in Section 28, T28N-R1 7W, Town of Pleasant Valley, St. Croix County, Wisconsin. 3) Harvey B. Christensen to rezone approximately 2.0 acres of land from Agriculture to Ag/Residential. Location: A parcel of land located in the NE '/4 of the SE % of Section 31, T31 N-R1 7W, Town of Stanton, St. Croix County, Wisconsin. CROIX COUNTY PLANNING, ZONING & PARKS COMMITTEE September 22, 1999 St. Croix County Agriculture Center, Baldwin, Wisconsin Committee present: Dave Hense, Art Jensen, Gerald Larson Ron Raymond, Linda Luckey Staff present: Steve Fisher, Zoning Administrator Chairman Raymond called the meeting to order at 7:00 PM. The hearing notice was read into the record. Mr. Raymond introduced committee members and explained the rules of the hearing. Motion by Hense, second by Larson to adopt the Agenda. Passed ZONING BUSINESS: 3 Agenda Items - New Business. See Attached Agenda. REQUEST NO.1 Sharon Austrum, 1811 CR "M" Hammond. Stated that they would like to rezone 5 acres of land from Ag to Ag/Residential to provide for a building site for their son. The committee had questions regarding earth-moving activities on the site. Austrum stated that work was under-way for an access to the site. Fisher read a letter from the Town of Pleasant Valley in support of the rezoning into the record. The committee noted that the letter did not specifically reference § 91.77. Chairman Raymond called for comments in support of, or opposing the request. None were heard. A motion was made by Larson, seconded by Jensen, to recess the hearing. Motion carried. A motion was made by Larson to recommend to the County Board that they approve the rezoning request of Robert and Sharon Austrum to rezone 5 acres of land from Ag to Ag Residential with the understanding that the provisions of § 91.77 have been met. Subject to the following condition: 1) The township is to submit a written correspondence to the zoning department stating that they considered WI §91.77 with their recommendation. Motion was seconded by Jensen. Motion carried with all members voting to approve. REQUEST NO.2 Harvey Christensen, 1492 CR W' New Richmond, stated that he would like to rezone a 2 acre parcel for a building site. The township required that the applicant amend his original rezoning proposal from a rezoning request for two (2)-building sites to one (1). Mr. Christensen stated that he is requesting to rezone only one (1) - two (2) acre parcel. Mr. Christensen initialed Lot 3 on the map presented, affirming that this is the lot he proposes to rezone. The other lot shown on the map (Lot 2) is not under rezoning consideration. Fisher read correspondence from the Town of Stanton, supporting the request. The committee noted that the letter did not specifically reference § 91.77. Chairman Raymond called for comments of support for or in opposition to the request, none were heard. Motion made by Larson, second by Jensen to recess the meeting. Motion carried. A motion was made by Hense to recommend to the County Board that they approve the request of Harvey Christensen to rezone 2 acres from Ag to Ag Residential, with the understanding that the provisions of § 91.77 have been met. Subject to the following condition: 1) The township is to submit a written correspondence to the zoning department stating that they considered WI §91.77 with their recommendation. Motion was seconded by Jensen. Motion carried with all members voting to approve. REQUEST NO.3 Marvin and Sharon Utecht request to rezone 120 acres from Ag to Ag - Residential. Joe Granberg, 1239 CR "E" New Richmond, of Granberg Surveying was in attendance representing the Utecht's. Granberg stated that the soils were poor and thus limited the number of building sites allowed on the parcel to 5. The front 40 acre parcel would not "perc" for a septic and a long road would be required to be constructed to the rear to provide access for the back lots. Raymond articulated County road standards and expressed concerns regarding the soils, road issues and general land suitability regarding the rezoning request. Jensen had questions on the suitability of the parcel and suggested the applicant provide a proposed layout. Fisher explained the staff report, including supplemental information on the poor soils on the property. Soils on the property create severe limitations for development including road and septic construction. Hense stated that he would like more information on this request regarding: soil limitations, layout, creek crossing information etc. Chairman Raymond called for comments of support for or in opposition to the request. Nancy O'Conner 2561 110th St; Town of Baldwin stated that she had concerns with suitable access to the site, and the number of homes on the property. Paul Lokker, with the Town of Baldwin stated that the town had provided written correspondence to the county. He stated that the Township does have concerns with the 'h mile driveway and the suitability of the land. Motion by Hense; second my Larson to recess hearing. Motion carried. Jensen reiterated concerns regarding the crossing of the creek and articulated that the Land and Water Conservation Department (LWCD) would be asked to review any proposed plans. Luckey expressed her concern with "spot zoning". The applicant is requesting approval to rezone a residential chunk of land among large tracts of Agriculture land. Motion by Jensen to postpone the 120-acre rezoning request until the following required additional information is submitted and addressed: 1. Applicant to provide a proposed layout of the subdivision. Layout to include, roads, driveways, proposed building pad locations, septic & well locations. All required features noted on the proposed layout are to demonstrate compliance with minimum setback requirements. 2. Applicant to identify the location and proposed design/construction of the roadways to all of the parcels. 3. Applicant to provide Creek crossing information. Applicant to explain/show how they plan on crossing the creek, compliant with DNR and County requirements. 4. Applicant to contact DNR. Applicant to report back to the Township and County regarding State requirements for crossing the creek. rt 5. Applicant to address the poor soil conditions on the parcel and justify the development /rezoning proposals on these marginal soils. 6. Applicant to address spot zoning concerns. The PZPC expressed concern over the Ag-Residential rezoning request within an area largely zoned Agriculture. Motion Seconded by Hense. Discussion: The Committee stated that the applicant must submit the required information to the Town Board and appear before the Town board with this new information before coming to a future PZPC rezoning meeting. The committee expects additional feedback from the town regarding this required additional information. Raymond stated that he had concerns regarding the suitability of this parcel for development in general. Motion carried. Motion made by Hense second by Jensen to adjourn the meeting. Motion carried.
