CROIX COUNTY GOVERNMENT CENTER, HUDSON, WI October 27, 1999 PRESENT: Chairman Ron Raymond, Supervisors Art Jensen, Gerald Larson, Dave Hense and Linda Luckey were present. Staff present: Steve Fisher, Mary Jenkins, Debbie Zimmermann, Dave Fodroczi, Fran Bleskacek. Guests: Doug Zahler, Steve Kochaver, Larry Murphy, Ron Johnson, Jim Janke. Chairman Raymond called the meeting to order at 9:00 a.m. Raymond informed everyone that the viewings for today have been canceled and will be on the agenda at a later date. Motion by Jensen, second by Luckey to adopt the agenda with changes. Motion carried. Minutes/ Meeting Dates Chairman Raymond went over dates for upcoming meetings. Those meeting dates are: November 3rd: Rezonement hearing in Hudson November 9th - Next meeting with Planning and Parks Departments - The van will be available for viewing the Conservation Design at Marine on the St. Croix for those committee members interested. November 15th - Meeting to be held on the Plan November 17th - Meeting to be held on the Plan November 231- Next meeting with the Zoning Department December 28th - Meeting with the Zoning Department Raymond also added that there will be some additional items on the November 31 meeting agenda. The agenda will be amended to include these additions. Motion by Hense, second by Larson to approve minutes from meeting held on October 12, 1999, with changes made by Supervisor Luckey. Hearings Fisher informed the committee that there are no hearings scheduled for today. Rezonements Fisher stated that there are two new rezonements to be scheduled. The Committee decided that the rezonement for the Town of Troy will be held at 7:00 p.m. on December 11t at the Government Center in Hudson. The rezonement for the Town of Pleasant Valley will be held at 7:00 p.m. on December 8th at the Ag Center in Baldwin. The committee will view these properties at the Planning, Zoning and Parks Committee meeting to be held on November 23' Minor Subdivisions See Attachment A Major Subdivisions See Attachment B Municipal Plats Fisher stated that there are no municipal plats this month. Bills. Invoices and Revenue Report Committee members reviewed the Zoning Department Revenue Report for September. Motion by Hense, second by Larson to approve bills in the amount of $11,260.26 for the month of September. Violations and Citations The Committee reviewed the report. Fisher informed the Committee that the Town of St. Joseph has been taking aggressive action against violators in their town. When they are reported to Zoning, they are looked at and then the major violations are identified and action is taken. At the present time, there are just too many being turned in by St. Joseph for Zoning to be able to act on all of them. The Zoning Office will work with the town on this issue. 1 Fisher stated that the Bettendorl' and Sukowatey matters are moving forward. The Judge has ruled in our favor on both cases. Fisher added that Mr. Bettendorf has been cooperative with the Zoning Office. Release of Escrow Funds for the Town of Rush River Fisher explained to the Committee that the Town of Rush River is asking for funds to be released out of their escrow account for parks. They are asking for $1134 to send children from their town to the park in Baldwin for the summer program, as they do not have a program like this in Rush River. There was a discussion held by the Committee on using park money for this type of request. The Committee believes that this money should go toward improving parks, new equipment, etc, not for individual children to attend a parks program. The Committee took a break at 10:15 a.m. to get a copy of the policy on distribution of the money in these escrow accounts. The Committee reconvened at 10:35 a.m. and further discussed this item. Fisher went over the ordinance with the group. It was the consensus of the group that Supervisor Jensen will speak with the Town of Rush River and explain the policy to them and work with the Town on this request. Motion by Hense, second by Larson to postpone this request to a later date. Motion carried. St. Croix County Development Management Plan Ellen Denzer and Jim Janke joined the group at this time to discuss the Plan. Denzer stated that staff reviewed the Town of Troy and City of Hudson plans regarding the transition area. After reviewing the plans, they had questions on the City of Hudson plan. Staff talked to City Planner, Denny Darnold, and he agreed that there are some areas that need to be addressed. He will check into this and get back to planning. Denzer asked that this be placed on the agenda again for the meeting in two weeks. Denzer also stated that this will not impact the process from moving forward. The public hearings for November 15'h and 17`h are firm. The November 15'h hearing will be held at 7:30 at the Ag Center in Baldwin. The hearing on the 17'h will be held at 7:30 p.m. at the Government Center in Hudson. Luckey stated that she went to the St. Joseph Planning Committee meeting last night. They looked at the Development Capacity Chart that was handed out at the public informational meeting on the Plan and were concerned that the numbers for St. Joseph were not correct. Denzer stated that Pat Collins had been in to see her about that and she realized that there had been an error made. She gave Collins a copy of the chart with the correct numbers on it. Luckey said that there were also some questions on the numbers for the Town of Hudson. Denzer explained that the Town of Hudson numbers included a transitional zone. She further explained that St. Joseph does not have a transitional zone. Their numbers are based on 10,000 acres of developable land. There are ways to increase the numbers if clustering is allowed. She further stated that this is not a regulatory chart, just informational to illustrate the concepts. Luckey asked Denzer to send a memo to the town of St. Joseph explaining how the chart works relative to them. Denzer will talk with Pat Collins on this issue. Direct Farm Marketing Ordinance Fisher explained progress that has been made on writing this new proposed ordinance. He has had contact with the University of Wisconsin-River Falls on this issue. The University has been conducting studies and doing research on this topic. They believe there is a real need for this to help out the rural economy. Chairman Raymond agreed that we need to help the farmers out in this area so they are able to make a living. Discussion held by the Committee. Jim Janke, County Resource Agent with UW Extension, has been working with Fisher and went over the information handed out to the Committee. He stated that this is not unique to St. Croix County, so we can draw from other experiences in other areas in Wisconsin and in the nation. Janke went on to say that in order to help the rural economy, we need to look at farmers being able to directly market farm products and possibly other related products. Fisher agreed that we need to address this issue. Larry Swain, with U-W River Falls, is working with farmers at this time that are interested in direct farm marketing. 2 - - Fisher stated that there is this type of farming going on right now in St. Croix County in the Ag District. It is important for us to look at these operations and learn from them to use as a tool in writing this new ordinance. Fisher proceeded to go over the different options he believes are available in putting together this ordinance. Fisher asked the Committee to go over the handout he gave them and we can discuss again at the next meeting. The Committee agreed that the zoning staff is on the right track with this ordinance. Fisher said they would proceed with this and keep the Committee informed. The Committee asked Fisher to look into permits for commercial uses being reviewed from time to time to keep businesses compliant with original permit. St. Croix Riverway Chairman Raymond stated that they have gotten some communication on this issue from the Department of Natural Resources and Corporation Counsel. A discussion was held. Fisher asked for direction from this committee to resolve this issue. The Committee feels they need to think about this some more and are not ready to act on this complicated issue at this time. This item will be placed on the November 3rd agenda for discussion. Motion by Larson, second by Raymond to adjourn. Motion carried. Staff Recommendation: Conditional approval: 1) Financial guarantees equal to 120% of the construction bids are required for erosion control and road construction. Written estimates must accompany the financial guarantees. 2) No construction, including earth moving, to take place until the financial guarantees are submitted and approved by the Zoning Office. Riverpark Meadows - Preliminary Owner: Pat Collova Location: Section 10 & Section 15, Town of Hudson, 26 lots totaling 76.52 acres Staff Recommendation: Conditional approval: 1) The County requires financial guarantees for road construction and erosion control. The guarantees must be 120% of the estimated cost for construction. Written estimates must accompany the financial guarantees; 2) Financial guarantees and construction estimates to be submitted and approved by the Zoning Office; 3) A construction waiver may not be approved until financial guarantees are submitted; 4) The developer is granted a limited construction waiver to construct the road to the point of the common lot line of lots 13-14 this year. The remainder of the plat shall not be constructed until weather conditions allow for it in the spring of 2000; 5) Applicant to verify that the stormwater discharge permit has been obtained prior to final plat approval; 6) The final plat must contain a notice that all lots in Section 15 will require a well construction variance from the Dept. of Natural Resources.
