MINUTES
PLANNING, ZONING AND PARKS COMMITTEE
ST. CROIX COUNTY GOVERNMENT CENTER, HUDSON, WI
November 23,1999
PRESENT: Chairman Ron Raymond, Supervisors Art Jensen, Gerald Larson, Dave Hense and Linda
Luckey were present. Staff present: Steve Fisher, Debbie Zimmermann, Dave Fodroczi,
Fran Bleskacek. Guests: Doug Zahler, Jason Paukner, Kristin Granberg, Ron Johnson,
Chris Bethke, Philip M. LaVenture, Patricia A. LaVenture, Dennis Damold
Chairman Raymond called the meeting to order at 9:00 a.m. Raymond informed everyone that the
viewings for today have been canceled and will be on the agenda for the next meeting. Motion by Hense,
second by Raymond to adopt the agenda with changes. Motion carried.
Minutes/ Meeting Dates
Chairman Raymond stated that the next County Board Meeting will be held December 14th, so this
committee needs to change their December meeting date. After some discussion, it was decided that the
next meeting for Planning and Parks will be held on December 6th at 9:00 a.m. The Committee will meet
and conduct the viewing of various sites and then meet at the Government Center in Hudson in the
afternoon to continue with their meeting. It was then decided that the next meeting with the Zoning
Department will be held on December 21 s' at 9:00 a.m. at the Government Center in Hudson.. The
deadline for plat submittals will remain as December 28th, even though the meeting will be held on the 215'
The meeting dates for December are as follows:
December 1st: Town of Troy rezonement at Government Center in Hudson
December 6th: Meeting with Planning and Parks at Government Center, and viewing of sites
December 8th: Town of Pleasant Valley and Baldwin rezonement hearing at Ag Center in Baldwin
December 14th: County Board
December 21st: Meeting with Zoning Department at Government Center in Hudson
Motion by Luckey, second by Larson to approve minutes from meeting held on November 9, 1999, with
changes made by Supervisor Luckey.

Hearings - Variance request from Patricia and Philip LaVenture pursuant to Section 18.16(D)(7)(g)
Fisher explained that this request is for a variance to allow the continuation of traffic from a residential
development directly into a commercial area. The applicant is required to apply for this permit, as their
proposed certified survey map will not be allowed without this variance. The applicant would like to build a
new home on a parcel of land near the commercial site. The applicant owns the commercial property, as
well as the proposed building parcel.
Fisher explained that the Town of Richmond has approved this application, but he has not received any
comments from the Wisconsin Dept. of Transportation. Fisher has made numerous phone calls to the
DOT, and has not gotten any response from them.
Fisher went over the staff report that was handed out to the Committee.
The hearing was opened at 10:15 a.m.
Philip LaVenture and Patricia LaVenture are the applicants, whose address is 1035 Highway 64, New
Richmond, Wisconsin. Mr. LaVenture stated that they would like to build a home on this parcel for he and
his wife. Their son will be living in the existing home on the parcel. Doug Zahler, with S & N Land
Surveying, stated that this is a 70 acre parcel and putting a second home on the property should not
create a problem. He further explained that the bulk of the 70 acres is behind this property and there is
no other access to the parcel at this time, and he believes another access would be hard to find.

LaVentures went on to explain that the driveway goes straight from the road to the home, and the
businesses break off at the left and right of the driveway. The driveway does not run through any parking
lots. The LaVentures plan to keep the parcel intact and not subdivide now or in the future. The
commercial property takes up 11 acres and the remaining 70 acres is open. This request is for the one
additional home only. This will not be an access for additional building sites in the future.
Chris Bethke, Supervisor for the Town of Richmond, asked the Committee to consider approving this
variance request.
Zahler stated that according to the information they have seen so far from the D.O.T., this highway access
may be a frontage road when the new highway 35 comes through.
Motion by Hense, second by Larson to close the hearing at 10:40 a.m.
Fisher recommended to the Committee that they postpone making a decision until we receive information
we
from the Department of Transportation. The Committee told Fisher that it is extremely important that
get a response from the D.O.T. as soon as possible.
Motion by Raymond, second by Luckey to postpone a decision until the site is viewed again, to give the
D.O.T. more time to respond to this request, and to determine how the 70 acres in the back could be
accessed. The Committee will make a decision at the December 2151 meeting, whether or not a response
has been received from the D.O.T. Raymond, Luckey, Hense and Jensen voted in favor. Larson was
opposed. Motion carried.
Bills. Invoices and Revenue Report
Committee members reviewed the Zoning Department Revenue Report for October. Motion by Hense,
second by Larson to approve bills in the amount of $80.052.82 for the month of October.
The Committee recessed at 10:55 a.m.
The Committee reconvened at 11:05 a.m.
St Croix Development Management Plan
Dave Fodroczi stated that staff could be prepared to take this to the County Board on December 14`h.
Comments on the plan will be accepted until December 11
Ellen Denzer went over the transitional area issues with the Committee. She stated that Denny Darnold,
Planner for the City of Hudson, has written a letter to the Planning Office recommending designation of an
addition to the transition zone within the Town of Troy. Denzer added that the Town of Troy is in
agreement with the City on this zone. Two of the affected property owners have written letters requesting
the change. Denzer showed the map of this area to the Committee and recommended that the committee
approve this map as the town, county and city are all in agreement. After reviewing the map, a motion
was made by Hense, second by Raymond to adopt this transition zone. All in favor. Motion carried.
Ellen Denzer handed out a summary of comments from the public hearings, for the Committee to review.
This handout included comments from the Department of Natural Resources. She went over the
comments with the Committee. After some discussion, a motion was made by Larson, second by
Raymond to approve the changes to the Plan as recommended by the Planning Department. Fodroczi
told the Committee that they would try to have this in final form for the committee to look at by the next
meeting.
Violations and Citations
The Committee reviewed the violation/citation list with Fisher and Jon Sonnentag. Fisher believes they
have made positive progress in this area.
Rezonements
Fisher stated that there are no new rezonements to be scheduled.

Municipal Plats
Fisher stated that there is one municipal plat this month. The Committee reviewed the plat for Tall Grass
Subdivision in the City of Hudson. A motion was made by Hense, second by Luckey stating that the
Committee has no objection to this plat. All in favor. Motion carried.
Glen Hills Moratorium Update
Rod Eslinger handed out a memo to the Committee outlining a schedule and what the staff plans to do to
meet the deadline of this moratorium. He went over the timeline for this project that was stated in the
memo. They plan to hold informational meetings at the town halls in January, public hearings in February
and present information to County Board in March.
Release of Escrow Funds for the Town of Rush River
Fisher explained to the Committee that the Town of Rush River has revised their request of last month for
release of escrow funds. They are asking for $1134 to be put towards playground equipment for a shared
park in Baldwin. Motion by Larson, second by Jensen to approve Rush River request. Luckey made a
motion to amend motion to approve, with the Town of Rush River supplying zoning with an estimate of
what the money would be used for. There was no second to the amendment, so the motion failed.
Jensen, Larson, Hense and Raymond voted yes to the original motion. Luckey voted no. Motion carried.
Town of Hudson Zoning Ordinance Amendment Review/ Ratification
Fisher presented this amendment to the Committee and stated that it is a reasonable change and staff
recommends approval. The request is to amend Section 2.8.1 of the Town of. Hudson Zoning Ordinance.
A motion was made by Raymond, second by Hense to approve amendment. All in favor. Motion carried.
Weber Rezonement Ordinance
Fisher went over the ordinance that was drafted by the staff in this matter. He stated that it reflects the
Board's direction to the Committee to draw up this ordinance for approval of the rezonement. This will be
presented to the County Board on December 14". The Committee reviewed and stated that this review
does not necessarily reflect that they approve of all of the information in Exhibit 2, Corporation Counsel's
memo.
The Committee recessed at 12:05 p.m.
The Committee reconvened at 12:15 p.m.
Direct Farm Marketing Ordinance
Jon Sonnentag handed out information on the drafting of this new ordinance. He went over the handout
with the Committee. He stated that they are looking at Option 2, as it seems to make the most sense for
this ordinance. Fisher added that they have not decided whether this will be strictly for ag zoned districts,
or will include ag/residential. He further stated that some of the towns are already zoned ag/residential, so
need to take that into consideration.
There was a lengthy discussion on the process for this new ordinance. The Committee would like to see
Zoning start with a small amendment to help farm related businesses only. The amendment as proposed
needs to be simplified. Fisher will keep the Committee updated on their progress.
St. Croix Riverway Ordinance Discussion
Chairman Raymond stated that he wants to take something to the Board in January on this issue. He
believes something needs to be done. They will discuss what to bring to the Board at the next meeting in
December.
Motion by Raymond, second by Jensen to rescind instruction to Zoning staff to change the 50% rule in the
Riverway as stated in September 14, 1999 minutes. Hense, Larson, Jensen and Raymond voted in favor.
Luckey abstained. Motion carried.
Motion by Larson, second by Hense to adjourn meeting. Motion carried. Meeting adjourned at 12:50 p.m.

beginning.
Committee action: Motion by Hense, second by Larson to approve with conditions. Motion

Staff Recommendation: Conditional approval: 1) Verification of stormwater discharge permit to
be furnished at final plat. 2) Financial guarantees to be submitted. 3) A construction waiver will be
approved when the guarantees are received and approved by the Zoning Office. 4) The County
Highway Dept. and the Land and Water Conservation Office to be notified three (3) days prior to
