Staff present: Mary Jenkins The hearing was called to order at 7:10 p.m. by Chairman Raymond, The rules of the hearing were explained and the hearing notice was read into the record. Zoning Business: Dennis Emmert to rezone 4.0 acres of land from Agriculture to Commercial. Location: A parcel of land located in the NE 1/4 of the NE 1/4 of Section 27, T30N-R17W, Town of Erin Prairie, St. Croix County Wisconsin. Dennis Emmert, 1881 140th Avenue, Baldwin, Wisconsin, told committee members that he has installed a large LP gas tank on his property. There is a gas company that wants to lease the tank and use it as a distribution point. The gas would be used for corn drying and home heating. Chairman Raymond asked if anyone wished to speak in favor of or in opposition to the rezoning. Vern Nagle, 1750 140th Avenue, New Richmond, Wisconsin, a neighbor of Emmert, inquired as to whether the area would be for the tank only or if it would open the 4.0 acres for other commercial activities. Chairman Raymond explained that once it is rezoned any permitted use in the Commercial District would be permitted on the parcel. He further explained that the present ordinance requires a Board of Adjustment permit for any use, however, the proposed ordinance, scheduled to be adopted in the next year, will have a series of permitted uses that are allowed without a special use permit. Supervisor Luckey told those present that the town veto power allowed by the current ordinance may disappear with the new ordinance forcing the town to accept permitted uses as listed by ordinance. Dennis Emmert said that at this time they have no intention of any other use on the property, and explained the boundaries of the 4.0 acres. John Dalton, Town Board Chairman, told the committee that the town supports the ag use, and feels there is no liability for the town. Dennis Mitchell, Town Board Supervisor, questioned whether the acreage could be less, stating that this could limit future commercial activities. Staff has recommended that the committee look at the compatibility with surrounding uses as well as whether rezoning this parcel would be spot zoning when making a decision on the request. The committee discussed whether the use could be permitted as an ag related use and the parcel rezoned to Ag Residential as opposed to Commercial. Chairman Raymond summarized the committee option as rezoning the parcel to Ag Residential if the use would fit the district, rezoning to Commercial but a lesser acreage than requested, or approving the rezoning to Commercial for the acreage requested by the applicant. A motion was made by Jensen to have staff review with the county's legal counsel to determine if the Ag Residential District would be applicable and if so, to republish the notice and reschedule the hearing. If this is not workable, the committee will attempt to reach a decision on the original request at their November 10 meeting. The motion was seconded by Hense. Motion carried.
