Committee Present: Ron Raymond, Gerald Larson, Linda Luckey, Art Jensen
Committee Absent: Dave Hense (excused)
Staff Present: Mary Jenkins
Chairman Raymond called the hearing to order at 7:00 p.m. A motion was made by Luckey and seconded
by Jensen to adopt the agenda. Motion carried. The hearing notice was read into the record. Chairman
Raymond explained the hearing procedure.
Zoning Business: Garland Fregine to rezone 10.0 acres of land from Agriculture to Ag/Residential.
Location: A parcel of land located in the NE 1/4 of the NW 1/4, Section 23, T28N-
R16W, Town of Eau Galle, St. Croix County, Wisconsin.
The Committee and staff discussed problems with the legal publication. Jenkins explained that the
application was for the NE 1/4 of the NE 1/4 of Section 23, and upon researching the records, it was
discovered that the parcel to be rezoned is also in the NW 1/4 of the NW 1/4 of Section 23. An additional
problem is that the 10 acre parcel exceeds the 3:1 lot ratio standard required by the Subdivision Ordinance.
She told the Committee that the Fregines are planning to convey the parcel as a separate parcel, and
advised members that they should not be approving a parcel that would require a variance when the lot is
created.
Committee also discussed access for the parcel requested to be rezoned. Mr. Fregine explained that an
easement from the town road will provide access.
In discussion with the applicants, it was agreed that Mr. Fregine would have a certified survey map created
showing a parcel that meets the 3:1 lot ratio. He will contact the Zoning Office when the map is completed
and the hearing will be rescheduled. The Committee discussed having the easement created and recorded
prior to approval of the rezoning.
A motion was made by Luckey and seconded by Larson to adjourn. Motion carried.
