October 21,1998
Rush River Town Hall
Committee present: Ron Raymond,
Jensen.
Staff present: Mary Jenkins.
Dave Hense, Gerald Larson, Linda Luckey, Art
The hearing was called to order at 7:08 p.m. by Chairman Ron Raymond. Raymond explained
the rules of the hearing. The hearing notice was read into the record.
Zoning Business: Richard Walton to rezone a 1.00 acre parcel of land from
Agriculture to Ag Residential. Location: A parcel of land located
in the SE 1/4 of the SE 1/4 of Section 14, T28N-R17W, Town of
Rush River, St. Croix County, Wisconsin.
Richard Walton, 1964 30th Avenue, Baldwin, Wisconsin, told the committee that he wants to
rezone a 1.00 acre parcel with an existing residence on it. It has always been rental property
and now he wishes to sell the house with one acre of land.
Chairman Raymond asked for comments in favor of or opposed to the rezoning. No comments
were received.
Wayne Loock, Rush River Town Board Chairman, told the committee that a letter supporting the
rezoning request was mailed to the Zoning Office. The town has addressed the provisions of
Wisconsin Statute 91.77. There was discussion on the number of residences allowed for an Ag
parcel.
The staff recommendation was given by Jenkins. Recognizing that the provisions of Wisconsin
Statute 91.77 are not substantially affected due to the fact that a residence already exists on the
lot, staff recommends approval of the request.
A motion was made by Hense, seconded by Larson, to close the hearing. Motion carried.
A motion was made by Jensen to recommend the County Board approve the rezoning request
of Richard Walton to rezone one acre of land from Ag to Ag Residential, stipulating that the
provisions of Wisconsin Statute 91.77 have been addressed by both the town and the county.
The motion was seconded by Hense. Motion carried.
A motion was made by Hense and seconded by Larson to adjourn. Motion carried. Hearing
adjourned at 7:25 p.m.
Gerald Larson, Secretary Jenkins, Recorder
