HomeMy WebLinkAboutPlanning Zoning & Parks 09-29-98Planning, Zoning & Parks Committee September 29, 1998 St. Croix County Government Center Hudson, Wisconsin Committee members present: Ron Raymond, Dave Hense, Linda Luckey, Art Jensen, Gerald Larson The hearing was called to order by Chairman Raymond at 10:00 a.m. at the regular monthly meeting of the committee. Zoning business: Article: 17.15(2), Variance to the minimum lot size Appellant: Michael L. Cody Location: The SW%-SE'/4 & the SE'/4-SE'/, Section 33, T31 N-R18W, Town of Star Prairie, St. Croix County, Wisconsin The hearing notice was read into the record and the rules of the hearing were explained. Michael Cody, 1820 110th Street, New Richmond, told the committee that in 1989 the above property was rezoned to Commercial to accommodate a storage unit facility that is on the property. A meat shop is also on the 2.5 acre lot. Mr. Cody sold all of the land and the storage units, but retained ownership of the meat shop. He now has a buyer for the meat shop, however, the buyer wants to also purchase the land the meat shop sits on. Cody wants to sell him approximately 1/2 acre. He explained to the committee that due to the highway on the south, storage units on the east, farm buildings on the west, and a feed lot on the north, he cannot sell the required one acre to fulfill the one acre requirement. The committee questioned why Cody is applying for the variance when he isn't the owner. He said the owner is his son-in-law and he is representing the owner. Cody presented committee members with a copy of the existing lot with a line drawn showing where he proposed to split the lot. Jim Thompson, County Zoning Specialist, spoke to the committee about the need to identify an alternate site for a septic system on the 1/2 acre. Well issues were also discussed. Supervisor Larson questioned the distance to municipal sewer and water and Cody said it is approximately 3/4 mile from his property. A motion was made by Hense, seconded by Larson, to recess the hearing. Motion carried. A motion was made by Hense to postpone a decision on the request of Michael Cody in order to view the property on October 13. The request will be placed on the November 10 meeting agenda for a decision to be made. The motion was seconded by Raymond. Motion carried. Staff will contact the Department of Transportation prior to October 13 to determine the affect of the proposed new road. The committee returned to the business of the regular meeting.
