Committee present: Ron Raymond, Art Jensen, Dave Hense, Gerald
Larson, Linda Luckey.
Staff present: Mary Jenkins.
The hearing was called to order at 7:30 PM by Chairman Raymond. The hearing
notice was read into the record.
Zoning business: Charles & Janet Webster to rezone a 5
acre parcel of land from Ag to Ag
Residential. Location: The SW'/4 of the
NE'/4of Section 21, T28N-R19W, Town
of Troy, St. Croix County, Wisconsin.
Chairman Raymond explained the procedure and rules of the hearing.
Rick Johnson, 7595 18 Street N., Oakdale, MN, son-in-law of the owner, told the
committee that they wish to rezone a 3.16 acre parcel that Mr. Webster owns for the
purpose of building one single family home. An easement will be given to Johnson
for access to Chinnock Lane. He said that the proposed lot is on the SE corner of a
40 acres parcel which lies adjacent to the plat of Wyngate.
Charles Webster told the committee members that he has owned the 40 acres since
1983 and that 2 of the 3 acres has never been farmed due to prohibitive slopes.
Dean Albert, Town of Troy Chairman, said that the request fits the town criteria for
rezoning, and that the town supports the request. Reference was made to
correspondence from the Clerk dated September 16 that was FAXED to the Zoning
Office.
Supervisor Larson questioned why the application was for 5 acres, when tonight it has
been submitted as 3.16 acres. Charles Webster said that because the exact acreage
was not known at the time of the written application, they asked for more than they
needed in order to eliminate the need for a new hearing if the actual acreage became
more than the published amount.
Supervisor Luckey asked Town Board Chairman Albert if the town had considered the
provisions of WI Stat. 91.77. Albert outlined the criteria used by the town in making
the recommendation, and said they had considered the statutory provision.
Jenkins presented the staff recommendation, recommending approval of the request
based on the fact that both the town and county have considered the provisions of
Wisconsin Statute 91.77, and that only 1 acre is being taken out of farm production.
Chairman Raymond called for further remarks in support or opposition of the request.
When none were voiced, he called for a motion to close the hearing.
A motion was made by Hense and seconded by Jensen to close the hearing. Motion
carried.
A motion was made by Hense to recommend approval to the County Board on the
request of Charles Webster to rezone 3.16 acres from Ag to Ag Residential, stipulating
that both the Town and the County have addressed the provisions of Wisconsin
Statute 91.77. The motion was seconded by Jensen. Motion carried.
A motion was made by Hense and seconded by Larson to adjourn. Motion carried.
The hearing adjourned at 7:50 PM.
