OLD BUSINESS: Troy Glen subdivision preliminary plat - continuation from previous
meeting.
NEW BUSINESS:
1) Walter W. Nelson to rezone a 20.92 acre parcel of land from Agriculture to
Commercial. Location: A parcel of land located in the SE 1/4 of the SE 1/4 of
Section 1, T28N-R17W, Town of Rush River, St. Croix County, Wisconsin.

The hearing was called to order at 7:45 p.m. by Chairman Ron Raymond. The rules of the
hearing were explained and the hearing notice was read into the record.
Zoning Business: 1. Troy Glen Major Subdivision, preliminary plat
approval, continuation from previous meeting.
2. Walter W. Nelson to rezone a 20.92 acre parcel
of land from Agriculture to Commercial. Location:
A parcel of land located in the SE'/4 of the SE'/4 of
Section 1, T28N-R17W, Town of Rush River, St.
Croix County, Wisconsin.
1. Jenkins explained that the preliminary plat of Troy Glen had come to the committee prior to
approval by the Land & Water Conservation Committee. It now has been given approval by that
committee, and is presented tonight for preliminary plat approval. Conditions are that the town
conditions be met (all setbacks to be 100 ft., screening on Plainview Drive, and tree planting on
Lot 5), and that map revisions be made as listed in correspondence of 8-24-98 from the Highway
Department. A motion was made by Hense, seconded by Jensen, to conditionally approve the
plat with the conditions as listed above. Motion carried.
2. Walter Nelson, 2081 60th Avenue, Baldwin, Wisconsin, told the committee that he wishes to
rezone a 20.92 acre parcel of land from Agriculture to Commercial. When he purchased the
parcel 17 years ago it was zoned Commercial. He explained the location of the parcel as being
adjacent to the Village of Baldwin, at the intersection of S. T. H. 63 and 1 94. He has an
interested buyer at this time, and would like to have it back in the Commercial Zoning District.
There was discussion on Mr. Nelson's participation in the Farmland Preservation Program and
any required paybacks if the zoning district is changed.
Chairman Raymond asked for comments supporting the rezoning or in opposition to the request.
No comments were received.
A letter from the Town of Rush River, in support of the rezoning, was read into the record by
Jenkins. Raymond discussed the need for the town to address the provisions of Wisconsin
Statute 91.77. Wayne Loock, Town Board Chairman, told the committee that the statute has
been considered.
Jenkins told committee members that the staff recommends approval of the request, noting that
Wisconsin Statute 91.77 had been addressed by both the town and the county, and that the
district will be compatible with surrounding uses that are in close proximity to the highway and
the village.
A motion was made by Hense, seconded by Larson, to close the hearing. Motion carried.
A motion was made by Larson to recommend the County Board approve the rezoning request
of Walter W. Nelson to rezone a 20.92 acre parcel from Agriculture to Commercial, recognizing
that the provisions of Wisconsin Statute 91.77 have been addressed. The motion was seconded
by Jensen. Motion carried.
A motion was made by Hense and seconded by Larson to adjourn. Motion carried. The hearing
adjourned at 8:20 p.m.
